ACAN Explanation An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. All responses or inquiries are to be submitted to the Procurement officer identified above. The PWGSC file number, the Procurement officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page 2. Definition of Requirement: Environment Canada (EC) requires two (2) Microphysical sensors and accompanying software in the form of one (1) Back Scatter Cloud Probe (BCP) and one (1) Cloud Droplet Probe (CDP) from Droplet Measurement Technologies (DMT). These sensors are mountable on Unmanned Ariel Vehicles (UAV) for cloud/fog studies and complement an existing integrated platform used to study Arctic ice fog and take Arctic cloud measurements. EC owns and operates an existing suite of BCP and CDP sensors from Droplet Measurement Technologies (DMT), which use the Particle Analysis Display System (PADS) software. These sensors cannot be used on UAVs because of size restrictions. UAVs can go into low level fog conditions while large aircraft cannot. The microphysical BCP and CDP sensors from DMT will allow EC to collect observations of ice particles, droplets, and liquid mass in low level clouds and fog in the exact manner to how existing sensors collect the same data at higher altitudes and used on larger aircraft. 3. Criteria for Assessment of the Statement of Capabilities: Any interested supplier must demonstrate by way of a statement of capabilities that its product meets the following requirements: 1. The Microphysical Sensors must use the Particle Analysis Display System (PADS) software and be supplied with PADS software application. 2. The sensors must interface seemlessley with all Droplet Measurement Technology Microphysical Sensors 3. The Data Anaysis System must be supplied to accept inputs from 10 different sensors 4. The data produced must be compatible with previous PADS data analysis results. 5. System must have capability of measuring both particle polarization and particle spectra from sizes 1-50 micron, and response time 1 sec. 6. Polarization/backscattering based sizing, up to 75 micron is required for drizzle size detection. 7. Must have a software that monitor instrument operational parameters: temperature, and electronic temperature 8. Operational temperature must be between -40 and 40C. 9. Its weight is less than 3 kg and system power must be less than 28 VDC. 10. Probe dimensions less than 15 cm for any direction 11. Software is needed for data processing during UAV flight time. 12. Both backscattering probe and forward scattering probe data analysis must be integrated during the flights. 13. DAS weight must be less than 1 kg. 4. Applicability of the Trade Agreement(s) to the procurement: The procurement is subject to the following Trade Agreements: Agreement on Internal Trade (AIT), and North American Free Trade Agreement (NAFTA). 5. Justification for the Pre-Identified Supplier: Droplet Measurement Technologies, Boulder, Colorado, is the only known manufacturer of a BCP and CPD Microphysical Sensors that use Particle Analysis Display System software that can fulfill the performance requirements EC requires to ensure compatibility and accurate data collection. There are no other solutions to the data continuity issue. Droplet Measurement Technologies is the original equipment manufacturer and PADS software developer and I.P rights holder. There are no alternative source to supply the same equipment and software requested. A microphysical sensor provided by a different manufacturer would not provide similar data collected for adequate comparison. Droplet Measurement Technologies is the only supplier and manufacturer that can provide identical microphysical sensors and software that is currently used by EC. Without identical equipment and software in use by UAVs, observations cannot be compared and analyzed due to data compatibility and sensor sensitivity. Droplet or ice data collected by a sensor other than a DMT sensor and processed by a data analysis software other than PADS will adversely affect the data continuity and comparisons done in the past and can result in failure of the entire project. The data collected from the sensor is in a specific format unique. No other software other than PADS can yield the data produced and required by EC. The data collected from the sensor is in a specific format unique to this probe. 6. Government Contract Regulations Exception(s) The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) "only one person is capable of performing the contract; for patent or copyright requirements, or technical compatibility factors and technological expertise." 7. Exclusions and/or Limited Tendering Reasons The following exclusion(s) and/or limited tendering reasons are invoked under the section of the trade agreement(s) specified: Agreement on Internal Trade (AIT) Articles 506.12 (b), "where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particular supplier and no alternative or substitute exists." North American Free Trade Agreement (NAFTA) Articles 1016.2 (b), "where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists."; (d) "for additional deliveries by the original supplier that are intended either as replacement parts or continuing services for existing supplies, services or installations, or as the extension of existing supplies, services or installations, where a change of supplier would compel the entity to procure equipment or services not meeting requirements of interchangeability with already existing equipment or services, including software to the extent that the initial procurement of the software was covered by this Chapter." 7. Delivery Date: The Contractor must deliver the Microphysical Sensors no later than March 31, 2014. 8. Supplier's right to submit a statement of capabilities Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN, may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 10. The closing date for a submission of a statement of capabilities The closing date and time accepting statements of capabilities is January 31, 2014 11. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
