Advance Contract Award Notice (ACAN) An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Definition of the requirement The Canada Revenue Agency (CRA), Audit Division, Toronto, Ontario has a requirement for the supply, delivery and installation of 23 new Haworth furniture systems and dismantling 17 existing Haworth furniture systems. It is intended to negotiate a contract with CTI Working Environment Inc., Mississauga, Ontario. The Contractor must dismantle the existing 17 Haworth workstations and build 40 new drop-down cubicles in the same area. The work will take place in two (2) phases. As well, the Contractor must attend a site visit to provide drawings of possible layout options for the area which must include maximizing the space usage and reusing the Haworth furniture in stock to determine the scope of work of this reconfiguration. 2.1 Tasks ( Design and Installation): The following are, but not limited to, tasks related to the installation of the purchased product a) Must visit the work site in order to get understanding with the specific scope of work and the work site. b) Must provide drawings for each furniture layout option (Phase 1 and Phase 2) and get approval by CRA’s project team. Layouts must comply with the building codes and regulations. c) Provide detailed installation drawings and technical specifications which support proficient and effective installations. d) Provide old furniture and existing furniture reuseplan to ensure that the total cost of purchasing new furniture is reduced. e) Install all products in accordance with the manufacturers’ specifications. f) Must provide the installation services after regular working hours from 5:00 p.m. to 11:00 p.m.Monday to Friday including weekends (excluding statutory holidays), at no additional costs. g) Must supply all equipment, tools and labour required for the installation. 2.2 Location of Requirement: CRA 4th Floor East, 1 Front Street West Toronto, Ontario 3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements) Any interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements: 1. Must be an authorized reseller of Haworth furniture systems. To proof compliance, the Bidder must provide validation from the manufacturer that they are an authorized reseller of their product. 2. Must be able to provide a minimum of two (2) Haworth certified installers. Toproof compliance, the Bidder must provide a copy of their certification. 3. Must meet the building code and city construction regulation. 4. Must provide warranty for the furniture installed. 4. Applicability of the trade agreement(s) to the procurement This procurement is subject to the following trade agreement(s): a. Agreement on Internal Trade (AIT); and b. North American Free Trade Agreement (NAFTA) 5. Justification for the Pre-Identified Supplier CRA has 17 Haworth furniture systems that need to be dismantled, relocated and reconfigured to incorporate additional Haworth furniture systems. Authorized Haworth dealers must be used for the dismantling, installation and reconfiguration in order to fulfil warranty requirements and fitinto the existing furniture system. To the best of CRA’s knowledge, CTI Working Environment Inc., is the only known authorized dealer and certified installer of Haworth furniture systems meeting the specifications and performing the work including the delivery requirement constraints, location and reconfiguration plan incorporating the existing furniture systems. 6. Government Contracts Regulations Exception(s) The following exception(s) to the Government Contracts Regulations is (are) invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work"). 7. Exclusions and/or Limited Tendering Reasons The following exclusion(s) and/or limited tendering reasons are invoked under the: AgreementonInternal Trade (AIT) - Article 506.12 (a), to ensure compatibility with existing products, to recognize exclusive rights, such as exclusive licences, copyright and patent rights, or to maintain specialized products that must be maintained by the manufacturer or its representative; and (b), where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particular supplier and no alternative or substitute exists; and North American Free Trade Agreement (NAFTA) - Article1016 (b), where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists; and (d) for additional deliveries by the original supplier that are intended either as replacement parts or continuing services for existing supplies, services or installations, or as the extension of existing supplies, services or installations, where a change of supplier would compel the entity to procure equipment or services not meeting requirements of interchangeability with already existing equipment or services, including software to the extent that the initial procurement of the software was covered by this Chapter. 8. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 12. Closing date for a submission of a statement of capabilities The closing date and time for accepting statements of capabilities is November 23, 2016 at 2:00 p.m. EST. 13. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
