Advance Contract Award Notice (ACAN) An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contractingofficer may then proceed with the award to the pre-identified supplier. 2. Definition of the requirement Health Canada has a requirement for the supply and installation of 2 LC-MS/MS with user training for up to 3-4 persons for delivery to Ottawa, Ontario. The delivery is required by 31st March 2016. 3. Criteria for assessment of the Statement of Capabilities Any interested supplier must demonstrate by way of a statement of capabilities that its system meets the following requirements: The equipment is required to measure baseline levels of priority chemicals, including those mandated under the Government of Canada Chemicals Management Plan (CMP), and is essential for data collection in a timely manner to support regulatory activities. This equipment is necessary in order to collect ultra-low level exposure data in a wide variety of food matrices that is required for risk management decisions and setting compliance levels for these chemicals. The new system must be equipped with a Differential ion mobility separation (DMS) technology to distinguish isobaric metabolites and to remove isobaric matrix interferences resulting in a reduction in chemical background noise. The new system must be equipped with an off-axis curved LINAC collision cell to prevent neutral molecules entering the last quadrupole analyzer and the ion detection system, thus reduce the noise and lower the limit of detection. In order to analyze high molecular weight analytes (such as long-chain perfluorinated compounds), the new system must have a mass range of both quadrupole mass analyzers not less than 2,000 Da. The new system must have a scanning speed of both quadrupoles not slower than 12,000 Da/sec in all MS/MS scanning modes to obtain enough data points for the ever-narrower UPLC peaks. For multiple analyte analyses, the new system must have a minimum MRM cycle time (including the dwell time and inter-channel setting time) not slower than 5 msec. The responses under this rapid MRM transitionsmust not be different from long dwell time settings (e.g. 100 ms dwell and 10 msec inter-channel setting time). The new system must have a fast polarity switching (<5 msec) between positive ion detection and negative ion detection to be able to simultaneously collect information on hundreds different contaminants with different polar functional. The new system must have an additional dimension (3rd dimension) of MS/MS/MS and MRM3 analyses for unambiguous confirmation in both quantitative and qualitative determination of trace contaminants when high chemical background or challenging co-eluting interferences present in complex food matrices. Due to the complexity of the samples investigated and the narrow UPLC peaks, the new system must have a scanning speed in trapping mode to be at least 15,000 Da/sec to obtain enough data points. 4. Applicability of the trade agreements to the procurement This procurement is subject to the following trade agreements: Agreement on Internal Trade (AIT) World Trade Organization - Agreement on Government Procurement (WTO-AGP) North American Free Trade Agreement (NAFTA) 5. Justification for the Pre-Identified Supplier The only known supplier of a LC-MS/MS meeting all the above required technical specifications is the QTRAP® 6500+ from AB Sciex. For this reason, it is proposed to negotiate this requirement with the manufacturer AB Sciex, Concord, Ontario. 6. Government Contracts Regulations Exception The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work". 7. Exclusions and/or Limited Tendering Reasons The following exclusions and/or limited tendering reasons are invoked under the : Agreement on Internal Trade (AIT) - Article 506.12 (a) World Trade Organization - Agreement on Government Procurement (WTO-AGP) - Article XV.1 (d) North American Free Trade Agreement (NAFTA) - Article 1016.2 (b) 8. Ownership of Intellectual Property Ownership of any Foreground Intellectual Property arising out of the proposed contract will vest in the Contractor. 9. Suppliers' right to submit a statement of capabilities Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 12. Closing date for a submission of a statement of capabilities The closing date and time for accepting statements of capabilities is 6th January 2016 at 2:00 p.m. EST. 13. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
