    Definition of requirement
    The Department of Fisheries and Oceans (DFO), St. John's, NL has
    a requirement for the provision of services as specified under
    "Background" below. The purpose of this Advance Contract Award
    Notice (ACAN) is to signal the government's intention to award a
    contract for these services to Fishermen Food & Allied Workers
    Union (FFAW), St. John's, NL.  Before awarding a contract,
    however, the government would like to provide other suppliers
    with the opportunity to demonstrate that they are capable of
    satisfying the requirements set out in this Notice, by
    submitting a statement of capabilities during the 15 calendar
    day posting period.  If no supplier submits a statement of
    capabilities that meets the requirements set out in the ACAN, on
    or before the closing date stated in the ACAN, the contracting
    officer may then proceed with the award to the pre-identified
    supplier.
    
    
    Background
    Post-season Snow Crab Survey and Lobster Monitoring Projects.
    Several collaborative projects were originally funded by sale of
    fish revenue or additional quotas of fish to the harvesters
    participating in projects. As a result of a Federal Court of
    Canada decision in June 2006 (the Larocque decision), the
    Department of Fisheries and Oceans (DFO) is no longer permitted
    to fund research in this way. Since the projects are essential
    in providing data to the stock assessment process for a number
    of species,  Public Works and Government Services Canada on
    behalf of The Department of Fisheries and Oceans (DFO), St.
    John's, Newfoundland intends to award a contract for the
    Post-season Snow Crab Survey and Lobster Monitoring Projects.  
    
    Criteria for assessment of the Statement of Capabilities
    Minimum Essential Requirements
    
    Mandatory Technical Criteria 
    
    To maintain the integrity of the data series, the bidder must
    have access to a large number of survey/project platforms over a
    wide geographic range (2J3KLPs4R3Pn).
    
    Point Rated Technical Criteria
    
    Technical Proposal (40 points)	
    Understanding of the scope and objectives of the LaRocque Post
    Season Snow Crab and Lobster monitoring projects including
    survey design and application of survey results to the
    assessment process.	10
    Proposed approach and methodology including organizational
    ability to mobilize and oversee a large number of survey vessels
    (commercial vessels) over a wide geographic range (NAFO DIVs
    2J3KLPs4R3Pn) and from all fleet sectors.	10
    Adequacy of work plan and schedule with intent and ability to
    maintain integrity of data series with respect to ensuring
    continuity in survey timing and geographic location as well as
    survey and project design.	10
    Recognition of direct as well as peripheral problems and
    solutions offered.	10
    
    Managerial (30 Points)	
    Project Manager with relevant experience including knowledge and
    background in the stock assesment process.	10

    Justification for the Pre-Identified Supplier 
    
    The  Fishermen Food & Allied Workers Union (FFAW) is the only
    known organization capable of successfully completing this work,
    these research projects are unique to the fisheries research
    program which has been developed  by the Science Branch of the
    Department of Fisheries and Oceans and administered by the FFAW
    over the last fifteen years. No other organization is known to
    possess the fisheries infrastructure, experience or working
    knowledge to deliver the project in these North West Atlantic
    Fisheries Organization (NAFO) Divisions of Newfoundland and
    Labrador.
    
    Government Contracts Regulations Exception:
    
    The following exception to the Government Contracts Regulations
    is invoked for this procurement under subsection 6(d) - only one
    person is capable of performing the work.
    
    Exclusions and/or Limited Tendering Reasons 
    The following exclusion(s) and/or limited tendering reasons are
    invoked under the section of the trade agreement(s) specified:
    Agreement on Internal Trade (AIT)  Article 506 12. a):
    -  to ensure compatibility with existing products, to recognize
    exclusive rights, such as exclusive licences, copyright and
    patent rights, or to maintain specialized products that must be
    maintained by the manufacturer or its representative.
    
    Ownership of Intellectual Property.
    
    Canada intends to retain ownership of any Foreground
    Intellectual Property arising from the performance of the Work
    under the proposed contract on the basis that the main purpose
    of the contract, or of the deliverables contracted for, is to
    generate knowledge and information for public dissemination.

    The proposed contract is from July 1, 2012 to March 31, 2013

    before the closing date of this notice. The statement of
    capabilities must clearly demonstrate how the supplier meets the
    advertised requirements.

    with one firm only as identified above. Should you have any

    An Advance Contract Award Notice (ACAN) allows departments and
    agencies to post a notice, for no less than fifteen (15)
    calendar days, indicating to the supplier community that it
    intends to award a good, service or construction contract to a
    pre-identified contractor. If no other supplier submits, on or
    before the closing date, a Statement of Capabilities that meets
    the requirements set out in the ACAN, the contracting authority
    may then proceed with the award.  However, should a Statement of
    Capabilities be found to meet the requirements set out in the
    ACAN, then the contracting authority will proceed to a full
    tendering process.
    
    Suppliers who consider themselves fully qualified and available
    to provide the services/goods described herein, may submit a
    statement of capabilities in writing to the contact person
    identified in this Notice on or before the closing date of this
    Notice. The statement of capabilities must clearly demonstrate
    how the supplier meets the advertised requirements.
    
    The PWGSC file number, the contracting officer's name and the
    closing date of the ACAN must appear on the outside of the
    envelope in block letters or, in the case of a facsimile
    transmission, on the covering page.
    
    The Crown retains the right to negotiate with suppliers on any
    procurement.
