Advance Contract Award Notice (ACAN) An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing othersuppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Definition of the Requirement The Canadian Coast Guard of the Department of Fisheries and Oceans is seeking to replace the launch and recovery davit for the Zodiac 753 ridged hull inflatable boat fitted to the CCGS JP Tully. The CCGS Tully is a science vessel that completes inshore science programs, offshore science programs and search and rescue programs. The 753 boat is utilized for multiple duties which include tending science equipment and support of search and rescue activities. The 753 boat is also called upon to transport injured persons on stretchers and offer fast response to medical emergencies when performing search and rescue activities. It is critical that the 753 boat be capable of being launched in severe sea conditions with a minimal launching crew. The Canadian Coast Guard has a requirement for the supply of one complete davit capable of launching and recovering the existing Zodiac 753 fast rescue boat from the boat deck of the CCGS Tully. The Canadian Coast Guard requires one complete Harding NPDS 6000H High Speed Davit with the boat steading features (or equivalent). The davit must have a system to steady the 753 boat when it is being launched, loaded, and unloaded at the ship's side. The 753 boat is fitted on the upper boat deck and the vessel movement is magnified due to the height from the waterline. The Canadian Coast Guard requires a davit that is high speed to reduce launch and recovery times of the rescue craft in heavy seas and that the davit is fitted with a system that captures the 753 boat to prevent it from swinging caused by the motion of the ship. All of the davit's major components must be mounted inside the davit itself tobetter withstand the environmental conditions the davit will be exposed to on a regular basis. 3. Criteria for Assessment of the Statement of Capabilities (Minimum Essential Requirements) Any interested supplier must demonstrate by way of a statement of capabilities that its product meets the following requirements: (a) The davit must be suitable for its intended application: Launching and recovering Zodiac 753 Fast Rescue boats from the boat deck of the CCGS Tully; (b) The davit must be a cradle-style davit fitted with a system that prevents the 753 boat being recovered from swinging caused by the motion of the ship; (c) The davit must have a system to steady the 753 boat when it is being launched, loaded, and unloaded at the ship's side; (d) All major components of the davit must be mounted inside the davit itself (i.e. a totally enclosed davit); (e) The davit must provide single point hoisting; (f) Hoisting / lowering must be executed hydraulically with a manual hoisting backup in the event of a hydraulic failure; (g) The safe working load of the davit must be a minimum of 6000 kilograms; (h) The davit must hoist and lower at multiple speeds (i.e. at least one high speed and one low speed for safer operation); (i) The davit including its hydraulic system must fit within the following available deck space while also storing the 753 boat: Maximum Width: 13 feet; Maximum Length: 27 feet; Maximum Height: 18 feet; (j) The davit must operate in the following temperature range at a minimum: -20 degrees Celsius to +50 degrees Celsius; (j) The davit must be certified in accordance with International Maritime Organization / Safety of Life at Sea (IMO/SOLAS) requirements; (k) The davit must provide active heave compensation and shock absorption; and (l) The davit must come with an anti-twisting hoisting cable. 4. Applicability of the Trade Agreements to the Procurement This procurement is subject to the following trade agreements: - Agreement on Internal Trade (AIT) - World Trade Organization - Agreement on Government Procurement (WTO-AGP) - North American Free Trade Agreement (NAFTA). 5. Justification for the Pre-Identified Supplier Harding Safety Canada Inc. offers a product that meets the Canadian Coast Guard's requirements. To the knowledge of the Canadian Coast Guard, Harding Safety Canada Inc. is the only company able to provide the required goods. 6. Government Contracts Regulations Exception The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d): Only one person or firm is capable of performing the work. 7. Exclusions and/or Limited Tendering Reasons The following exclusions and/or limited tendering reasons are invoked under the section of the trade agreements specified: - Agreement on Internal Trade (AIT) - Article 506.12.b; - North American Free Trade Agreement (NAFTA) - Chapter Ten, Article 1016.2.b; - World Trade Organization - Agreement on Government Procurement (WTO-AGP) - Article XV.1.b. 8. Proposed Delivery Date The goods must be delivered no later than February 28, 2017. 9. Suppliers' Right to Submit a Statement of Capabilities Suppliers who consider themselves fully qualified and available to provide the goods, services or construction servicesdescribed in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 11. Closing Date for a Submission of a Statement of Capabilities The closing date and time for accepting statements of capabilities is August 3, 2016 at 02:00 pm (PDT). 12. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
