If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. DEFINITION OF THE REQUIREMENT Public Works and Government Services Canada (PWGSC), on behalf of its client, National Defence Canada, would like to establish a contract in order to obtain services of a contractor to upgrade the bender machine in the squadron's metal shop with the company Innovative Tube Equipment Corp. The machine’s electronic and electrical parts are at the end of their serviceable life. Currently, parts are no longer functional and this impedes the operational production of titanium hydraulic lines. The bender machine provides hydraulic lines for front-line squadrons and second-line periodic inspections. The Canadian Forces Base Bagotville needs a number of specific lines for their aircraft. The goal of this Statement of Work is to allow the replacement of failed and obsolete components on the bender machine. In fact, the machine is currently unserviceable due to a major failure that could break equipment or even seriously injure the technicians operating the machine. The manufacturer has developed an upgrade aimed at extending the life of their high-performance machines. An engineer will have to come to CFB Bagotville to upgrade the bender machine in order to repair the defect, replace obsolete components, perform preventative maintenance, and upgrade the electronic, electrical, and mechanical system. 3. CRITERIA FOR ASSESSMENT OF THE STATEMENT OF CAPABILITIES (Minimum Essential Requirements) Any interested supplier must demonstrate by way of a statement of capabilities that he is capable to meet the requirements and that it includes the following components and/or specifications: 1. The bidder must hold a reliability security screening; 2. Must be an accredited or authorized distributor of the registered trademark (Star Bend); 3. Must be able to obtain, from the manufacturer, the developed parts designed for the standards and characteristics of this machine; 4. Must be able to provide after-sales service of the machine; and 5. Must be able to provide the after-sales services of the upgrade of the machine. SCOPE OF WORK The work must include: - Provide the PLC, memory card and wiring necessary for the upgrade; - Perform the conversion between the POLARIS and the new PLC; - Provide all that is necessary in order to make the conversion: new PLC, new compatible card for the machine, and the new connection wiring; - Convert the existing programs into the new programming format; and - Train the new technicians in order to ensure understanding of the new software. TASKS The following tasks must be done in order to render the bender machine operational: - Equipment: Provide the PLC, memory card and wiring necessary for the upgrade. The supplier must have all of the items requested in their possession (or a purchase order in hand) and deliverable four weeks after the award of the contract so that our operations can restart as soon as possible; - Conversion of equipment: Perform the conversion between the POLARIS and the new PLC. The supplier must do a 100% conversion of the POLARIS operating system to the new PLC in order to have no communication problems between the components: a) Provide all that is necessary in order to perform the conversion of equipment: the new PLC, new compatible card for the machine and the new connection wiring. The supplier must pre-mount the PLC in order to facilitate the execution of the task. They must also pre-assemble the wiring with the necessary connections, if needed; b) Software licenses: Valid software licenses that we will need must be provided in order to operate our system legally; c) Conversion of software: Convert existing software into the new programming format. The supplier must agree to do a minimum of 10 conversions of all existing tube specialty software from the former PC to the new programming format, in the new PC (provided by Canada); and d) Training: Train the technicians to ensure understanding of the new software. The supplier must, at the minimum, train one technician to be able to understand, operate and modify the programming as well as perform general maintenance. CONSTRAINTS a) Languages: Must speak both French and English; b) Access to the facility: Must have a valid security clearance within the Department of National Defence; and c) Tools: Must provide their own tools. 4. APPLICABILITY OF THE TRADE AGREEMENT(S) TO THE PROCUREMENT This procurement is subject to the following trade agreements: - Canadian Free Trade Agreement (CFTA) - North American Free Trade Agreement (NAFTA) 5. GOVERNMENT CONTRACTS REGULATIONS EXCEPTION The following exception(s) to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work". 6.EXCLUSIONS AND/OR LIMITED TENDERING REASONS The following exclusion(s) and/or limited tendering reasons are invoked under the (section of the trade agreement(s) specified): Canadian Free Trade Agreement (CFTA) Chapter Five - Government Procurement Article 513: Limited Tendering 1. Subject to paragraphs 2 and 3, and provided that it does not use this provision for the purpose of avoiding competition among suppliers or in a manner that discriminates against suppliers of any other Party or protects its own suppliers, a procuring entity may use limited tendering in the following circumstances: (b) if the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute goods or services exist for any of the following reasons: (iii) due to an absence of competition for technical reasons. North American Free Trade Agreement (NAFTA) Part IV, Government Procurement, Chapter 10, Article 1016: 2. An entity may use limited tendering procedures in the following circumstances and subject to the following conditions, as applicable: b) where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists. 7. JUSTIFICATION FOR THE PRE-IDENTIFIED SUPPLIER The upgrade of the 3 EMA bending machine, provided by Innovative Tube Equipment Corp., includes all the unique and essential features sought by the customer. Thus, in accordance with government contracting policies, it is proposed to award a contract to Innovative Tube Equipment Corp. which, to our knowledge, is the only company that can provide the services the customer needs, to repair the bending machine. 8. PERIOD OF THE PROPOSED CONTRACT OR DELIVERY DATE The upgrade must be performed no later than four (4) weeks following the contract award. 9. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 13. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
