Trade Agreement: NAFTA/AIT/Canada FTAs with Peru/Colombia/Panama Tendering Procedures: Generally only one firm has been invited to bid Non-Competitive Procurement Strategy: Exclusive Rights Comprehensive Land Claim Agreement: No Vendor Name and Address: Aerolab LLC 8291 Patuxent Range Rd Jessup Maryland United States 20794 Nature of Requirements: This amendment is raised to modify the delivery to read: The delivery is required on or before March 31, 2016. 1. Advance Contract Award Notice (ACAN) An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Definition of the requirement Environment Canada has a requirement for the supply, installation and training of 1 customized mini wind tunnel (MWT) to study the evaporation of liquid substances including crude and fuel oils under various wind speeds and temperatures for delivery to Ottawa, Ontario. 3. Criteria for assessment of the Statement of Capabilities Any interested supplier must demonstrate by way of a statement of capabilities that its equipment meets the following requirements: The MWT is to be operated in a small lab equipped with a fume hood. The outlet of the MWT (exhaust) will be connected/vented to the fume hood. Specifically, the MWT must have the following characteristics and be able to accommodate the following ranges of the variables noted below: Type Open circuit to let the evaporative part evacuate to outside and does not contaminate subsequent evaporation of the liquid. Length The maximum length of the MWT must not exceed 2.3 m. Size of the test chamber (length x width x height) Two test chambers with related accessories for installation on the MWT are required. The first one must be10 inch x 6 inch x 4 inch and the second must be 10 inch x 6 inch x 6 inch with related accessories for installation on the MWT. Wind speed The MWT must be designed to operate continuously with constant and uniform wind speed varying from 0 to ~10-15 m/s Flow uniformity and straightening The MWT must be equipped with honeycomb-type screen or better to ensure flow uniformity and straightening in the test section. Turbulence control The MWT must be equipped with the proper screening to reduce air turbulence in the test section when running experiments at high wind speeds. Operational temperature range and control The operational temperature range must be 0 to +35 oC or wider. The MWT must include an integrated cooling/heating system to control air temperature in the test chamber. Split systems are not accepted. Load cell The MWT must be equipped with a vertical load cell to record the changes in weight of the liquid held in a canister described below. The precision of the load cell must be 0.05 g or better. The cell must be able to handle weight up to 2 kg. An additional exactly the same load cell must be provided as a spare. Liquid canister The liquid whose evaporation is to be studied will be exposed to the air flowing in the MWT at the preset temperature and wind speed. A liquid canister in a cylindrical form made with stainless steel with adjustable height is required. Computer control of the height is required as well. One canister must be designed in the test chamber of the MWT, plus an additional exactly the same canister must be provided as a spare. Data acquisition and control The MWT must be equipped with the proper instruments to measure wind speed and air temperature at a minimum. These two variables, the height of the canister and the weight of the liquid must be computer controlled. The driver software must provide the ability to display of live data from the load cell and the other sensors. A perpetual license of the driver software is required. Source code of the software is not required. Wind speed calibration kit A complete calibration kit for the air velocity measurement is required. The apparatus must have an interface with the MWT and include all hardware and software components required to calibrate the air velocity in the test chamber of the MWT. Duration of each experiment (operation of the MWT) The MWT must be cabled to run continuously for a period of up to 7 days with the preset temperature and wind speed properly maintained. Warranty Extended warranty of 4 years on all parts and labour. Installation and training The system must include on-site full installation and training for 10 users. 4. Applicability of the trade agreements to the procurement This procurement is subject to the following trade agreements: Agreement on Internal Trade (AIT) North American Free Trade Agreement (NAFTA) 5. Justification for the Pre-Identified Supplier The only known supplier that can deliver a custom functioning miniature wind tunnel (MWT) meeting all required technical specifications is the custom low speed open circuit miniature wind tunnel system from Aerolab LLC. For this reason, it is proposed to negotiate directly with the manufacturer and sole supplier of the Aerolab LLC, Jessup, Maryland, USA. 6. Government Contracts Regulations Exception The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work". 7. Exclusions and/or Limited Tendering Reasons The following exclusion(s) and/or limited tendering reasons are invoked under the: Agreement on Internal Trade (AIT) - Article 506.12 (b) North American Free Trade Agreement (NAFTA) - Article 1016.2 (b) 8. Period of the proposed contract or delivery date The scientific equipment delivery is required on or before March 31, 2016. 9. Suppliers' right to submit a statement of capabilities Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 11. Closing date for a submission of a statement of capabilities The closing date and time for accepting statements of capabilities is the 7 October 2015 at 2:00 p.m. EDST. 12. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
