    1. Advance Contract Award Notice (ACAN) 
    An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
    
    2. Definition of the Requirement
    Title: Coded Wire Tag Fishery Sampling and Laboratory Services for the Department of Fisheries and Oceans, Pacific Region.  
    
    The Department of Fisheries and Oceans Canada has a broad mandate to develop and implement programs in support of Canada’s economic, ecological and scientific interests in oceans and inland waters. The Canada/U.S. bilateral coast-wide “Coded Wire Tag Indicator Program” forms the basis for DFO Pacific Region Science to assess the state of Chinook and Coho Salmon stocks against benchmarks to support Pacific Region stock assessment, sustainable fisheries, hatchery management, and Canada’s domestic commitments under the Pacific Salmon Treaty. The ability to make informed decisions concerning the management of Pacific Salmon fisheries and hatcheries is dependent on this sustained and systemic research program. 
    
    The objective is to obtain coded wire tag (CWT) biological sampling services for B.C. commercial and recreational fisheries, and to obtain CWT laboratory services to dissect, extract and read CWTs from sample groups in fishery, hatchery and spawning grounds of the Pacific Region. 
    
    3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements)
    
    Any interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements: 
    - The supplier must have extensive expertise and experience in dockside monitoring programs including catch verification, biological sampling, and taxonomic identification of salmon.
    - The supplier must have extensive expertise and experience in fisheries related laboratory work including common dissection techniques and taxonomic identification of salmon. 
    - The supplier must have extensive expertise and experience in project management to complete the work within the contract deadline(s), while meeting or exceeding quality control standards as set forth within standard protocols. 
    - The supplier must have qualified and experienced staff located locally to perform the Work.
    Extensive is defined as greater than five (5) years and supported by successful contracts, published papers and/or references. 
    
    Special Requirements and Certification:
    The supplier must be listed with the Canadian General Standards Board, and designated by Fisheries and Oceans Canada as a certified provider of dockside monitoring services. 
    
    The supplier must comply with regulations governing designation, duties and certification of observers in accordance with the Fishery (General) Regulations, Section 39 and 40. 
    
    
    4. Applicability of the trade agreement(s) to the procurement 
    This procurement is subject to the following trade agreement 
    • Canadian Free Trade Agreement (CFTA)
    
    5. Justification for the Pre-Identified Supplier
    It is believed that there is no other company that 1) has the ability and resources to collaborate with DFO on an undertaking of this scale and scope throughout BC, and 2) possesses the necessary technical expertise in B.C. salmon fisheries, dockside monitoring, coded wire tag sampling, and coded wire tag lab operations to effectively deliver the requirements.
    
    6. Government Contracting Regulations Exception
    The following exception(s) to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work".
    
    7. Exclusions and/or Limited Tendering Reasons 
    This requirement falls under Services F030A- Fisheries Resources Management Services to which the North American Free Trade agreement (Chapter 10, Annex 1001.1b-2 Services) does not apply. 
    
    8. Ownership of Intellectual Property:
    The Department of Fisheries and Oceans has determined that any intellectual property arising from the performance of the Work under the contract will belong to Canada as the main purpose of the contract is to generate knowledge and information for public dissemination.
    
    9. Period of the proposed contract:
    The proposed contract is from the date of award to March 31, 2019 inclusive, with three one-year options.
    
    10. Cost estimate of the proposed contract
    The estimated value of the contract, including options, is $5,000,000 (GST/HST extra).

The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
    
    13. Closing date for a submission of a statement of capabilities
    The closing date and time for accepting statements of capabilities is September 4, 2018 at 2:00 p.m. PDT.

However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.

    The Crown retains the right to negotiate with suppliers on any procurement.
