    1. Advance Contract Award Notice (ACAN) 
    An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 
    
    
    2. Definition of the requirement 
    The Department of Natural Resources Canada has a requirement for the supply of one (1) laboratory HydroFloat from the company Eriez Lab Equipment or an equivalent laboratory flotation of coarse particles machine to support its research in new materials in mining industry such as rare earth, chromite and ores.
    
    This apparatus (aerated fluidized bed separator) must be able to disperse fine bubbles into a fluidized bed of mineral slurry. The dispersed air bubbles percolate through the hindered settling zone of the pulp and attach to the hydrophobic particles. It must have the capability to float particles with diameters up to 850 µm.   
    
    3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements) 
    Any interested supplier must demonstrate by way of a statement of capabilities that its laboratory flotation machine meets the following requirements: 
    
    1- Field of application: Separation of coarse particle (>425 micrometers) mineral concentration delivering the capacity of a density separator while maintaining the selectivity of a flotation device.
    
    2- Material: Stainless steel support frame or corrosion resistant material, column made of transparent PVC or equivalent.
    
    3- Lab sized apparatus (no pilot or industrial scale unit)
    
    4- System must have a transparent PVC or equivalent vessel with feedbox, overflow outlet, underflow valve connection and dewatering cone.
    
    5- System must have internal elutriation water and air distribution manifold and associated piping.
    
    6-Teeter water flow meter.
    
    7-The system must include:
    
         a. Air flow meter (Rotameter, Valved Acrylic, air flow rate up to 1LPM),
         b. Teeter water flow meter (Rotameter, Valved Acrylic, 100mm, up to 20 LPM)
         c. Underflow control valve (Appropriate air control pinch valve)
         d. PID loop controller and I/P converter house in a Nema4 enclosure or equivalent enclosure to protect against environmental hazards such as water
    
    8- Appropriate electrical requirement for the operation of the apparatus (CSA approval for the electrical equipment is the responsibility of the vendor.)

    4. Applicability of the trade agreement(s) to the procurement 
    
    This procurement is subject to the following trade agreement(s):

    5. Justification for the Pre-Identified Supplier 
    The HydroFloat unique technical feature is that it is the only laboratory equipment capable of floating coarse mineral particles over 425 micrometers and up to 850 micrometers. Eriez Lab Equipment has a patent on the HydroFloat apparatus.
    
    
    6. Government Contracts Regulations Exception(s) 
    The following exception(s) to the Government Contracts Regulations is (are) invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work".
    
    
    7. Exclusions and/or Limited Tendering Reasons 
    The following exclusion(s) and/or limited tendering reasons are invoked under:
    
    o Canadian Free Trade Agreement (CFTA) 
    Article513 (b) if the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute goods or services exist for any of the following reasons: 
    
     (ii) the protection of patents, copyrights, or other exclusive rights; 
     (iii) due to an absence of competition for technical reasons; 
    
    o  North American Free Trade Agreement (NAFTA)
    Article 1016 2. An entity may use limited tendering procedures in the following circumstances and subject to the following conditions, as applicable:
    (b) where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists;
    
    
    8. Ownership of Intellectual Property 
    There are not IP terms.
    
    
    9. Period of the proposed contract or delivery date 
    The equipment must be delivered before March 31, 2018.

    11. Suppliers' right to submit a statement of capabilities 
    Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
    
    
    12. Closing date for a submission of a statement of capabilities 
    The closing date and time for accepting statements of capabilities is October 3, 2017 at 2:00 p.m. (EDT).

    An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award.  However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.
    
    Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
    
    The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page.
    
    The Crown retains the right to negotiate with suppliers on any procurement.
