Trade Agreement: Canadian Free Trade Agreement (CFTA) Tendering Procedures: Generally only one firm has been invited to bid Non-Competitive Procurement Strategy: Exclusive Rights Comprehensive Land Claim Agreement: No Vendor Name and Address: SANOFI PASTEUR LIMITED/SANOFI PASTEUR LIMITEE sanofi pasteur Limited Connaught Campus 1755 Steeles Ave West North York Ontario Canada M2R3T4 Nature of Requirements: Definition of Requirement: PSPC proposes to negotiate with Sanofi Pasteur Ltd. for the purchase of Imovax Polio®, Td Ads®, Tubersol® and YF-Vax®. This requirement falls within the Federal/Provincial/Territorial (F/P/T) Group Purchasing Program for Drugs and Vaccines. Yearly Quantities (Approximately): Imovax Polio®: 60,379 doses Td Ads®: 518,255 doses Tubersol®: 638,525 tests YF-Vax®: 1,902 doses Contract Period: April 1, 2021 to March 31, 2022, with an option to extend the contract period for three additional one-year periods. Delivery: Will be on an as-and-when requested basis. Trade Agreements: The provisions of the Canada-United States-Mexico Agreement (CUSMA) do not apply as The Government Procurement Chapter does not apply to Canada. The provisions of the WTO-AGP, Canada-Chile Free Trade Agreement (CCFTA), Canada-Columbia Free Trade Agreement (CCOFTA), Canada-Peru Free Trade Agreement (CPFTA), Canada-European Union Comprehensive Economic and Trade Agreement (CETA) and Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP) are not applicable for reasons connected with the protection of human life and health (see WTO-AGP article XXIII (2); CCFTA article Kbis-16 para. 2 (b); CCOFTA article 2201 para 3 (a); CPFTA article 1402 para. 2 (b) ; CETA Annex 19-3 para. 2 (b) and CPTPP article 15.3.1 (b) because of the absence of regulatory harmonization between Canada and the other signatory countries to the WTO, CCFTA, CCOPTA, CPFTA, CETA and CPTPP. This requirement is subject to the Agreement on Internal Trade (AIT). This requirement is for the Federal/Provincial/Territorial (F/P/T) Group Purchasing Program for Drugs and Vaccines. Canada is acting as a purchasing agent for Provincial and/or Territorial Governments. Limited Tendering Reason: It is intended to negotiate directly with Sanofi Pasteur Ltd. as they are the only known source of supply licensed by Health Canada. Delivery Date: 01/04/2021 You are hereby notified that the government intends to negotiate with one firm only as identified above. Should you have any questions concerning this requirement, contact the contracting officer identified above. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
