Advance Contract Award Notice (ACAN) An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Definition of the requirement Public Works and Government Services Canada, on behalf of its client the Department of National Defence (DND), Valcartier, intends to negotiate with GATR Technologies, for the supply and delivery at Quebec City of ten (10) Inflatable and Mobile Satellite Communications Antenna Kits. The Department of National Defence (DND) must be ready to deploy personnel anywhere in its area of responsibility (AOR), which extends from the northern border of Mexico to the 75th parallel North and to the Pacific and Atlantic coasts, to respond to a domestic emergency in the form of an Immediate Reaction Unit (IRU) and to conduct northern exercises to train troops for deployment in the Canadian Arctic. To carry out this type of activities, DND must acquire satellite communications antenna kits, operating in an environment of Arctic activities and engagements. These special antenna kits will have to be able to work in both Ku and X bands. The X Band will use the WGS (WideBand Global Satcom) satellite constellation, property of the US government and managed by the US Department of Defense (DoD). This system is strictly restricted for military use. DoD requires that all the equipment utilized to access the WGS satellite constellation being certified by them and only them. Uncertified equipment will be denied access to the WGS satellite constellation. Also because of the weight and volume limitations imposed by their transport on commercial airlines or smaller aircraft, we need to acquire antennas kits, which are extremely light, compact and easy to transport. They must also be easy to assemble and disassemble, given the frequent travel of our troops deployed in the field. 3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements) DND requires satellite communications antenna kits that satisfy the following technical criteria: The antenna must measure a minimum of 2.4 meters. All the components of the satellite communications antenna kits must withstand Canadian Arctic weather conditions, i.e. winds up to a minimum of 60 Km/h and temperature as low as of - 30 Celsius degrees. The total weight of the antenna and its components must not exceed 300 pounds. Each satellite communications antenna kit must be possible to transport in a maximum of three (3) transport containers; each transport container must measure a maximum of 33 in. x 22 in. x 17 in. Each satellite communications antenna kit must be possible to assemble within 45 minutes. Each satellite communications antenna kit must be possible to disassemble within 45 minutes. Each satellite communications antenna kit must operate on 120VAC (Volt Alternate Current) and include a transformer that will supply 24 volts DC to the compressor unit. The LNB (Low Noise Block) must produce a gain of precisely 62Db NF0.7Db The antenna and its components must be capable of producing, at minimum, elevation angles of 5 to 90 degrees. Each satellite communications antenna kit must work in the Ku band and be easily adaptable to the X band. Each antenna kit must be WGS (WideBand Global Satcom) standards certified. Each component of the antenna kits (bands, amplifiers, injection unit, cable etc.) must be compatible (connections/voltage) to form the required satellite communications antenna kit. 4. Applicability of the trade agreement(s) to the procurement This procurement is subject to the following trade agreements - Agreement on Internal Trade (AIT) - North American Free Trade Agreement (NAFTA) - World Trade Organization - Agreement on Government Procurement (WTO-AGP) 5. Justification for the Pre-Identified Supplier The supplier selected in advance and identified with the section 9, GATR Technologies, is to our knowledge the only supplier meeting all minimum essential requirements required at section 3. 6. Government Contracts Regulations Exception(s) The following exception(s) to the Government Contracts Regulations is invoked for this procurement under subsection: 6(d) - "only one person is capable of performing the work". 7. Exclusions and/or Limited Tendering Reasons The following exclusions and/or limited tendering reasons are invoked under the: - Agreement on Internal Trade (AIT) - Article 506.12 (a) &(b); - North American Free Trade Agreement (NAFTA) - Article 1016.2b). - World Trade Organization - Agreement on Government Procurement (WTO-AGP - Art. Suppliers' right to submit a statement of capabilities Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 11. Closing date for a submission of a statement of capabilities The closing date and time for accepting statements of capabilities is February 5, 2015 at 2:00 p.m. (EST). 12. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
