    1. DESCRIPTION OF REQUIREMENT
    
    The Administrative Tribunal Support Service of Canada’s (ATSSC) Business Units require translation and revision services on an as and when requested basis for translation and revision of documents that are administrative and/or legal in nature. The translation and revision services could be either from Canadian French to Canadian English and from Canadian English to Canadian French. 
    
    This requirement has been estimated to be 2,778,000 words for translation services and 213,000 words for comparative bilingual revision services per year. Please refer to Attachment 1 to Part 3 and Annex A - Statement of Work for further details. 
    
    It is intended to result in the award of up to three (3) contracts each for one (1) year.  
    
    The first (1st) ranked Contractor will be awarded one (1) translation contract for the Federal Public Sector Labour Relations and Employment Board (FPSLREB), the National Joint Council (NJC) and the Canadian Human Rights Tribunal (CHRT) for an estimated total of 1,757,000 words.
    
    The second (2nd) ranked Contractor will be awarded one (1) contract combining translation services for the Public Servants Disclosure Protection Tribunal (PSDPT) and the Social Security Tribunal (SST) for an estimated total of 554,000 words and comparative bilingual revision services for FPSLREB/NJC and CHRT for an estimated total of 213,000 words.
    
    The third (3rd) ranked Contractor will be awarded one (1) translation contract for the Secretariat of the Canadian International Trade Tribunal (CITT) for an estimated total of 467,000 words.
    
    If only two (2) Contractors are qualified under this Request for proposal (RFP) process, the CITT translation requirement (467,000 estimated words) will be performed by the 2nd ranked contractor for an estimated total of 1,021,000 words for translation and 213,000 words for revision. 
    
    If only one (1) Contractor is qualified, that Contractor will perform translation for all ATSSC’s Business Units for an estimated total of 2,778,000 words. Comparative bilingual services (213,000 estimated words) will then be acquired by other means.
    
    The volumetric data has been provided to Bidders to assist them in preparing their bids. The inclusion of this data in this bid solicitation does not represent a commitment by Canada that Canada’s future usage of the service identified in this bid solicitation will be consistent with this data. It is provided purely for information purposes.
    
    This procurement is limited to Canadian services.
    
    This procurement is subject to the Canadian Free Trade Agreement (CFTA).
    
    This procurement is not subject to the Comprehensive Land Claims Agreements (CLCA). 
    
    2. PERIOD OF THE CONTRACT 
    
    The term of any resulting Contract will be one (1) year from the date of contract award plus five (5) one-year irrevocable options allowing Canada to extend the term of the contract(s). There is also a three (3) months transition period from the Contract to a new contract with another supplier.
    
    3. SECURITY REQUIREMENT

    4. EVALUATION PROCEDURES
    
    (a) Offers will be assessed in accordance with the entire requirement of the bid including the technical evaluation criteria.  
    
    (b) An evaluation team composed of representatives of Canada will evaluate the offers.
    
    5. BASIS OF SELECTION - Highest Combined Rating of Technical Merit (70% and Price (30%)
    
    To be declared responsive, a bid must: 
    
    (a) comply with all the requirements of the bid solicitation; and
    (b) meet all mandatory evaluation criteria; and
    (c) obtain the required minimum number of points specified in Attachment 1 to Part 4 for the point rated technical criteria.   
    
    Bids not meeting (a) or (b) or (c) will be declared non-responsive. 
    
    6. BASIS FOR CANADA'S OWNERSHIP OF INTELLECTUAL PROPERTY
    
    Canada has determined that any intellectual property rights arising from the performance of the Work under the resulting contract will belong to Canada, for the following reasons, as set out in the Policy on Title to Intellectual Property Arising Under Crown Procurement Contracts: «The Intellectual Property in Foreground Information consists of material subject to copyright, with the exception of computer software and all documentation pertaining to that software».
