    1.Advance Contract Award Notice (ACAN)
    An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
    
    2.Definition of the requirement 
    The Department of Public Works and Government Services Canada has a requirement for the supply of approximately 300 cubic meters of limestone in accordance with the Construction Specifications of the Kingston Mills Rehabilitation Project.
    
    3.Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements). The limestone must have:
    o “Absorption: 1% max. to ASTM C97M;
    o Density: 2560 Kg/cu.m. min. to ASTM C97M;
    o Compressive strength: 55 MPa min., taken in the weakest direction tested wet and dry to ASTM C170M;” 
    o The stone must also match the existing colour of the stone at Kingston Mills and have suitable bedding heights. 
    
    4.Any interested supplier must demonstrate by way of a statement of capabilities that its stone meets the listed requirements with:
    o Recent stone testing information with the required parameters (as per ASTM C568M-15).
    o Quantity of stone available.
    o Maximum size of stone.
    o Description of range of colours available.
    o A quarry visit by the Prime Consultant.

    7.Justification for the Pre-Identified Supplier 
    Kingston Mills is a cultural resource of national significance and part of the Rideau Canal World Heritage Site and National Historic Site. Thus with rehabilitation work, a higher standard of care exists. The scope of the rehabilitation of Kingston Mills is in line with the standards and guidelines for the conservation of historic places in Canada with respect to, “Repairing masonry by patching, piecing-in or consolidating, using recognized conservation methods. Repair might include the limited replacement in kind, or replacement with a compatible substitute material, of extensively deteriorated or missing masonry units, where there are surviving prototypes.” (Canada’s Historic Places, 2010). These guidelines are also reflected in the Statement of Cultural Resource Impact Analysis for Kingston Mills.
     
    In addition to finding compatible material, other criteria exists when sourcing stone for heritage projects. When qualifying a quarry as a supplier, along with the physical properties and size of the stone, the quantity able to be provided and within what timeframe is essential information.  Consistency in supply is a key element in heritage construction projects. This construction project is of a three year duration and Société Ansa Canada Inc. (ANSA) stone has already been used in two of the three years of construction. Also, compatibility and consistency of the stone material is necessary for the structural longevity and integrity of the lock structures for long-term safety of the locks in addition to the desired consistent appearance, colour and general aesthetics. Therefore,  it is required that ANSA stone is used for the final year of construction. With respect to time, ANSA has the stone volume required for Year 3. Stone production lead times can significantly delay a project.
    
    The specifications for this rehabilitation project called for stone that meets the following requirements: 
    o “Absorption: 1% max. to ASTM C97M; 
    o Density: 2560 Kg/cu.m. min. to ASTM C97M;
    o Compressive strength: 55 MPa min., taken in the weakest direction tested wet and dry to ASTM C170M;” 
    ANSA stone tests results showed an absorption of 0.17%, significantly under the 1% maximum as listed by the specifications. The density and compressive strength also met the requirements with 2700 Kg/cu.m and 130 MPa respectively. The performance of ANSA stone was well under and above the maximum and minimum limitations in the specifications as well as the importance of consistency and time justify the sole-source for the last year of construction.

    The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - only one person is capable of performing the work.

    10.Ownership of Intellectual Property 
    
    Stone for use in construction is not an intellectual asset. There are no limitations to use once the stone is provided to PSPC by the proposed stone supplier.
    
    11.Period of the proposed contract or delivery date
    The product/system/equipment (as appropriate) must be delivered by October 12, 2021.
    
    12.Cost estimate of the proposed contract 
    
    The estimated value of the contract, including option(s), is $400,000.00  (GST/HST extra).

    An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor.
