Advance Contract Award Notice (ACAN) An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contractingofficer may then proceed with the award to the pre-identified supplier. 2. Definition of the requirement The National Research Council of Canada’s Measurement Science and Standards portfolio (NRC-MSS) has a requirement for a Mass Spectrometer (MS) suite that will integrate into NRC’s existing infrastructure, and enhance NRC’s capabilities in measurement science. The requirement includes the following 3 instruments, and maintenance and support services for 12 months: 1. One Element XR sector-field inductively coupled plasma mass spectrometer (072472) 2. One Neptune plus High Resolution Multicollector ICP-MS (0746521) 3. One Orbitrap Fusion Lumos mass spectrometer (FSN02-10000) 3. Criteria for assessment of the Statement of Capabilities Any interested supplier must demonstrate by way of a statement of capabilities that its equipment meets the following requirements: -The Element XR sector-field inductively coupled plasma mass spectrometer must deliver: • Mass resolution of 10,000 or better • Dynamic range of 12 orders of magnitude • Software compatibility with existing Element2 instrument’s methods/procedures and data files • Enabled for speciation applications including control of chromatography (GC and LC) peripherals and associated data handling -The Neptune plus High Resolution Multicollector ICP-MS must deliver: • Mass resolution of 8,000 or better • Software compatibility with existing Neptune instrument’s methods/procedures and data files • Enabled for speciation applications including control of chromatography (GC and LC) peripherals and associated data handling -The Orbitrap Fusion Lumos mass spectrometer must deliver: • Mass resolution of 500,000 or better • Software compatibility with existing LTQ-Orbitrap instrument’s methods/procedures and data files • Electron transfer dissociation capability - Must provide direct transfer of procedures currently performed on an Element 2, Neptune and LTQ-Orbitrap mass spectrometers, developed over a period of 15 years by NRC staff. -Software must be compatible with existing MS instrumentation (Element 2, Neptune and LTQ- Orbitrap mass spectrometers) for facilitated transfer of methods and settings and exported data must be compatibleon a common software platform (Xcalibur) in order to retrieve archived data files as required in accordance with international standards such as ISO 17025 and ISO Guide 34. - The mass spectrometer suite must be provided by a single manufacturer whomust be able to provide Original Equipment Manufacturer (OEM) maintenance and support services for the entire mass spectrometer suite. 4. Applicability of the trade agreement(s) to the procurement This procurement is subject to the following trade agreements: Agreement on Internal Trade (AIT) World Trade Organization - Agreement on Government Procurement (WTO-AGP) North American Free Trade Agreement (NAFTA) 5. Justification for the Pre-Identified Supplier Thermo Fisher Scientific is the OEM of the required instruments and is the only known supplier that can meet the requirements and ensure interchangeability with NRC’s existing infrastructure of mass spectrometer systems and instruments, parts, components, consumables, research protocols and methodologies and software platforms. 6. Government Contracts Regulations Exception The following exception(s) to the Government Contracts Regulations is invoked for this procurement under subsection: 6(d) - "only one person is capable of performing the work". 7. Exclusions and/or Limited Tendering Reasons The following exclusions and/or limited tendering reasons are invoked under the: Agreement on Internal Trade (AIT) - Article 506.12 (a) World Trade Organization - Agreement on Government Procurement (WTO-AGP) - Article XV.1 (d) North American Free Trade Agreement (NAFTA) - Article 1016.2 (b) 8. Ownership of Intellectual Property Ownership of any Foreground Intellectual Property arising out of the proposed contract will vest in the Contractor. 9. Period of the proposed contract or delivery date The equipment must be delivered on 31st December 2015. 10. Suppliers' right to submit a statement of capabilities Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 12. Closing date for a submission of a statement of capabilities The closing date and time for accepting statements of capabilities is December 15th, 2015 at 2:00 p.m. EST. 13. Should you have any questions concerning this requirement, contact the contracting officer identified above. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
