Trade Agreement: WTO-AGP/NAFTA/AIT/Canada FTAs with Peru/Colombia/Panama Tendering Procedures: All interested suppliers may submit a bid Competitive Procurement Strategy: Comprehensive Land Claim Agreement: No Nature of Requirements: Rental of Portable Heaters W168A-17KM25/A Maki, Christie Telephone No. - (204) 891-6126 Fax No. - (204) 983-7796 christie.maki@pwgsc.gc.ca The Department of National Defence (DND), 3 CDSG Tech Svcs Branch requires a contract for the provision of all labour, materials, tools, equipment, transportation, and supervision necessary for the rental and related servicing and maintenance of portable heaters. This equipment will be required to support Exercises Rugged Bear and Maple Resolve overthe time frame of 13 March 2017 until 9 June 2017. All portable heaters must be delivered to the Department of National Defence, Denwood, Alberta as per the schedule provided within this Statement of Work. The geographic area of coverage for delivery is defined as facilities located within Canadian Forces Base Wainwright plus a 50 Km radius of the Base. The requirement is subject to the provisions of the World Trade Organization Agreement on Government Procurement (WTO-AGP), the North American Free Trade Agreement (NAFTA), and the Agreement on Internal Trade (AIT). Due to urgency, the period for the receipt of tenders is 20 days using limited tendering procedures as outlined under NAFTA Article 1016 1. and 2. (c) and Article 1012 (c) and WTO-GPAArticle XV 1(a) and Article XI 3. (c) NAFTA Article 1016: Limited Tendering Procedures 1. An entity of a Party may, in the circumstances and subject to the conditions set out in paragraph 2, use limited tendering procedures and thus derogatefrom Articles 1008 through 1015, provided that such limited tendering procedures are not used with a view to avoiding maximum possible competition or in a manner that would constitute a means of discrimination between suppliers of the other Parties or protection of domestic suppliers. 2. An entity may use limited tendering procedures in the following circumstances and subject to the following conditions, as applicable: (c) in so far as is strictly necessary where, for reasons of extreme urgency brought about by events unforeseeable by the entity, the goods or services could not be obtained in time by means of open or selective tendering procedures; Article 1012: Time Limits for Tendering and Delivery 3. An entity may reduce the periods referred to in paragraph 2 in accordance with the following: (c) where a state of urgency duly substantiated by the entity renders impracticable the periods in question, the periods may be reduced to no less than 10 days from the date of publication of a notice in accordance with Article 1010. WTO-GPA Article XV: Limited Tendering 1. The provisions of Articles VII through XIV governing open and selective tendering procedures need not apply in the following conditions, provided that limited tendering is not used with a view to avoiding maximum possible competition or in a manner which would constitute a means of discrimination among suppliers of other Parties or protection to domestic producers or suppliers: (c) in so far as is strictly necessary when, for reasons of extreme urgency brought about by events unforeseeable by the entity, the products or services could not be obtained in time by means of open or selective tendering procedures; Article XI: Time-limits forTendering and Delivery 3. The periods referred to in paragraph 2 may be reduced in the circumstances set out below: (c) where a state of urgency duly substantiated by the entity renders impracticable the periods in question, the periodsspecified in paragraph 2 may be reduced but shall in no case be less than 10 days from the date of the publication referred to in paragraph 1 of Article IX; Delivery Date: Above-mentioned The Crown retains the right to negotiate with suppliers on any procurement.
