Calgary Alberta Canada T2V5C6 Nature of Requirements: Hydrogen Probe and Monitor 1. ACAN Explanation An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. 2. Definition of Requirement Natural Resources Canada, requires the supply and delivery of one (1) Hydrogen probe and monitor comprising one (1) Hydrosteel 6000 Instrument (Battery only) Model A-40654, LT-R Probe Model A-41031, and miscellaneous accessories. Delivery is required on or before March 28, 2013. 3. Criteria for Assessment of the Statement of Capabilities 3.1 Minimum Essential Requirements: Any interested supplier must demonstrate by way of a statement of capabilities that its product meets the following requirements: A hand held device and attached monitor that measure the flux of hydrogen diffusing through a steel sheet. The measured data must be transferred to a computer for subsequent analysis. The device will be attached to a multi-module, custom made apparatus (designed entirely at Natural Resources Canada, CanMetMATERIALS) and must comply with the overall apparatus in terms of dimensional restriction, operational requirements and specimen size. Operational requirements: a) surface measurement and monitoring of Hydrogen flux diffusing through steel sheet (0.5 to 2 mm thickness) b) using surface-based, non-intrusive, non-destructive, non-electrochemical, dry method c) enable of data logging and data transferring to computer d) stand alone device without need for additional analyzer, e.g. mass spectroscope, gas chromatography Specifications: Price: less than $33,000.00 CAD (excluding shipping and taxes) Probe size: surface area between 400 mm2 to 700 mm2 Sensitivity: less than 3 pl/cm2 s-1 Response time: less than 90 sec Surface temperature of steel: 20-300 degrees C Expected results: Determine, show and record Hydrogen flux diffusing through a steel sheet with aforementioned thickness and surface area. The amount of flux must be in pL/Cm2/s and must be detected with response time less than 90s and sensitivity less than 3 pL/cm2/s. 4. Applicability of Trade Agreements This procurement is subject to the following trade agreements: Agreement on Internal Trade (AIT) North American Free Trade Agreement (NAFTA) 5. Justification for the Pre-Identified Supplier Corr Science Inc. is the authorized Canadian representative for ION Science Americas, and this is a unique device developed based on patented flux measurement principle for which the IP belongs to the Director of ION Science Americas. 6. Government Contracts Regulations Exception The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - "Only one person or firm is capable of performing the contract"; for patent or copyright requirements, or technical compatibility factors and technological expertise." subsection 6(d) - "Only one person or firm is capable of performing 7. Exclusions and/or Limited Tendering Reasons The following exclusion(s) and/or limited tendering reasons are invoked under the section of the trade agreement(s) specified: Agreement on Internal Trade (AIT) - Article 506.12 (b) "where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particular supplier and no alternative or substitute exists." North American Free Trade Agreement (NAFTA) - Article 1016.2 (b), "where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists." 8. Suppliers' right to submit a statement of capabilities Suppliers who consider themselves fully qualified and available to provide the goods and services described in the ACAN, may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 11. The closing date for a submission of a statement of capabilities: The closing date and time for accepting statement of capabilities is 4 January 2013 at 2:00 p.m. EST. 12. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
