    1. Advance Contract Award Notice (ACAN) 
    An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 
    
    2. Definition of the requirement 
    The mass spectrometry services group of Health Canada’s Food Research Division currently house three high-resolution magnetic sector GC-MS (gas chromatography - mass spectrometry) systems that are not currently functional. In order to restore the capacity of the laboratories to provide reliable and timely GC-MS analytical services to the Division, Health Canada requires a new High-Resolution magnetic sector GC-MS system. This work involves high-throughput chemical analyses and requires the best available sensitivity for a variety of classes of chemical compounds such as Dioxins, PCBs, flame retardants, and persistent organic pollutants.  To achieve this, a high-resolution magnetic sector GC-MS system is needed.
    
    3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements) 
    Any interested supplier must demonstrate by way of a statement of capabilities that its product meets all of the following requirements: 
    (i) must include a double-focussing magnetic sector mass spectrometer along with an air-cooled water chiller and step up isolation transformer that meet the manufacturers specificiations for instrument operation;  
    (ii) the mass spectrometer must include an Electron Ionization Source region;
    (iii) must include two gas chromatographs, both connected to the mass spectrometer, which can be operated independently, or in a method-integrated fashion allowing mass spectrometer data to be generated from one gas chromatographs system output during the cycle down time in the other and inversely;
    (iv) both of the gas chromatographs must have two injector ports, of which one must be configured with a programmable temperature vaporizing injector and the other configured with a helium saver module;
    (v) must achieve a raw data signal to noise ratio > 200:1 when analysing 20 fg of the compound 2,3,7,8-TCDD (m/z 321.893) at a resolution of 10,000 (resolved at 10% peak height) using a DB-5MS (or equivalent) fused silica column (30 m length; 0.25mm ID; 0.1µm film thickness);
    (vi) must include an autosampling apparatus capable of holding at least 50 2ml vials at a programmable controled temperature between 4oC - 40oC, inclusive;
    (vii) must include a computer (including keyboard, 24 inch monitor and mouse) with Windows 10 OS, equipped with software to control both the mass spectrometer and gas chromatographs components of the system and to generate and execute gas chromatographs - mass spectrometer methods for targeted, quantitative chemical analyses. The software must collect and process raw data for review and report generation.
    
    4. Applicability of the trade agreement(s) to the procurement

    5. Justification for the Pre-Identified Supplier 
    The ThermoFisher Gas Chromatograph/Mass Spectrometer System is the only known system that meets all of the minimum essential requirements detailed herein. Isomass Scientific Inc. are the exclusive Canadian Agents for the sale of this Thermo Fisher Scientific system.
    
    6. Government Contracts Regulations Exception(s) 
    The following exception(s) to the Government Contracts Regulations is (are) invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work".

    8. Ownership of Intellectual Property 
    Ownership of any Foreground Intellectual Property arising out of the proposed contract will vest in the Contractor.

    Suppliers who consider themselves fully qualified and available to provide the goods described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
    
    12. Closing date for a submission of a statement of capabilities: 
    The closing date and time for accepting statements of capabilities is January 28 2021 at 2:00 p.m. EST.

    An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award.  However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.
    
    Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
    
    The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page.
    
    The Crown retains the right to negotiate with suppliers on any procurement.
