Trade Agreement: Agreement on Internal Trade (AIT) Tendering Procedures: Generally only one firm has been invited to bid Non-Competitive Procurement Strategy: Exceptional Circumstances Under Article 508 (1) of AIT Comprehensive Land Claim Agreement: No Vendor Name and Address: Université Laval Faculté des sciences et de génie 1045 avenue de la Médecine Pavillon Alexandre-Vachon Direction-local 1036-D Québec Quebec Canada G1V0A6 Nature of Requirements: Advance Contract Award Notice (ACAN) An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or co nstruction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a st atement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 1. Requirement Transport Canada’s Transportation Innovation and Applied Research Centre (TC/TIARC) has a requirement for a study of the Frazil Ice concentration in the St. Lawrence River. This project seeks to ensure and increase the safety and effectiveness of winter navigation on the St. Lawrence River. The project will assist Transport Canada’s Marine Safety and Security (TCMSS) to interpret and ensure proper application of Canadian Marine Machinery Regulations (SOR/90-264) under the Canada Shipping Act, 2001. - This first project objective is to determine the periods and weather conditions when frazil ice may clog the sea water strainer of a vessel transiting inthe St. Lawrence River during the winter season. - The second objective is to quantify the heat required (volume flow of the ship’s war m sea water returning to the suction) in order to ensure no frazil blockage. - The third objective is to help TCMSS to communicate best means, methods and practices regarding frazil ice blockage prevention and to inform stakeholders about periods of severe frazil conditions that could lead to frazil ice blockage occurrence in the St. Lawrence River. Knowing moreabout the characteristics of frazil in water, TCSSM will be more effective in its response to the vessels which may be affected. 2. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements) Any interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements: 1) The Bidder must have a minimum of five (5) years of experience, within the past ten (10) years measured back from the date of ACAN closing, in: a.conducting navigation-related studies on the St. Lawrence River system; b.the study of ice jams and phenomena connected to frazil ice on the St. La wrence River system; and c.conducting studies in the quantifying and documenting of the varying ice processes on the St. Lawrence River (i.e. typical river reach, sluggish river reach, tidal river reach and estuarine river reach) with publ ished results on the St. Lawrence River ice processes. The Bidder must demonstrate this experience by providing brief abstract(s) of one or more project(s) that clearly identifies the month an d year commenced and completed, how (through what activities, responsibilities and approach) they successfully completed the project(s), with a specific focus of how they meet the individual areas of e xperience listed above. 2) The Bidder’s proposed principle researcher must have completed a minimum of three (3) projects conducting studies on frazil ice concentrations and the blockage of water intakes in the vicinity of the proj ect in the St. Lawrence River region. The Bidder must demonstrate this experience by providing brief abstract(s) of at least three (3) projects that clearly demonstrates the month and year commenced and completed, and how (through what activities, responsibilities and approach) they successfully completed the project. 3) The Bidder must have a minimum of three (3) years of experience, within the past five (5) years measured back from the date of ACAN closing, with data modeling (including, for example, finite element, discrete element, neural networks, 1D, 2D and 3D, Eulerian and Lagrangian) of the St. Lawrence River. The Bidder must demonstrate this experience by providing brief abstract(s) of one or more project(s) that clearlydemonstrates the month and year commenced and completed, and how (through what activities, responsibilities and approach) they successfully completed the project. 4) The Bidder must demonstrate that they have previous experience in collaborating withthird parties and cooperating and communicating with stakeh olders within the interest groups related to the frazil ice on the St. Lawrence River. The Bidder must demonstrate this experience by providing brief abstract(s) of one or more project(s) that clearly demonstrates their collaboration with the interest groups related to the fr azil ice on the St. Lawrence River. 3. Applicability of the trade agreement(s) to the procurement This procurement is subject to the Agreement on Internal Trade (AIT). This procurement consists of Transportation Research and Development services which are excluded from the application of the NAFTA as per Annex 1001.1b-2, Class A Research and Development and are not listed under the WTO-AGP Appendix l, Annex 4. The Comprehensive Land Claims Agreements (CLCAs) are not applicable to this procurement, as the Work will not be delivered to, nor conducted within CLCA areas. 4. Justification for the Pre-Identified Supplier Université Laval is the only known supplier to have carried out studies on fra zil ice concentrations and the blockage of sea water intakes in the vicinity of the project in the St. Lawrence River region, and specifically: a.Université Laval is the only known supplier who has a minimum of fi ve (5) years of experience, within the past ten (10) years, conducting navigation-related studies on the St. Lawrence River system, studying the ice jams and the phenomena connected to the frazil ice and conducting studies in the quantifying anddocumenting of the varying ice pr ocesses (i.e. typical river reach, sluggish river reach, tidal river reach and estuarine river reach) with published results on the St. Lawrence River ice processes b.Université Laval is the only known supplier who also has a principle researcher who has completed a minimum of three (3) projects conducting studie s on frazil ice concentrations and the blockage of water intakes in the vicinity of the project in the St. Lawrence River region; c.Université Laval isthe only known supplier who also has a minimum of three (3) years of experience, within the past five (5) years, with data modeling (including, for example, finite element, discrete element, neural networks, 1D, 2D and 3D, Eulerian and Lagrangian)of the St. Lawrence River; d.Université Laval is the only known supplier who also has previous experience in collaborating with third parties and cooperating and communicating with stakeholders within the interest groups related to the frazil ice on the St. Lawrence River; 5. Government Contracts Regulations Exception(s) The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work". 6. Limited Tendering Reasons The following exclusion(s) and/or limited tendering reasons are invoked under the (section of the trade agreement(s) specified): Agreement on Internal Trade (AIT)- Article(s) 506, 12b - "where there is absence of competition for technical reasons and the goods and services can only be supplied by a particular supplier and no alternative of substitute exists". 7. Ownership of Intellectual Property The Contractor will own the Intellectual Property Rights in Foreground Information. 8. Period of the proposed Contract or delivery date The period of the proposed contract is from the date of contract award to July 31, 2017. 9. Cost of the proposed contract The value of the contract is $105,000.00 applicable taxes extra. 10. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
