Advance Contract Award Notice (ACAN) An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Definition of the requirement Statistics Canada has a requirement for the supply of an up-to-date electronic database of all available published business and residential telephone numbers in Canada in order to perform respondent tracing. This database is used as the first source of tracing information and the primary means of research when a respondent (an individual selected for a Statistics Canada survey) cannot be contacted. The database must be current and routinely updated on a monthly basis with new information about telephone number changes, and must contain a minimum of 90% of all published business and residential telephone listings in Canada. 3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements) Any interested supplier must demonstrate by way of a statement of capabilities that its database meets the following requirements: 1. Electronic full file downloads must be updated monthly. 2. Files must be delimited according to the layout included at Appendix A, and must be delivered via a Windows-compatible ASCII format. 3. The database must contain the following fields: Field Name - Type - Width Area Code - Char - 3 Exchange - Char - 3 Number - Char - 4 Prefix (Mr., Mrs., etc.) - Char - 15 First Name - Char - 30 Last Name / Company Name - Char - 60 Suffix (Sr., Jr., etc.) - Char - 5 House Number - Char - 6 House Suffix (A, B, ½, etc.) - Char - 3 Street - Char - 30 Location Type (Apt, Unit, etc.) - Char - 14 Location Number (Apt/Unit number) - Char - 6 City - Char - 20 Province - Char - 2 Postal Code - Char - 6 Language - Char - 1 Type (B/R: Business or Residential) - Char - 1 4. The database must identify each published telephone number as belonging to either a business or a residence (i.e., no missing values in the Type field). 5. The database must cover at least 90% of all business and residential telephone number listings currently published in Canada. 6. The database must cover at least 90% of all listed business and residential telephone numbers in each province. 7. The database must include published telephone listings from all of the following telephone companies: Telephone Company - Geographic Area Aliant Inc. - NB, NS, PEI, NL Telebec Ltee - Portion of 418’, 450’, and 819’ area codes in Quebec Telus Quebec - Eastern Quebec Groupe Videotron - Quebec Bell Canada - Ontario & Quebec, excluding; Telus Quebec / Telebec Ltee Mountain Cablevision - Ontario- Hamilton area Rogers Home Phone - ON, QC, Maritimes Northern Tel - Portion of 705’ area code in Ontario Manitoba Telecom - Manitoba SaskTel - Saskatchewan Telus - British Columbia and Alberta 8. The database must contain the minimum number of published telephone listings and unique telephone numbers for each of the provinces and territories as follows: Province/Territory - Minimum Number of Listings - Minimum Number of Unique Telephone Numbers Newfoundland and Labrador - 185,000 - 170,000 Prince Edward Island - 55,000 - 45,000 Nova Scotia - 340,000 - 300,000 New Brunswick - 310,000 - 275,000 Quebec - 2,820,000 - 2,800,000 Ontario - 3,600,000 - 3,400,000 Manitoba - 325,000 - 290,000 Saskatchewan - 335,000 - 300,000 Alberta - 1,000,000 - 940,000 British Columbia - 1,300,000 - 1,150,000 Yukon - 10,000 - 8,000 Northwest Territories - 6,000 - 5,000 Nunavut - 6,000 - 5,000 9. At least 70% of the published residential listings must have an address meeting the following criterion: non-blank house number and non-blank street name and non-blank postal code. The postal code must contain six (6) characters. 10. For multi-unit residential addresses (i.e. where there are more than five (5) residential listings at the same combination of house number + street name + full 6-character postal code, at least 70% of the listings must contain non-blank information in the house suffix OR location type OR location number. 11. Telephone and e-mail support services in English and Canadian French available between 08:00 - 20:00 local time, Monday through Friday, exclusive of Canadian statutory holidays. 4. Applicability of the trade agreements to the procurement This procurement is subject to the following trade agreement: - Canadian Free Trade Agreement (CFTA) 5. Justification for the Pre-Identified Supplier Info-Direct is the only known database that can meet all of the above mandatory requirements. Deloitte is the only provider of monthly file update information directly from major telephone companies for published business and residential telephone numbers in Canada. Deloitte retains an exclusive relationship with Yellow Pages Group, the sole directory publisher of multiple telecommunications companies (including Telus, Manitoba Tel, and Videotron White Pages). Furthermore, all publicly-available information in the database is run through cleansing processes that are exclusive to Deloitte and RSTS. Finally, Deloitte does not offer the Info-Direct database through resellers. Therefore, Deloitte is the only vendor that can satisfy the requirement for the reason of exclusive and proprietary rights. 6. Government Contracts Regulations Exception(s) The following exception to the Government Contracts Regulations is invoked for this procurement under subsection: 6(d) - "only one person is capable of performing the work. 7. Exclusions and/or Limited Tendering Reasons The following exclusion(s) and/or limited tendering reasons are invoked under the: - Canadian Free Trade Agreement (CFTA) - Article 513, paragraph (b), section ii) 8. Ownership of Intellectual Property Ownership of any Foreground Intellectual Property arising out of the proposed contract will vest with the Contractor. 9. Period of the proposed contract or delivery date The proposed contract is for a period of one (1) year, from the date of contract award, and includes an option to extend the contract period by three (3) one-year periods. 10. Suppliers’ right to submit a statement of capabilities Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 12. Closing date for a submission of a statement of capabilities The closing date and time for accepting statements of capabilities is January 10, 2020 at 2:00 p.m. EST. 13. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
