    1. Advance Contract Award Notice (ACAN): 
    
    An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities thatmeets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 
    
    
    2. Definition of the requirement:
    
    The Royal Canadian Police D Division in Winnipeg, Manitoba has a requirement for the supply and delivery of fifty (50) Stalker Radar DSR speed radar units. The units to be procured are intended as maintenance spares for Stalker Radar units that are currently in use in seventy-two (72) D Division traffic enforcement vehicles. There is currently no stock of maintenance spares. When one of the Stalker Radar units currently in use malfunctions, it must be removed from the police vehicle and shipped to the manufacturer to be repaired. Without a stock of spare units, the police vehicle will be without a speed radar until the malfunctioning unit is repaired and returned, or until the vehicle is retrofitted to allow for the installation of a competing manufacturer’s speed radar.
    
    3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements): 
    
    Any interested supplier must demonstrate by way of a statement of capabilities that its product meets the following requirements as specified in below. 
    
    MINIMUM MANDATORY PERFORMANCE SPECIFICATIONS:
    
    Requirement: Speed Radar Units

    1: Physical Specifications
    1.1: All components must be fully compatible with Stalker Radar speed radar units currently in use in RCMP D Division traffic enforcement vehicles.
    1.2: Complete radar unit must consist of display unit, counting unit, antennae and remote.
    1.3: Must utilize antennae Doppler radar.
    1.4: Must use conical horn-style antennae withcorrective lens.
    1.5: Must use direct conversion homodyne receivers.
    1.6: Must have a 3-digit LED display.
    1.7: Must have a serial port for interfacing with electronic equipment including computers, video cameras and printers.
    1.8: Display unit mustmeasure no more than 1.65” x 1.05” x 5.05” (h x d x w) and weight no more than 0.5 lbs.
    1.9: Counting unit must measure no more than 1.65” x 3.90” x 5.05” (h x d x w) and weight no more than 1.4 lbs.
    1.10: Each antenna must measure no more than 2.5” x4.75” (dia. x length) and weight no more than 0.5 lbs.
    
    2: Performance Specifications
    2.1: Must have an operating frequency range of 33.4-36.0 GHz (Ka-Band).
    2.2 :Must have a stability of ±100 MHz (Ka-Band).
    2.3: Antennae must utilize a digital signal to communicate with the counting unit.
    2.4: Must be accurate within ±3 km/h whether stationary or moving.
    2.5: Must be capable of capturing the speed of target vehicles moving at speeds between 20-320 km/h when stationary.
    2.6: Must be capable to tracking at least two target vehicles at the same time.
    2.7: Must be capable of indicating which direction the target vehicle is travelling. 
    2.7: Must be capable of using voice verification to indicate the antenna in use, the mode of operation and thedirection the target vehicle is travelling.
    2.8: Must perform an automatic self-test. Self-tests must be performed every 10 seconds or less.
    
    
    4. Applicability of the trade agreement(s) to the procurement: 
    
    This procurement is subject to the following trade agreements:
    
    • Agreement on Internal Trade (AIT)
    • North American Free Trade Agreement (NAFTA)
    
    
    5. Justification for the Pre-Identified Supplier:
    
    Mega-Tech has been pre-identified as the supplier as it is the only distributor of Stalker Radar speed radars in Canada. The 50 Stalker Radar speed radar units to be procured are intended as maintenance spares for 72 Stalker Radar units currently in use by D Division. These 72 units are being employed in RCMP traffic enforcement vehicles,and should a unit malfunction, it must be removed from the vehicle and shipped to the manufacturer for repair. With Stalker Radar units as spares, one can quickly be swapped in for a malfunctioning unit. A competing manufacturer’s speed radar cannot be used as a spare, as the vehicles are hard-wired for the Stalker Radar units, and Stalker Radar units are incompatible with other manufacturers’ products. Therefore, should D Division not have Stalker Radar units as spares, a vehicle with a malfunctioningspeed radar would be without radar until the vehicle could be retrofitted to allow for the install of another manufacturer’s radar unit.
    
    
    6. Government Contracts Regulations Exception(s): 
    
    The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6 (d) - “only one person is capable of performing the work.” 
    
    
    7. Exclusions and/or Limited Tendering Reasons:
     
    The following exclusion(s) and/or limited tendering reasons are invoked under the:
     
    • Agreement on Internal Trade (AIT) - Article 506 - 12 (b) where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particular supplier and no alternative or substitute exist.
    • North American Free Trade Agreement (NAFTA) - Article 1016 - 2(b) where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists.

    The equipment must be delivered on November 1, 2016.
    
    
    9. Cost estimate of the proposed contract:
    
    The estimated value of the contract, including option(s), is $115,500.00 (GST/HST extra).
