    1. An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 
    
    2. Definition of requirement 
    The Department of National Defence (DND) has a requirement for the supply of quantity six (6) PortaCount Pro+ 8038 or equivalent Respirator Fit Tester units in accordance with Specification, with the option to purchase additional four (4) units, spare parts and extended in-service support.  The respiratory protection system must be compatible with existing respirators currently in use by the Department of National Defence, Canadian Armed Forces, to support the fit-testing of Avon, SCOTT, C4, commercial, disposal respirators (N95s) and be forward compatible with further respirators.  
    
    3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements)
    Any interested supplier must demonstrate by way of a statement of capabilities that its equipment meets the following requirements: 
    Mandatory Operational Performance Requirements:
    1.1   The Respirator Fit Tester Requirements:
    1.1.1 Must be a commercial-off-the-shelf, tester that measures ambient particle 
    concentration inside and outside the respirator and calculates a fit factor,  the ratio of the two measurements.
    1.1.2 Must come equipped with a system to print fit testing results and externally 
             store data;
    1.1.3 Must be transportable as an integrated unit in its case;
    1.1.4 Must have a size and weight that permits portability as follows:
    i. No Larger than the following dimensions without accessories and case 
       Length (11.8in) x Width (9.8in) x Height (7.9in)
    ii. Weigh of actual unit no more than 4.0 kg (8.8 pounds) without
        accessories and case;
    1.1.5 Must operate on 100 to 250 VAC, 50/60 Hz frequency; and,
    1.1.6 Must have a calibration life of no less than one (1) year.
    
    1.2 Mandatory Technical Requirements:
    The technical requirements for the respirator fit tester are detailed in the following:
    1.2.1 Must permit printing and external storage fit factor result data;
    1.2.2 Must measure particle concentration range from 0.01 to 2.5 x 105 
             particles/cm3
    1.2.3 Must have a measurement precision of fit factor range from one (1) to   
             10,000;
    1.2.4 Must fit and measure a wide variety of respiratory protective systems,  
             including;
    1.2.4.1 Negative pressure Air Purifying Respirators (APR);
    1.2.4.2 Powered Air Purifying Respirators (PAPRs); and
    1.2.4.3 Disposable, half-face respirators (N95 series);
    1.2.5    Must have a sample flow rate of no less than 350 cm3/min;
    1.2.6    Must have a total flow rate of no less than 1000 cm3/min;
    
    1.3 Mandatory Accessories:
    The respirator fit tester must include the following accessories:
    1.3.1 Hard-sided carrying case for fit tester and accessories;
    1.3.2 Power supply adapter;
    1.3.3 Alcohol supply for approximately 500 hours of usage;
    1.3.3 Operator and service manuals;
    1.3.4 Software for respirator fit test calculation;
    1.3.5 Required cabling to interface the respirator fit tester with a laptop; and
    1.3.6 Adaptors and components to test the following respirator systems:
    1.3.6.1 C4;
    1.3.6.2 AVON FN53; and
    1.3.6.3 SCOTT FRR;
    1.3.6.4 AirBoss Low Burden Mask;
    4. Applicability of the trade agreement(s) to the procurement This procurement is subject to the following trade agreement(s): 
    - Agreement on Internal Trade (AIT) 
    - World Trade Organization - Agreement on Government Procurement (WTO-AGP) 
    -North American Free Trade Agreement (NAFTA)
    5. Justification for the Pre-Identified Supplier 
    The only known supplier of PortaCount Pro+ 8038, meeting all the above required technical specifications is Levitt Safety 2872 the only exclusive distributorof TSI Incorproated. For this reason, it is proposed to negotiate this requirement with Levitt Safety 2872.
    6. Government Contracts Regulations Exception(s) 
    The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work”.
    
    7. Exclusions and/or Limited Tendering Reasons The following exclusion(s) and/or limited tendering reasons are invoked under the:
    
    Agreement on Internal Trade (AIT)  Article 506.12.b - where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particular supplier and no alternative or substitute exists; (CAP code 71)
    
    North American Free Trade Agreement (NAFTA) Article 1016.2.b - where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists; (CAP Code 71)
    
    World Trade Organization - Agreement on Government Procurement (WTO-AGP) Article XV1.(b) when, for works of art or for reasons connected with protection of exclusive rights, such as patents or copyrights, or in the absence of competition for technicalreasons, the products or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists.(CAP Code 71)
    8. The period of the proposed contract or the delivery date(s) 
    The equipment must be delivered on or before November 30, 2016 with the option to purchase an additional (4) Respiratory Fit Testers within the contract period and three additional one-year option periods for extended warranty services and spare parts on an ``as-and-when requested`` basis through a Task Authorization process. 
    
    9. A cost estimate of the proposed contract 
    The estimated value of the contract, including option(s), is $280,014.16 (GST/HST extra).

    An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award.  However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.
    
    Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
    
    The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page.
    
    The Crown retains the right to negotiate with suppliers on any procurement.
