    1. Advance Contract Award Notice (ACAN) 
    An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 
    
    2. Definition of the requirement 
    Health Canada has a requirement for the supply of a radon progeny particle size spectrometer including all software and one year warranty and maintenance and support services. The spectrometer will be used to provide guidance to Canadians regarding health effects from exposure to indoor radon and ways to protect themselves from radon-induced lung cancer. The spectrometer will allow Health Canada to carry out measurements of the short-lived radon progeny particle size distribution for both unattached and attached fractions of the radioactive aerosol in an indoor environment to better understand the dosimetric implications of radon inhalation. 
    
    3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements) 
    Any interested supplier must demonstrate by way of a statement of capabilities that its system meets the following requirements: 
    
    • The spectrometer must provide the measurement of the particle size distributions of radioactive aerosols from short-lived radon progeny in the size range from 1 nanometer (nm) to 1 micrometer (µm), inclusive, in diameter;
    • The spectrometer must be built based on multistage diffusion batteries with a minimum of eight channels operated in parallel with each stage having an individual pump, flow meter and passivated implanted planar silicon (PIPS) alpha detector with minimum counting efficiency of 40% for the measurement of potential alpha energy concentration;
    • The flow rate for the pump for each of the channels must be adjustable from 0.2 litres to 5 litres, inclusive, per minute;
    • The spectrometer must provide Low level of detection (LLD) for the potential alpha energy concentration (PAEC) for the alpha detectors and must be equal to or lower than 30E-9 Joule per cubic meter (J/m3) with 95% confidence interval for a counting time of 5 hours;
    • The spectrometer must have a built-in microcontroller to run the system without any external computer control;
    • The spectrometer must include all software (including source code) to enable analysis of data output in Microsoft Excel and Visual Basic for Applications (VBA);
    • The data analysis software must calculate and generate reports for the geometric mean diameter, geometric standard deviation and the percentage contribution to the potential alpha energy concentration (PAEC) for each of the modes (unattached, nucleation and accumulation modes) for a multimodal size distribution from the particle size distributions data;
    • The data analysis software must calculate and generate reports for effective-dose from the short-lived (half-life less than or equal to 30 minutes) radon progeny particle size distribution and PAEC measurement results;
    • The spectrometer must be built inside a protective case for air transport as checked luggage; 
    • The spectrometer must operate using 120 volt, 60 Hz power; and 
    • The spectrometer must operate using a rechargeable battery with a minimum battery life of 3 hours operating time.

    5. Justification for the Pre-Identified Supplier    
    The Australian Radiation Protection and Nuclear Safety Agency (ARPANSA) 
    radon progeny size spectrometer is the only known spectrometer that meets all of the minimum essential requirements detailed herein. ARPANSA is the original equipment manufacturer (OEM) of this instrument, owner of all related Intellectual Property and is the only known supplier that can supply a spectrometer meeting all of the minimum essential requirements detailed herein. 
    
    6. Government Contracts Regulations Exception(s) 
    The following exception(s) to the Government Contracts Regulations is (are) invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work". 
    
    7. Exclusions and/or Limited Tendering Reasons 
    The following exclusion(s) and/or limited tendering reasons are invoked under the:

    8. Ownership of Intellectual Property
    Ownership of any Foreground Intellectual Property arising out of the proposed contract will vest in the Contractor.

The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
    
    12. Closing date for a submission of a statement of capabilities 
    The closing date and time for accepting statements of capabilities is 2pm EST December 31 2021.

    An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award.  However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.
