    1.	ACAN Explanation
    
    An Advance Contract Award Notice (ACAN) allows departments and
    agencies to post a notice, for no less than fifteen (15)
    calendar days, indicating to the supplier community that it
    intends to award a good, service or construction contract to a
    pre-identified contractor. If no other supplier submits, on or
    before the closing date, a Statement of Capabilities that meets
    the requirements set out in the ACAN, the contracting authority
    may then proceed with the award.
    
    2.	Definition of Requirement
    
    Environment Canada, Meteorological Services Canada, located at
    Downsview, Ontario, requires the supply and delivery of quantity
    four (4) ICEX capsule buoy (X-2412(V-06) with magnetic switch
    and equipped with Iridium telemetry to be delivered no later
    than March 28, 2013, with an option to purchase up to quantity
    of two (2) units from date of contract award to March 28, 2013.
    There is also an option to purchase up to quantity of six (6)
    units between April 1, 2013 to March 31, 2014 to be delivered
    before March 31, 2014, and an option to purchase up to quantity
    of six (6) units between April 1, 2014 to March 31, 2015 to be
    delivered before March 31, 2015, as well as an option to
    purchase up to quantity of six (6) units between April 1, 2015
    to March 31, 2016 to be delivered before March 31, 2016.
    
    3.	Criteria for Assessment of the Statement of Capabilities
    
    3.1	Minimum Essential Requirements:
    
    Any interested supplier must demonstrate by way of a statement
    of capabilities that its product meets the following
    requirements: 
    
    1.	Must be built for operation in the Arctic environment, with
    intended deployment onto multi-year ice pack. Supplier must
    demonstrate successful deployments from C-130 or similar
    aircraft, with at least 10 successful deployments over the past
    5 years.
    
    2.	Typical Buoy Dimensions (nominal)
    Height:	90 cm
    Diameter:	60 cm
    Weight:	70 kg
    
    3.	Buoy Construction 
    Buoy hull is constructed of fiberglass suitable for air
    deployment onto surface of the ice. Sensors exposed to the
    elements, while still protected by conical shape of the top
    portion of the hull.
    
    4.	Electronics and Sensor package
    
    Electronics/Telemetry
    GPS (Navcore V-GPS or equivalent);
    Iridium SBD;
    Sensor sampling period is once every 10 minutes, with message
    delivery each hour. 
    
    Sensors
    Barometer Pressure - Paroscientific Digiquartz 216 B or
    equivalent;
    Air Temperature - Fenwall thermistor in Aanderaa Radiation
    Screen;
    Sea Surface Temperature - Fenwall thermistor in ConMar Brass
    Housing.
    
    5.	Power 
    12 series of 4 lithium Thionyl Cell batteries which must be UN
    Certified for air transport.
    
    6.	Buoy Operational Lifetime
    Supplier must be able to demonstrate operational lifetimes of
    similar units in service in Arctic environments as follows:
    Demonstrated performance in Arctic Environment of up to 3 years,
    and minimum of 1.5 years.
    
    7.	Supplier must be able to deliver the product on or before
    March 28, 2013. 
    
    4.	Applicability of Trade Agreements
    
    This procurement is subject to the following trade agreements: 
    Agreement on Internal Trade (AIT)
    North American Free Trade Agreement (NAFTA)
    World Trade Organization Agreement on Government Procurement
    (WTO-AGP)
    
    5.	Justification for the Pre-Identified Supplier
    
    ICEX capsule buoy is the only known product which can monitor
    position, surface air temperature, and surface pressure,
    certified for air deployment and meeting all the technical
    requirements. Christian Michelsen Research AS, Norway is the
    original equipment manufacturer of the ICEX capsule buoys and is
    the only distributor. 
    
    6.  Government Contracts Regulations Exception
    
    The following exception to the Government Contracts Regulations
    is invoked for this procurement under section 10.2.1 subsection
    6(d)  Only one person or firm is capable of performing the
    contract; for patent or copyright requirements, or technical
    compatibility factors and technological expertise. 
    7.	Exclusions and/or Limited Tendering Reasons
    The following exclusion(s) and/or limited tendering reasons are
    invoked under the section of the trade agreement(s) specified:
    
    Agreement on Internal Trade (AIT)  Article 506.12 (b) where
    there is an absence of competition for technical reasons and the
    goods or services can be supplied only by a particular supplier
    and no alternative or substitute exists.
    
    North American Free Trade Agreement (NAFTA)  Article 1016.2 (b),
    where, for works of art, or for reasons connected with the
    protection of patents, copyrights or other exclusive rights, or
    proprietary information or where there is an absence of
    competition for technical reasons, the goods or services can be
    supplied only by a particular supplier and no reasonable
    alternative or substitute exists.
    
    TheWorld Trade Organization Agreementon Government Procurement
    (WTO-AGP) ArticleXV (b) when, for works of art or for reasons
    connected with protection of exclusive rights, such as patents
    or copyrights, or in the absence of competition for technical
    reasons, the products or services can be supplied only by a
    particular supplier and no reasonable alternative or substitute
    exists. 
    
    8. The Delivery Date
    
    Quantity of four (4) units must be delivered no later than March
    28, 2013. If option to purchase additional quantities is
    exercised, up to two (2) additional units must be delivered by
    March 28, 2013, up to six (6) units must be delivered by March
    31, 2014, up to six (6) units must be delivered by March 31,
    2015, up to six (6) units must be delivered by March 31, 2016.

    10.	Suppliers right to submit a statement of capabilities
    
    Suppliers who consider themselves fully qualified and available
    to provide the goods and services described in the ACAN, may
    submit a statement of capabilities in writing to the contact
    person identified in this notice on or before the closing date
    of this notice. The statement of capabilities must clearly
    demonstrate how the supplier meets the advertised requirements. 
    
    11.	The closing date for a submission of a statement of
    capabilities:

    capabilities is November 05, 2012 at 2:00 p.m. EST.

    closing date of the ACAN must appear on the outside of the
    envelope in block letters or, in the case of a facsimile
    transmission, on the covering page.
    
    The Crown retains the right to negotiate with suppliers on any
    procurement.
    
    Documents may be submitted in either official language of Canada.
