Advance Contract Award Notice (ACAN). An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Definition of the requirement Environment Canada (EC) has a requirement for the supply and delivery of one hundred and eighty (180) Intigeo C-65 geolocator tags to study the migratory ecology of Rhinoceros Auklets in the north coast of British Columbia as part of the World Class Tanker Safety System Phase 1a Initiative. The geolocator tags will record near full-range ambient light with complementary conductivity indicators allowing location tracking and behavioral studies of tagged birds. 3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements) (a) The unit must weigh 1.5 g or less (Rhinoceros Auklets ~500 g) (b) The unit must be small and non-obtrusive, ideally shaped like a brick with dimensions not exceeding 14 x 8 x 6 mm (c) It must mount solidly for long-term (1+ year) attachment with a cable tie around a plastic leg band (d) The unit must have long battery life, ideally > 2 years from time of manufacture (e) The unit must record near full range ambient light levels, ideally once every ~5 minutes (f) The unit must record changes in conductivity as required. 4. Applicability of the trade agreement(s) to the procurement This procurement is subject to the following trade agreements: -Agreement on Internal Trade (AIT) 5. Justification for the Pre-Identified Supplier Following a competitive tender run by Public Works and Government Services Canada (PWGSC) on behalf of EC in December 2013, a contract was awarded to Migrate Technology for the supply and delivery of 395 Intigeo C-65 geolocator tags and 4 interface boxes with communication software. For this year's work, it is vital that the same tags be used so that the data can be directly comparable. Comparable data is critical to the program and the scientific method. Changing the tags would mean a significant change in methodology, which invalidates the interpretation of the results across years. The exact way the tags collect data, and the algorithms/software that translate the data into locations are specific to the hardware/software so can only be reliably compared using the same system. In addition, the tags themselves have impacts on the birds that carry them, so using different hardware could potentially impact the data indirectly. 6. Government Contracts Regulations Exception(s) The following exception(s) to the Government Contracts Regulations is (are) invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work". 7. Exclusions and/or Limited Tendering Reasons The following exclusion(s) and/or limited tendering reasons are invoked under the: Agreement on Internal Trade (AIT) - Article(s) 506.12(b) "where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particular supplier and no alternative or substitute exists"; Agreement on Internal Trade (AIT) - Article(s) 506.12(a) to ensure compatibility with existing products, to recognize exclusive rights, such as exclusive licences, copyright and patent rights, or to maintain specialized products that must be maintained by the manufacturer or its representative; 8. Ownership of Intellectual Property Canada intends to retain ownership of any Foreground Intellectual Property arising out of the proposed contract on the basis that the main purpose of the contract is to generate knowledge and information for public dissemination. 9. Period of the proposed contract or delivery date All geolocator tags must be received at Destination in Delta (British Columbia) Canada V4K 3N2 on or before March 31, 2015 (MANDATORY). Cost estimate of the proposed contract The estimated value of the contract is $31,000 to $34,000.(Applicable taxes included). 10. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
