Advance Contract Award Notice (ACAN) Explanation An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Definition of the requirement Environment Canada's (EC) Aviation Research Group (ARG), Cloud Physics and Severe Weather Research Division, in King City, Ontario, Canada, requires one (1) Present Weather Sensor that can measure visibility, precipitation and type, and background light which will be installed at the Canadian Force Base Cold Lake airport (CYOD), Alberta, Ontario. The instrument will support the on going efforts by the group to develop better algorithms for forecasting the critical weather elements for aviation forecast such as visibility, runway visual range (RVR) and precipitation type. Contractor must supply and deliver one (1) Present Weather Sensor to Egbert, Ontario by January 15, 2014 Contractor must also provide twelve (12) months of maintenance and warranty service commencing from the date of delivery acceptance by EC Project Authority for the Present Weather Sensor. 3. Criteria for assessment of the Statement of Capabilities 3.1 Minimum Essential Requirements Any interested supplier must demonstrate by way of a statement of capabilities that its product meets the following requirements: The instrument must measure the visibility down to 5m with an accuracy at least 10% in the visibility range 5 - 10,000m; The instrument must be capable of measuring the Runway Visual Range (RVR); The instrument must be able to operate in a temperature range of -40 to +45C; The instrument must be able to operate in a humidity range of 0 to 100%; The instrument must be capable of identifying rain, freezing rain, drizzle, freezing drizzle, mixed rain and snow, snow, ice pellets, snow grains, ice crystals, fog, mist and haze (smoke and sand); The instrument must Report WMO 4680 (SYNOP), 4678 (METAR) and NWS code tables; The instrument must meet the Federal Aviation Administration ( FAA) and International Civil Aviation Organization (ICAO) specifications http://www.icao.int/safety/meteorology/amofsg/Memos/Memo%2036.doc ; The instrument must meet the ICAO/FAA frangibility standards http://www.pollite.com/frangibility compliance/icao-faa; The instrument must be able to withstand wind speeds up to 60 m/s; The instrument must include a Calibration set and Background luminance sensor; The instrument must have a ASCII serial output and able to operate in both broadcast and polled modes; The instrument must be able to be programmed and controlled through the serial port via a terminal program such as HyperTerminal; and The instrument must operate on 120VAC 60Hz and be pole mountable. 4. Applicability of the trade agreement(s) to the procurement This procurement is subject to the following trade agreements: (a) Agreement on Internal Trade (AIT); and (b) North American Free Trade Agreement (NAFTA). 5. Justification for the Pre-Identified Supplier Vaisala Canada Inc. of Richmond, British Columbia, is the only manufacturer and sole distributor of the FS11 which is the only known Present Weather Sensor that has the capability of measuring the Runway Visual Range (RVR) as well as identifying the many precipitation types, such as snow grain and ice crystals which meets our minimum performance specification. 6. Government Contracts Regulations Exception(s) The following exception to the Government Contracts Regulations is invoked for this procurement under section 10.2.1 subsection 6 (d), only one person or firm is capable of performing the contract; for the patent or copyright requirements, or technical compatibility factors and technological expertise. 7. Exclusions and/or Limited Tendering Reasons The following exclusion(s) and/or limited tendering reasons are invoked under the section of the trade agreements specified: (a) Agreement on Internal Trade (AIT) - Article 506.12 (b), where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particular supplier and no alternative or substitute exists; and (b) North American Free Trade Agreement (NAFTA) Article 1016.2 (b), where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists. 8. Suppliers' right to submit a statement of capabilities Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 11. Closing date for a submission of a statement of capabilities The closing date and time for accepting statements of capabilities is November 19, 2013 at 2:00 p.m. EST. 12. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
