    1. Advance Contract Award Notice (ACAN)
    
    An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
    
    2. Definition of the requirement
    
    Environment and Climate Change Canada (ECCC) has a requirement for one (1) new fluorescence technology submersible probe (BG34000 PhycoProbe) required to sense chlorophyll a and other algal pigments and to quantify and differentiate a minimum of four algal classes through the use of in vivo florescence. The equipment must be compatible for integration with the other vertical profiling equipment on board the CCGS Limnos which needs to operate in real-time profiling mode over the length of cable using and  provide data that is autocorrected for ambient temperature and turbidity effects, in order to minimize post-processing of the data.
    
    3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements)
    
    Any interested supplier must demonstrate by way of a statement of capabilities that its equipment meets the following requirements:
    
    Technical Specifications: 
    
    a. Must have In vivo measurement of chlorophyll a and phycocyanin within the 0-200 ug/L range and with a resolution of 0.01 ug Chla/L and 0.2 ug phycocyanin/L. 
    
    b. Must have in vivo measurement of between four and seven classes of algae, including but not limited to: blue-green algae, green algae, diatoms and cryptophytes
    
    c. Must be equipped with an Internal data logger
    
    d. Must perform Data corrections for temperature, turbidity and coloured dissolved organic matter (CDOM) effects
    
    e. Must withstand pressures of up to 300 m water depth
    
    f. Must operate in real-time profiling mode over the length of cable using RS485 (2-wire) communications and must be no higher than 24VDC operation
    
    4. Applicability of the trade agreements to the procurement

    5. Justification for the Pre-Identified Supplier
    
    Pursuant to the Government Contracts Regulations of the Financial Administration Act, the contract is being awarded because it has been determined that only one vendor is capable of performing the contract for reasons listed herein.
    
    Environmental Analytical Systems (EAS) has been selected because they are the sole authorized and exclusive distributor for the territory of Canada by BBE Moldaenke, Germany, who is the original equipment manufacturer (OEM) of the BG34000 PhycoProbe, and the sole owner of all related intellectual property for the instrument. The PhycoProbe meets all the minimum essential requirements listed in Section 3 above as it is capable of differentiating multiple algal groups in vertical profiles withstanding pressures of up to 300 m water depth using fluorescence technology.
    
    As the sole supplier, Environmental Analytical Systems in Barry Bay, Ontario, has been selected as Contractor. The requested BG34000 PhycoProbe which is the only manufacturer currently that provides a profiling unit with fluorescence technology capable of distinguishing multiple algal classes (7) and vertical profiles of 300 m.
    
    6. Government Contracts Regulations Exception(s)
    
    The following exception(s) to the Government Contracts Regulations is (are) invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work").
    
    7. Exclusions and/or Limited Tendering Reasons
    
    The following exclusion(s) and/or limited tendering reasons are invoked under the:
    
    Canadian Free Trade Agreement (CFTA) is applicable to this requirement. 
    
    Limited Tendering is applicable under paragraph 1 through 3 of Article 513, specifically (b) (ii) where, where, the goods or services can be supplied by a particular supplier an no reasonable alternative or substitute goods or services exist for any of the following reasons (I, ii, iii, iv, v, vi).
    
    8. Ownership of Intellectual Property
    
    BBE Moldaenke owns the patent rights and is the sole manufacturer of the PhycoProbe. Environmental Analytical Systems is the only agent of BBE products in Canada. 
    
    9. Period of the proposed contract or delivery date 
    
    The equipment must be delivered on or before March 31, 2022.
    
    10. Cost estimate of the proposed contract:
    
    The cost value of the contract is $44,015.00 (taxes extra); Subject to negotiation.

The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.

    An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award.  However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.
    
    Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.

    The Crown retains the right to negotiate with suppliers on any procurement.
