Advance Contract Award Notice (ACAN) An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Definition of the requirement The Department of Environment (EC) has a requirement for the supply of one (1) Accelerated Extraction Solvent (ASE) systems, with an option to purchase two additional ASE in 2019/2020. Environment Canada lab is currently extracting a huge backlog of samples. If EC cannot purchase this exact Accelerated Solvent Extractor (ASE), it will significantly disrupt the sample processing. The samples processed in EC lab are obtained from our long term passive air sampling network. It is crucial to use the exact same ASE to process the samples to ensure the results obtained will be comparable to previously processed samples. This is necessary to accurately interpret EC results and report on long term trend analysis. The Thermo Fisher Scientific ASE 350 system has the ability to validate a number of methods for extracting atmospheric samples. These methods include: Extraction of glass fiber filters used in air sampling for the determination of polycyclic aromatic hydrocarbons (PAHs), polybrominated diphenyl ethers (PBDEs), organochlorine pesticides (OCPs), polychlorinated biphenyls (PCBs), organophosphate ester (OPE) flame retardants, per- and polyfluoroalkyl compounds (PFASs), novel flame retardants (nFRs) and other emerging compounds. Extraction of polyurethane foam (PUFs) used in air sampling for the determination of polycyclic aromatic hydrocarbons (PAHs), polybrominated diphenyl ethers (PBDEs), organochlorine pesticides (OCPs), polychlorinated biphenyls (PCBs), organophosphate ester (OPE) flame retardants, per- and polyfluoroalkyl compounds (PFASs), novel flame retardants (nFRs) and other emerging compounds. Cleanup of PUFs prior to usage as a sampling media. Extract atmospheric samples at elevated temperatures and pressures to increase the kinetics of the extraction process. 3. For assessment of the Statement of Capabilities (Minimum Essential Requirements) the following must be met: 1.1 Extractor must operate on a laboratory bench without the use of a fume-hood and must not be larger than 80cm depth x 200 cm length x 100 cm height; 1.2 Extractor must prevent solvent vapor from being expelled into the atmosphere. Extractor must have a built in vapor sensor to shut down Extractor if vapor threshold levels above 100 are detected; 1.3 Extractor must have front panel control with both method and schedule editor and method and schedule storage; 1.4 Extractor must have an integrated solvent controller permitting the use of up to three solvents that are mixed and introduced to the extraction cell in preset ratios 1.5 Extractor must provide for the use of organic solvents as well as other polar, such as water, or non-polar liquids for extraction. The extractor must operate from ambient to 200 degrees Celsius and ramp the pressure from 0 to 1500 psi, holding at 1500 psi once thermal equilibrium has been reached; 1.6 Extractor must be able to perform extractions with a solvent saver mode to provide solvent savings up to 30%; 1.7 Extractor must be able to carry out extractions in static mode to help maintain extraction equilibrium; 1.8 The extractor must use a combination of solvents under set temperature and pressure conditions to perform rapid and efficient extractions; 1.9 Extractor must have ability to extract and collect volatile and non-volatile compounds for analysis; 1.10 Extractor must be capable of oven temperature control of up to 200 degrees Celsius and cell pressure control up to 1500 psi. Extractor must have controls to prevent operation at excessive temperatures and pressures. These controls include flammable vapour sensors, liquid lead detectors, check for vial overfill, over-pressurizing prevention (electronic and mechanical), pneumatic source pressure monitoring. If the temperature of the oven is detected to climb above the set temperature, the extraction must stop and the system must release the pressure to below 10 psi; 1.11 The solvent pump must pump at least 70 millilitres (mL) per minute; 1.12 Extractor must have an automatic pressure sensor and pressure relief during extraction cell heat up; 1.13 Extractor must be able to run unattended and automatically shut down once the extraction sequence is completed; 1.14 Extractor must have minimum of 24 position sample carousel with minimum of two rinse positions for unattended operation; 1.15 Extractor must have automatic rinsing between samples as a user selectable option; 1.16 Extractor must provide use of 1mL, 5mL, 10mL, 22mL, 34mL, 66mL and 100mL extraction cells interspersed on the sample carousel; 1.17 Cells must be tightened by hand so that no wrenches or mechanical tightening is required; 1.18 Extractor must accommodate either 60mL or 250mL collection bottles; 1.19 Collection bottles must be contained behind a safety shield; 1.20 Extractor must have built in fluid sensors that detect the arrival of fluid into the collection vial and fluid levels during the extract collection; 1.21 Extractor must have automatic shut-off in the event of sensor failure; 1.22 Extractor must perform multiple sequential extractions per individual cells. Extracts can then be collected into the same or different collection vials; 1.23 Extractor must allow extracts to be automatically filtered prior to collection in the vial; 1.24 Extractor must store system errors information for retrieval at the end of the extraction run(s); 1.25 Extractor must monitor each sample for pressure and temperature. Sample monitoring must detail how sample is extracted according to user method; 1.26 Extractor must extract acidified or alkaline samples with the use of a pH hardened pathway and pH resistant extraction cells. The following components must be resistant to acidic or alkaline matrixes: Top cell tip of the cell transfer lines; all valves; Needles or tubing that are "downstream" from the extraction cells; 1.27 Extractor power requirements must be 100-120 VAC, 50/60 Hz. 4. Applicability of the trade agreement(s) to the procurement This procurement is subject to the following trade agreement(s) Canada Free Trade Agreement (CFTA) North American Free Trade Agreement (NAFTA) World Trade Agreement (WTO) Canada-European Union Comprehensive Economic and Trade Agreement (CETA) 5. Justification for the Pre-Identified Supplier The identified supplier is: THERMO FISHER SCIENTIFIC (MISSISSAUGA) INC. 2845 Argentia Rd Unit 4 Mississauga, Ontario L5N 8G6 Canada, the only known Supplier who can meet the minimum essential requirements of the ASE 350 system. There are no other known Supplier that meets the requirement as outlined in the Statement of capabilities. 6. Government Contracts Regulations Exception(s) The following exception(s) to the Government Contracts Regulations is (are) invoked for this procurement under subsection subsection 6(d) - "only one person is capable of performing the work"). 7. Exclusions and/or Limited Tendering Reasons The following exclusion(s) and/or limited tendering reasons are invoked under the CFTA Article: 513 b. the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute goods or services exist for any of the following reasons: (iii) Due to an absence of competition for technical reasons; North American Free Trade Agreement (NAFTA) Article 1016.2.b - where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists; World Trade Organization - Agreement on Government Procurement (WTO-AGP) Article XV1.(b) when, for works of art or for reasons connected with protection of exclusive rights, such as patents or copyrights, or in the absence of competition for technical reasons, the products or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists. Canada-European Union Comprehensive Economic and Trade Agreement (CETA) Article 19.12 Limited tendering: If the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute goods or services exist for any of the following reasons: due to an absence of competition for technical reasons. 8. Delivery date The goods must be delivered on 31 March 2018. Options: (1) ASE must be delivered on or before 31 March 2019. (1) ASE must be delivered on or before 31 March 2020. 9. The estimated value of the contract is $280,000 (GST/HST extra). 10. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
