Advance Contract Award Notice (ACAN) An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or constructionto a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Definition of the requirement Public Works and Government Services Canada, on behalf of its client Defence Research and Development Canada (DRDC) - Valcartier Research Center, intends to negotiate with Optikon Corporation Ltd, for the supply and delivery at Quebec City of one (1) portable extended near-infrared (NIR) spectroradiometer measurement kit, including hardware, accessories, and operating software. DRDC - Valcartier Research Center requires an extended NIR spectroradiometer measurement kit with a versatility such that measurements of different nature may be performed by changing the instrument configuration (irradiance/illuminance, radiance/luminance, radiant intensity/candelas, radiant flux/lumens). A variable bandwidth is required to resolve the spectral profile of narrow band sources with more precision (using a smaller bandwidth) or get more throughput for broadband sources (using a larger bandwidth) without changing instruments or measuring spot size. Measurements are to be performed in the field as well as in a controlled laboratory environment for various light measurement applications. 3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements) DRDC - Valcartier Research Center requires an extended NIR spectroradiometer measurement kit that satisfies the following technical criteria: 1- The spectroradiometer wavelength range must respect the following boundaries: - Lower wavelength limit: between > or equal 300 nm and < or equal 400 nm - Upper wavelength limit: between > 1070 nm and < or equal 1200 nm 2- The spectroradiometer must have at least 7 different circular measuring apertures amongst the following: - 0.1°, 0.125°, 0.15°, 0.2°, 0.25°, 0.3°, 0.35°, 0.4°, 0.5°, 0.6°, 0.7°, 0.8°, 0.9°, 1°, 1.5°, 2°, 5°. 3- The spectroradiometer must have switchable, variable spectral bandwidth without changing apertures with atleast the following three possible settings: - Setting #1: between > or equal 1 nm and < 5 nm. - Setting #2: between > or equal 5 nm and < 10 nm. - Setting #3: between > or equal 10 nm and < or equal 20 nm 4- The spectroradiometer must have a luminance sensitivity < or equal 5e-4 fL. - Considering 2856K source, 2° aperture, and 8 nm bandwidth. 5- Software Development Kit (Windows .DLL): - Fully documented API for measurement, control and data transfer, including C++ and Visual Basic sample code. - Compatible with Windows 7 or higher. 6- RGB Display Calibration Software - Provide an interactive method of calibrating displays or digital projectors. 7- User Self-Calibration Software - Enabling end-user to perform a complete recalibration of wavelength accuracy, spectral intensity and linearity. 8- The spectroradiometer must be portable: - Weight: < 20 lbs. - Battery: providing > 6 hours of continuous operation. - Dimensions: < 12 inches in height, <12 inches in width and < 12 inches in depth. 4. Applicability of thetrade agreement(s) to the procurement This procurement is subject to the following trade agreements - Agreement on Internal Trade (AIT) - North American Free Trade Agreement (NAFTA) 5. Justification for the Pre-Identified Supplier The supplierselected in advance and identified with the section 9, Optikon Corporation Ltd, is to our knowledge the only supplier meeting all minimum essential requirements required at section 3. 6. Government Contracts Regulations Exception(s) The following exception(s) to the Government Contracts Regulations is invoked for this procurement under subsection: 6(d) - only one person is capable of performing the work". 7. Exclusions and/orLimited Tendering Reasons The following exclusions and/or limited tendering reasons are invoked under the: - Agreement on Internal Trade (AIT) - Article 506.12 (a) &(b); - North American Free Trade Agreement (NAFTA) - Article 1016.2b). 8. Suppliers' right to submit a statement of capabilities Suppliers who consider themselves fully qualified andavailable to provide the goods described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 11. Closing date for a submission of a statement of capabilities The closing date and time for accepting statements of capabilitiesis January 25, 2017 at 2:00 p.m. (EST). 12. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
