    1.	ACAN Explanation
    
    An Advance Contract Award Notice (ACAN) allows departments and
    agencies to post a notice, for no less than fifteen (15)
    calendar days, indicating to the supplier community that it
    intends to award a good, service or construction contract to a
    pre-identified contractor. If no other supplier submits, on or
    before the closing date, a Statement of Capabilities that meets
    the requirements set out in the ACAN, the contracting authority
    may then proceed with the award.
     
    2.	Definition of Requirement
    
    Environment Canada (EC) is leading the effort of a Solid
    Precipitation Intercomparison project by addressing issues that
    are particularly relevant to Canadian requirements pertaining to
    snow measurement. Specifically, EC is studying the effects of
    precipitation type (snow shape, density) and associated fall
    velocity on the catching efficiency of various snow gauge and
    wind shield configurations. To support this effort, Environment
    Canada, King City, Ontario requires the supply, delivery,
    installation and on-site training of one (1) 2D Video
    Distrometer system complete with hardware and software and its
    Raindrop Orientation Software Package. User manual and one year
    software assistance and upgrade is also required. The instrument
    will be used to measure size, shape, fall and horizontal
    velocity of falling hydrometeors or precipitation particles. 
    
    3.	Criteria for Assessment of the Statement of Capabilities
    
    3.1	Minimum Essential Requirements:
    
    Any interested supplier must demonstrate by way of a statement
    of capabilities that its product meets the following
    requirements: 
    
    1)	The instrument must be able to measure any falling particle
    individually in two different planes and produce images of a
    given snowflake or a rain drop in two orthogonal projections to
    allow accurate estimate of the particle size, shape, volume and
    particle fall velocity. 
    
    2)	Capable of  measuring both horizontal and vertical velocity
    of falling hydrometeors.
    
    3)	Vertical resolution of falling particles must be at least 
    0.03 mm for snowflakes and 0.1 mm for rain drops. 
    
    4)	Vertical velocity must be measured  with an accuracy of
    better than 4%. 
    
    5)	The instrument must be able to allow correction associated
    with drop splashing or shattering of snow flakes. 
    
    6)	Images produced by the instrument must have at minimum high
    time resolution of 29 microseconds. 
    
    7)	Instrument must be able to operate between the temperature
    range of -20  to + 50C.  
    
    
    8)	The instrument must have a minimum sampling area of  100 mm x
    100 mm.
    
    4.	Applicability of Trade Agreements
    
    This procurement is subject to the following trade agreements:

    5.	Justification for the Pre-Identified Supplier
    
    Joanneum Research located in Graz, Austria, is the original
    equipment manufacturer, the developer and the owner of the IP of
    this equipment. Joanneum Research does not have authorized
    resellers or distributors for their equipment. 
    
    6.	Government Contracts Regulations Exception
    
    The following exception to the Government Contracts Regulations
    is invoked for this procurement under subsection 6(d)  Only one
    person or firm is capable of performing the contract; for patent
    or copyright requirements, or technical compatibility factors
    and technological expertise.
    7.	Exclusions and/or Limited Tendering Reasons
    
    The following exclusion(s) and/or limited tendering reasons are
    invoked under the section of the trade agreement(s) specified:
    
    Agreement on Internal Trade (AIT)  Article 506.12 (b) where
    there is an absence of competition for technical reasons and the
    goods or services can be supplied only by a particular supplier
    and no alternative or substitute exists.
    
    North American Free Trade Agreement (NAFTA)  Article 1016.2 (b),
    where, for works of art, or for reasons connected with the
    protection of patents, copyrights or other exclusive rights, or
    proprietary information or where there is an absence of
    competition for technical reasons, the goods or services can be
    supplied only by a particular supplier and no reasonable
    alternative or substitute exists.
    
    8.	The Delivery Date
    
    Delivery is required no later than December 1, 2012.

    10.	Suppliers right to submit a statement of capabilities
    
    Suppliers who consider themselves fully qualified and available

    submit a statement of capabilities in writing to the contact
    person identified in this notice on or before the closing date
    of this notice. The statement of capabilities must clearly
    demonstrate how the supplier meets the advertised requirements. 
    
    11.	The closing date for a submission of a statement of
    capabilities:

    capabilities is October 31, 2012 at 2:00 p.m. EDT.

    Notice. The statement of capabilities must clearly demonstrate

    The PWGSC file number, the contracting officer's name and the
    closing date of the ACAN must appear on the outside of the
    envelope in block letters or, in the case of a facsimile
    transmission, on the covering page.
    
    The Crown retains the right to negotiate with suppliers on any
    procurement.
