    1. Advance Contract Award Notice (ACAN) 
    
    An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 
    
    2. Definition of the requirement 
    
    The Department of Natural Resources of Canada has a requirement to Development of Applicable Bio-oil Upgrading Technologies to Reduce Bio-oil Corrosivity and Enhance the application of the Oil for Clean Energy Production. The work will involve the following: 
    a) Pre-selection of promising bio-crudes upgrading technologies, and laboratory test facility preparation. 
    b) Upgrading of crude bio-oils and identify the corrosivity and other chemical properties of the upgraded oils.
    c) Further improve Upgrading technologies, and collaborate with other stakeholders to determine suitable materials that can be used for the storage, transportation and application of oils upgraded via the most cost-effective upgrading technologies.
    
    3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements) 
    
    Any interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements: 
    a) Leading technical staff must have at least ten (10) years of demonstrated experience in bio-crudes upgrading, and knowledge of state-of-the-art bio-crudes upgrading techniques (hydrodeoxygenation and/or esterification with supercritical alcohols). The interested supplier should provide evidence such as related projects and/or publications;
    b) The interested supplier must provide at least one example to demonstrate how they worked with government and/or industrial partners in the past 10 years;
    c) Academic qualifications of the interested supplier’s technical staff must have PhD in chemical engineering, or a related field about bioenergy production;
    d) Facilities, The interested supplier must have testing facilities that can be operated at temperature up to 500 C and pressure up to 5000 psig to conduct upgrading tests using hydrodeoxygenation or esterification with supercritical alcohols; 
    e) The interested supplier must have analytical equipment for products analyses:

    Gaseous products distribution | Gas chromatograph (GC) or equivalent
    Liquid products distribution | Gas chromatography - Mass spectrometer (GCMS) or equivalent
    f) The interested supplier must demonstrate they have the required facilities. Evidence includes photos of reactors and analytical instruments, and scientific publications, technical reports, operations manuals or other related documents that demonstrate the existing specifications of reactors and analytical instruments

    This is the only known Supplier that can perform the stated work and meet the criteria of assessment.
    
    6. Government Contracts Regulations Exception(s) 
    
    The following exception(s) to the Government Contracts Regulations is (are) invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work".

    8. Ownership of Intellectual Property 
    
    Canada intends to retain ownership of any Foreground Intellectual Property arising out of the proposed contract on the basis that the main purpose of the contract is where statutes, regulations, or prior obligations of the Crown to a third party or parties preclude Contractor ownership of the Foreground.
    
    9. Period of the proposed contract or delivery date 
    
    The proposed contract is for a period of 2+ years, from Contract award to 28  February 2022.
    
    10. Cost estimate of the proposed contract 
    
    The estimated value of the contract, including option(s), is $ 75,000.00 (GST/HST extra).

    An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award.  However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.
    
    Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.

    The Crown retains the right to negotiate with suppliers on any procurement.
