Advance Contract Award Notice (ACAN) Explanation An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Definition of the requirement Environment Canada requires 1 Ice Mass Balance (IMB) buoy for deployment in the Arctic, with deployments via Coast Guard Ice Breakers or other suitable vessel. The IMB buoy is a specialized suite of sensors that have been integrated to allow for direct in-situ measurement of ice growth and decay, along with atmospheric and oceanographic parameters to understand the thermodynamics at the ice. The IMB buoys are part of Canada¡¦s contribution to the International Arctic Buoy Program (IABP), and are also a key part of the augmentation of in-situ marine weather observations for the METAREA initiative. Part of the METAREA project will see Environment Canada arrange for sustained deployments of ice buoys in the Canadian Arctic, to maintain an array of buoys upstream of Canada that will improve knowledge of real-time conditions, and improve the skill of numerical weather forecast models. Buoys will transmit observations on an hourly basis via Iridium satellite. It is intended to negotiate a contract with MetOcean Data Systems of Dartmouth, Nova Scotia. The Contractor must supply and delivery one (1) IMB buoy with the option to purchase 3 additional units within the initial contract period. The contract will allow for the option to purchase an additional 9 buoys over a period of three years. 3. Criteria for assessment of the Statement of Capabilities 3.1 Minimum Essential Requirements Any interested supplier must demonstrate by way of a statement of capabilities that its product meets the following requirements: (i) Must be equipped with Iridium Satellite Telemetry and GPS position; (ii) Sensors and parts must include: CR1000 Data Logger; AM 16/32 Relay Multiplexer; 107 Temperature Probe; 41303-5A Radiation Shield; SR50A Snow Height; PSA-916 Altimeter Sonar; PTB110 Barometer; Tardiran Battery Packs (up to 24 months of battery operating life); and CRREL Thermistor Strings (45 temperature points) (iii) Buoy Dimensions: Hull: 30¨ LGTH x Ø 8.625¨ Mast Height: ~40¨ Float Size: Ø 24¨ x 3¨ THK Sonar Mast Height: ~60¨ Above Surface, ~230¨ Below Surface (iv) Buoy Construction: Surface Unit: Hull and Mast: 6061 T6 Aluminum Sonar Mast: White PVC Ablation Shields: Plywood 4. Applicability of the trade agreement(s) to the procurement This procurement is subject to the following trade agreements: (a) World Trade Organization Agreement on Government Procurement (WTO-AGP); (b) North American Free Trade Agreement (NAFTA); and (c) Agreement on Internal Trade (AIT). 5. Justification for the Pre-Identified Supplier MetOcean Data Systems Inc. is the only known manufacturer that provi des IMB buoys with the range of sensors integrated into a package suitable for deployment. 6. Government Contracts Regulations Exception(s) The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6 (d), only one person or firm is capable of performing the contract; for the patent or copyright requirements, or technical compatibility factors and technological expertise. 7. Exclusions and/or Limited Tendering Reasons The following exclusion(s) and/or limited tendering reasons are invoked under the section of the trade agreements specified: World Trade Organization Agreement on Government Procurement (WTO-AGP) - V Article XV 1 (b), when, for works of art or for reasons connected with protection of exclusive rights, such as patents or copyrights, or in the absence of competition for technical reasons, the products or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists; North American Free Trade Agreement (NAFTA) - V Article 1016.2 (b), where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists; and Agreement on Internal Trade (AIT) - Article 506.12 (b), where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particular supplier and no alternative or substitute exists. 8. Period of the proposed contract The proposed contract is for a period of one (1) year with three one-year option periods. 9. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 11. Closing date for a submission of a statement of capabilities The closing date and time for accepting statements of capabilities is January 28, 2015 at 2:00 p.m.EST. 12. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
