    1. Advance Contract Award Notice (ACAN) 
    An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 
    
    2. Definition of the requirement 
    The National Research Council Canada has a requirement for the supply of a portable LDS methane and ethane gas analyzer, including a hardshell carrying case, battery pack and wireless display. The analyzer will be used in multiple applications including field measurements of atmospheric methane levels, tailpipe measurement of methane concentrations in natural gas-fueled engines, as well as serving as a benchmark for in-house designed sensors characterization and calibrations. The Aeris Technologies MIRA Pico LDS analyzer’s size, weight and power consumption makes it a truly portable device. It can be mounted on a mobile platform and includes a smart power routing circuit and a battery pack which allows for it to be used in field measurements where access is limited. 
    
    3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements) 
    Any interested supplier must demonstrate by way of a statement of capabilities that its analyzer meets the following requirements: 
    
    o The analyzer must meet all of the following gas analysis requirements:
    - The analyzer must have methane concentration measurement with sensitivity better than 1 parts-per-billion (by volume) per second;
    - The analyzer must be software-configurable for measurement of sub-atmospheric methane concentrations as well as percentage level concentrations without any hardware modifications;
    - The analyzer must have ethane concentration measurement with sensitivity better than 0.5 parts-per-billion (by volume) per second;
    - The analyzer must enable the user to identify thermogenic and biogenic emission sources by real-time display of ethane to methane ratio; and 
    - The analyzer must have water vapor concentration measurement capability.
    
    o The analyzer must operate in the following minimum range of environmental conditions:
    - Temperature: 10 °C to 40 °C, with drift less than or equal to 30 parts-per-billion or 1% of reading; and
    - Humidity: 10% to 95% (non-condensing).
    
    o The analyzer must provide the following user interface, data communication and storage capabilities:
    - A graphical user interface on a separate wireless display linked to the analyzer’s internal CPU system with update rate faster than or equal to 1 Hz;
    - Standard RS-232 or TTL serial communication support;
    - At least one USB host connection for data transfer between internal memory and external memory modules; and 
    - A minimum internal storage capacity of 32 GB.
    
    o The analyzer must meet all of the following weight and size requirements (i.e. not including the wireless display and mains power supply):
    - Width less than or equal to 29.5 cm
    - Depth less than or equal to 20.5 cm
    - Height less than or equal to 9.6 cm
    - Weight less than or equal to 2.75 kg (including internal battery and sampling pump).
    
    o The analyzer system must meet the following power requirements:
    - Power consumption less than or equal to 15W (at room temperature); and
    - Must possess an internal battery power source with minimum 6 hours of run time as well as a main 110 VAC power supply unit.
    
    4. Applicability of the trade agreement(s) to the procurement 
    This procurement is subject to the following trade agreement: 
    o Canadian Free Trade Agreement (CFTA)
    
    5. Justification for the Pre-Identified Supplier 
    The Aeris Technologies MIRA Pico LDS analyzer is the only known instrument that meets all of the minimum essential requirements detailed herein. Aeris Technologies is the original equipment manufacturer (OEM) of this instrument, owner of all related Intellectual Property and is the only known supplier that can supply an analyzer meeting all of the minimum essential requirements detailed herein.
    
    6. Government Contracts Regulations Exception(s) 
    The following exception(s) to the Government Contracts Regulations is (are) invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work". 
    
    7. Exclusions and/or Limited Tendering Reasons 
    The following exclusion(s) and/or limited tendering reasons are invoked under the: 
    o Canadian Free Trade Agreement (CFTA) - Articlev513.1 (b) (iii)
    
    8. Ownership of Intellectual Property
    Ownership of any Foreground Intellectual Property arising out of the proposed contract will vest in the Contractor.
    
    9. Period of the proposed contract or delivery date 
    The analyzer must be delivered on or before August 27 2021.

    11. Suppliers' right to submit a statement of capabilities 
    Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
    
    12. Closing date for a submission of a statement of capabilities 
    The closing date and time for accepting statements of capabilities is 2pm EDT June 25 2021.

    An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award.  However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.
    
    Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
    
    The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page.
    
    The Crown retains the right to negotiate with suppliers on any procurement.
