    1. Advanced Contract Award Notice (ACAN) 
    An ACAN is a public notice indicating to the supplier community
    that a department or agency intends to award a contract for
    goods, services or construction to a pre-identified supplier,
    thereby allowing other suppliers to signal their interest in
    bidding, by submitting a statement of capabilities. If no
    supplier submits a statement of capabilities that meets the
    requirements set out in the ACAN, on or before the closing date
    stated in the ACAN, the contracting officer may then proceed
    with the award to the pre-identified supplier. 
    2. Definition of the Requirement 
    The Department of Agriculture & Agri- Food Canada (AAFC) -
    Harrow, ON requires the supply, delivery, labor and installation
    of (1) Cummins - Onan 800 KW Alternator. 
    This requirement is to replace the alternator of its current
    Emergency Generator that failed due to an ARC flash.  The
    requirement includes:
    
    a)	The complete removal of the alternator and all damaged parts;
    b)	The repair or replacement of associated control panels and
    harness as required.
    c)	The replacement of related components and parts that cannot
    be re-used;
    d)	The testing and re-commissioning of the unit; and
    e)	Warranty documentation.
    
    The Emergency Generator is used for backup power supply for
    AAFC's Research facility, power plant and greenhouse operations.
    
    3.  The Minimum Essential Requirements
    
    Any interested supplier must demonstrate by way of a statement
    of capabilities that it can supply and install the appropriate
    alternator and associated control panels, harness and parts to
    meet the following specifications:
    
    Ø	Cummins Diesel Power Generator originally purchased in 2002
    Make:  ONAN
    Model: GEN SET
    Unit No.: 800DFHB
    Engine Serial #: 37203028;
    
    Ø	All components, modules, assemblies and miscellaneous hardware
    for this project must be new (OEM) original equipment
    manufacturers parts, used materials will not be acceptable.
    Ø	The Contractor must provide all travel, replacement
    components, rental equipment, programming, testing and
    commissioning services and warranty documentation. 
    Ø	All technicians, mechanics and software engineers must have
    Cummins ONAN factory training for this type of diesel generator
    set and associated control and monitoring system.
    Ø	The Contractor must perform all work in a timely fashion, a
    project schedule will be provided to Agriculture and Agri-Food
    Canada outlining project startup through commissioning.  
    Ø	The Contractor must ensure that after the 800 Kilowatt
    alternator has been replaced, tested and commissioned the
    complete system including the 300 Kilowatt Cummins diesel
    generator set will be tested on line with the 800 kilowatt
    Cummins diesel generator set.  The Contractor must complete a
    full two (2) hour load bank test with both diesel generator sets
    on line, upon successful completion provide certificates for
    both units to Agriculture and Agri-Food Canada.
    Ø	All software must also be compatible with the existing on site
    monitoring and control system.  The existing configuration
    allows for remote access by Cummins Eastern Canada.
    
    Ø	The goods must be delivered FOB destination, Harrow, Ontario,
    Canada.
    
    4.  Applicability of the Trade agreement (s) to the procurement 
    This procurement is subject to the following trade agreement(s): 
    Agreement on Internal Trade (AIT) 
    North American Free Trade Agreement (NAFTA)
    5. Justification for the Pre-Identified Supplier 
    It is intended to sole source this requirement to Cummins
    Eastern Canada LP, the only known source on the market who can
    meet the minimum specifications.
    6. Government Contracts Regulations Exception 
    The following exception to the Government Contracts Regulations
    is invoked for this procurement under subsection 6(d) only one
    person or firm is capable of performing the work.
    7. Exclusions and/or Limited Tendering Reasons 
    The following exclusion(s) and/or limited tendering reasons are
    invoked under the section of the trade agreement(s) specified: 
    - AIT), Article 506.12 (b) where there is an absence of
    competition for technical reasons and the goods
    or services can be supplied only by a particular supplier and no
    alternative or substitute exists.
    
    -NAFTA, Article 1016.2 b): Where, for works of art, or for
    reasons connected with the protection of patents, copyrights or
    other exclusive rights, or proprietary information or where
    there is an absence of competition for technical reasons, the
    goods or services can be supplied only by a particular supplier
    and no reasonable alternative or substitute exists. 
    8.  Delivery Date
    The system must be delivered and installed as soon as possible,
    but no later than 30 September 2014.

    10.	Suppliers' right to submit a statement of capabilities
    Suppliers who consider themselves fully qualified and available
    to provide the goods, services or construction services
    described in the ACAN may submit a statement of capabilities in
    writing to the contact person identified in this notice on or
    before the closing date of this notice. The statement of
    Capabilities must clearly demonstrate how the supplier meets the
    advertised requirements.
    11. Closing date for a submission of a statement of capabilities 
    The closing date and time for accepting statements of
    capabilities is: 10th September 2014 at 2:00 p.m. EST.

    You are hereby notified that the government intends to negotiate
    with one firm only as identified above. Should you have any
    questions concerning this requirement, contact the contracting

    An Advance Contract Award Notice (ACAN) allows departments and
    agencies to post a notice, for no less than fifteen (15)
    calendar days, indicating to the supplier community that it
    intends to award a good, service or construction contract to a
    pre-identified contractor. If no other supplier submits, on or
    before the closing date, a Statement of Capabilities that meets
    the requirements set out in the ACAN, the contracting authority
    may then proceed with the award.  However, should a Statement of
    Capabilities be found to meet the requirements set out in the
    ACAN, then the contracting authority will proceed to a full
    tendering process.
    
    Suppliers who consider themselves fully qualified and available
    to provide the services/goods described herein, may submit a
    statement of capabilities in writing to the contact person
    identified in this Notice on or before the closing date of this
    Notice. The statement of capabilities must clearly demonstrate
    how the supplier meets the advertised requirements.
    
    The PWGSC file number, the contracting officer's name and the
    closing date of the ACAN must appear on the outside of the
    envelope in block letters or, in the case of a facsimile
    transmission, on the covering page.
    
    The Crown retains the right to negotiate with suppliers on any
    procurement.
    
    Documents may be submitted in either official language of Canada.
