Definition An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Requirement The Royal Canadian Mounted Police require 70 specialized video capture software devices for forensic application, with the option to purchase an additional 70 devices per year for two years. The devices are required for a round of courses offered by the RCMP Forensic Video Analysis Unit’s (FVAU) Video Conversion Support (VCS) program. The software’s capture process must adhere to the Nyquist-Shannon sampling theorem, simultaneously capture timestamp and the video when the timestamp is not permanently overlaid in the video, and be self-executing from the device itself, requiring no installation or Windows administrator rights. 3. Criteria for assessment of the Statement of Capabilities: Minimum Essential Requirements Any interested supplier must demonstrate by way of a statement of capabilities that its device meets the following requirements. The device must meet the following mandatory criteria: 3.1 adhere to the Nyquist-Shannon sampling theorem 3.2 simultaneously capture the timestamp and the video, when the timestamp is not permanently overlaid in the video 3.3 visually indicate whether the file is captured video or captured video and audio 3.4 be self-executing, requiring no installation or Windows administrator rights 3.5 be able to provide a detailed capture report 3.6 include batch processing for captured video files as well as captured video and audio files 3.7 include a protected secure storage partition, which resets and erases should the user not know the password 3.8 include an audio sync that assures that the audio remains indexed and in sync if the frame rate changes 3.9 have the ability to sample the videos’ playback rates and automatically set the capture sample rate, and have the ability to document that process 3.10 have user-defined preferences for multiple users 3.11 have the ability to export the video and time code as two separate streams 3.12 allow the user to choose of time code position when exporting a single file 4. Applicability of the trade agreement(s) to the procurement This procurement is subject to the following trade agreements: Agreement on Internal Trade (AIT) North American Free Trade Agreement (NAFTA) 5. Justification for the Pre-Identified Supplier The Omnivore Portable Digital Video Capture Tool is the only known device on the market that meets or exceeds the mandatory requirements. Ocean Systems is the sole manufacturer and distributer of the Omnivore Digital Video Field Acquisition Thumb Drive. 6. Government Contracts Regulations Exception The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6 (d) Only One Person or Entity Capable of Performing the Contract. 7. The period of the proposed contract or the delivery date Delivery March 31, 2017. 8. A cost estimate of the proposed contract The estimated value of the contract is $28,000.00 USD - $30,000.00 USD 9. Suppliers' right to submit a statement of capabilities Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN, may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 11. The closing date for a submission of a statement of capabilities. The closing date and time for accepting statements of capabilities is March 14, 2017 at 2:00 pm PDT. 12. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
