If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Definition of the requirement Environment and Climate Change Canada (ECCC) has a requirement for the supply and delivery of three (3) Sulfur Dioxide (SO2) analyzers and three (3) NOx analyzers. ECCC, Air Quality Research Division, Toronto, Ontario requires analyzers that include one capable of measuring Nitric Oxide (NO), Nitrogen Dioxide (NO2) and Nitrogen-Oxygen Trace Gases (NOy) sequentially and another different analyzer that is capable of measuring Sulfur Dioxide (SO2). These instruments will be used to make measurements in the oil sands particularly from aircraft. 3.Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements) Any interested supplier must demonstrate by way of a statement of capabilities that its equipment meets the following requirements: The instruments must meet the minimum criteria: SO2 SPECIFICATIONS: The SO2 analyzers must meet the minimum specifications: i.Precision 1% of reading or 1 ppb (whichever is greater) ii.Measurement Range 0-10ppb to 0-1000ppb iii.Measurement Time Resolution 1.0 second iv.Lower Detectable Limit: 0.208 ppb (10 second averaging time) 0.12 ppb (60 second averaging time) 0.05 ppb (300 second averaging time) v.Zero Drift (24 hour): < 1 ppb A.The system must have an internal zero/span assembly. B.The system must have user configurable streaming output of parameters from a menu system. C.The system must be rack-mountable (standard 19 rack) for ease of installation, particularly in an aircraft and supplied with appropriate rack mounting hardware D.The analyzer must have temperature and pressure compensation that can be turned on/off by the user. E.The instrument must have the following outputs: Selectable voltage, RS232/RS485, TCP/IP, 10 status relays, and power fail Indication. F.The analyzer power requirements: 115 VAC 50/60 Hz. Two NOx analyzers must meet the following minimum specifications: NOX SPECIFICATIONS: i.Measurement Range 0-5 ppb to 0-1000 ppb ii.Measurement Time Resolution 1.0 second iii.Lower Detectable Limit: 50 ppt (120 second average time) iv.Zero Drift (24 hour): < 1 ppb A.The system must have a permeation dryer. B.The system must have user configurable streaming output of parameters from a menu system. C.The system must have user configurable sampling modes accessed through the menu to switch via solenoids the instrument into a nitrogen oxide (NO) only mode, NOx only mode, NO/NOx mode and a pre-reactor internal zero mode. D.The system must measure NOx using a heated molybdenum converter. E.The system must be rack-mountable (standard 19 rack) for ease of installation, particularly in an aircraft and supplied with appropriate rack mounting hardware F.The analyzer must have temperature and pressure compensation that can be turned on/off by the user. G.The instrument must have the following outputs: Selectable voltage, RS232/RS485, TCP/IP, 10 status relays, and power fail Indication. H.The analyzer power requirements: 115 VAC 50/60 Hz. The analyzer power requirements: 115 VAC 50/60 Hz. 4.Applicability of the trade agreement(s) to the procurement This procurement is subject to the following trade agreement(s) - Canadian Free Trade Agreement (CFTA) - North American Free Trade Agreement (NAFTA) 5.Justification for the Pre-Identified Supplier The Thermo 43i-TLE and 42i-TL analyzer are the only instruments that are capable of providing high precision measurements at 1 second sampling rates for NO/NOx/NOy/SO2 trace gases simultaneously through four user configurable instruments in a compact, light-weight, rack mountable form for aircraft studies. The 43i-TLEand 42i-TL Thermo instruments are currently utilized by ECCC and C.D. NOVA Tech Inc. is the only known reseller of Thermo Instrument that can supply the products. 6.Government Contracts Regulations Exception(s) The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work. 7.Exclusions and/or Limited Tendering Reasons The following exclusion(s) and/or limited tendering reasons are invoked under the; CFTA Article: 513 -1 (b) if the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute goods or services exist for any of the following reasons: ii.the protection of patents, copyrights, or other exclusive rights; iii.due to an absence of competition for technical reasons; CFTA Article: 513 -1 (c) for additional deliveries by the original supplier of goods or services that were not included in the initial procurement, if a change of supplier for such additional goods or services: i.cannot be made for economic or technical reasons such as requirements of interchangeability or interoperability with existing equipment, software, services, or installations procured under the initial procurement; and ii.would cause significant inconvenience or substantial duplication of costs for the procuring entity; NAFTA: Article 1016: 2 (b).where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists. NAFTA: Article 1016: 2(d) - for additional deliveries by the original supplier that are intended either as replacement parts or continuing services for existing supplies, services or installations, or as the extension of existing supplies, services or installations, where a change of supplier would compel the entity to procure equipment or services not meeting requirements of interchangeability with already existing equipment or services, including software to the extent that the initial procurement of the software was covered by this Chapter. 8.Period of the proposed contract The equipment must be delivered before March 31, 2018. 9.Cost estimate of the proposed contract The estimated value of the contract, including option(s),is $170,195.00 (HST extra). 10.Name and address of the pre-identified supplier Name: C.D. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
