    1. Advance Contract Award Notice (ACAN) 
    An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 
    
    2. Definition of the requirement 
    Natural Resources Canada (NRCan) in Hamilton, Ontario, has a requirement for the supply, delivery, installation, and testing of one (1) Keyence High-Resolution Digital Microscope Model VHX-7000 or equivalent. Additional components will be added to the base unit enhance its capabilities.
    
    It is intended to negotiate a contract with Keyence Canada Inc., located in Mississauga, Ontario.
    
    The Contractor must provide one (1) high-resolution digital microscope that will be used to investigate surface morphology in detail, with high depth of focus that can capture digital images of fracture surfaces and complex surface oxide from severe corrosion. The instrument will be capable of conducting these microstructure investigations to enhance efficiency of new materials development and of existing materials failure analyses.
    
    3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements) 
    Any interested supplier must demonstrate by way of a statement of capabilities that its product meets the following requirements: 
    
    3.1 The digital microscope must be able to provide high-resolution images at both low and high magnification (20x-6000x);
    
    3.2 The digital microscope must have a removable lens assembly to allow hand-held imaging for larger samples;
    
    3.3 The hand-held lens must have a lens magnification of (20-200x) with an optical depth of field of 34mm at 20x magnification;
    
    3.4 The digital microscope must allow a tilt of 60 degrees on one side and 90 degrees on the other;
    
    3.5 The digital microscope must have a motorized stage in the X and Y axes and a real displacement of 100 x 100 mm;
    
    3.6 The motorized stage in X and Y must move in the Z axis with a resolution of one (1) micron, and a real displacement of 50 mm;
    
    3.7 The digital microscope must have a focus function in the Z axis with a five steps motor, a 0.1-micron resolution, and a 49 mm displacement;
    
    3.8 The digital microscope must allow to connect the handheld camera and the image capture camera at the same time (2 cameras at the same time);
    
    3.9 The image capture camera must have a frame rate of 30 frames per second HDR;
    
    3.10 The image capture camera must have a CMOS sensor with a resolution of 4000 (H) x 3000 (V) pixels;
    
    3.11 The image capture camera must have a high accuracy mode of 12000 (H) x 9000 (V) pixels;
    
    3.12 The system must be able to create 3D models using bright-field, dark-field, mixed, polarized light & DIC;
    
    3.13 The digital microscope must have an integrated vibration control system;
    
    3.14 The digital microscope must have an acquisition and assembly (stitch) capability;
    
    3.15 The digital microscope must have an automatic angle indicator for tilt and rotation;
    
    3.16 The digital microscope must have a 4K, 27-inch color LCD monitor (IPS type);
    
    3.17 The digital microscope must have software to perform, save and export the following measurements: distance, angle, radius, automatic count of particles and grains, occupied area measurements, 3D profile measurements, 3D volume measurements and surface roughness measurements; and
    
    3.18 The digital microscope must have an internal data storage capacity of 1TB.
    
    4. Applicability of the trade agreement(s) to the procurement 
    
    This procurement is subject to the following trade agreement(s):

    5. Justification for the Pre-Identified Supplier 
    To the best of NRCan’s knowledge, Keyence Canada Inc. is the only known supplier that can provide digital optical microscope’s with the capabilities listed in Section 3 above.   
    
    6. Government Contracts Regulations Exception(s) 
    The following exception(s) to the Government Contracts Regulations is (are) invoked for this procurement under subsection 6(d) - "only one person is capable of performing the contract"). 
    
    7. Exclusions and/or Limited Tendering Reasons 
    The following exclusion(s) and/or limited tendering reasons are invoked under the:  
    - Canadian Free Trade Agreement (CFTA) - Article 513 1(b)(iii), due to an absence of competition for technical reasons;
    
    - Canada-Korea Free Trade Agreement (CKFTA) - Article 14.3: Scope;
    
    - Canada-Chile Free Trade Agreement (CCFTA) - Article Kbis-09: Tendering Procedures;
    
    - Canada-Colombia Free Trade Agreement - Article 1409 1(b)(iii), Due to an absence of competition for technical reasons;
    
    - Canada-Panama Free Trade Agreement - Article 16.10 1(b)(iii), of the absence of competition for technical reasons;
    
    - Canada-Honduras Free Trade Agreement - Article 17.11 2(b)(iii), there is an absence of competition for technical reasons; and
    
    - Canada-Peru Free Trade Agreement (CPFTA) - Article 1409 1(b)(iii), due to an absence of competition for technical reasons
    
    8. Period of the proposed contract or delivery date 
    
    The product must be delivered, installed, tested, and accepted on or before March 31, 2022.
    
    9. Cost estimate of the proposed contract 
    The estimated value of the contract is $156,395.00 CAD (GST/HST extra).

The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.

    An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award.  However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.
