The work will be provided on a "when requested" basis and authorized through the use of call-ups issued by Identified Users. At most, two (2) single Standing Offers may be established following this Request for Standing Offers: Group Training Standing Offer Individual Training Standing Offer Offerors may submit offers for one or both Standing Offers. However, to allow for the awarding of the two (2) standing offers to two (2) distinct contractors, the Offeror recommended for issuance of the Group Training Standing Offer will be withdrawn from the evaluation process for the Individual Training Standing Offer. A list of the Identified Users located in downtown Gatineau can be found in Part 7A - Standing offer, article 6 of the Request for Standing Offer EN578-112154/A. The boundaries of downtown Gatineau are listed in Annex A - Statement of Work, 4.0 Training Site, of the Request for Standing Offer EN578-112154/A. For the Group Training Standing Offer: In sixty percent (60%) of cases, the contractor must provide the premises for the group training in downtown Gatineau. For the Individual Training Standing Offer: All premises will be provided by the Identified Users in downtown Gatineau. Based on last year volumes, the estimated number of participants for language training per session is as follows: Group Training Standing Offer Group training in French: 455 participants per session Group training in English: 111 participants per session Each training group comprises 4 to 10 participants. The contractor may train groups of three (3) or fewer participants at its discretion. Individual Training Standing Offer Individual training in French: 162 participants per session Individual training in English: 99 participants per session The number of participants specified herein is only an approximation of requirements. This requirement is subject to the provisions of the North American Free Trade Agreement (NAFTA) and the Agreement on Internal Trade (AIT). PERIOD OF THE STANDING OFFERS The period for issuing call-ups against the Standing Offers will be two (2) years from the date of issuance of the SOs. Canada reserves the right to extend the Standing Offer period up to a maximum of two (2) additional periods of one (1) year each. SECURITY REQUIREMENT 1. The Contractor must, at all times during the performance of the Contract, hold a valid Designated Organization Screening (DOS), issued by the Canadian Industrial Security Directorate (CISD), Public Works and Government Services Canada (PWGSC). 2 The Contractor personnel requiring access to sensitive work site(s) must EACH hold a valid RELIABILITY STATUS, granted or approved by CISD/PWGSC. 3 Subcontracts which contain security requirements are NOT to be awarded without the prior written permission of CISD/PWGSC. 4 The Contractor must comply with the provisions of the: Security Requirements Check List and security guide (if applicable), attached at Annex "D" of the Request for Standing Offer EN578-112154/A; Industrial Security Manual (Latest Edition). EVALUATION PROCEDURES (a) Offers will be assessed in accordance with the entire requirement of the Request for Standing Offers including the technical and financial evaluation criteria. (b) An evaluation team composed of representatives of Canada will evaluate the offers. MANDATORY TECHNICAL CRITERIA (MTC) Offers for the Group Training Standing Offer must satisfy all mandatory technical criteria indicated in Attachment 1 of Part 4, Article 1 of the Request for Standing Offer EN578-112154/A. Offers for the Individual Training Standing Offer must satisfy all mandatory technical criteria indicated in Attachment 2 of Part 4, Article 1 of the Request for Standing Offer EN578-112154/A. The Offeror must provide the necessary documentation to demonstrate that it complies with the requirements. Offers not meeting all of the mandatory technical criteria will be declared non-responsive. Each mandatory technical criterion should be treated separately. POINT RATED TECHNICAL CRITERIA (PRTC) For point rated technical criteria for the Group Training Standing Offer, see Attachment 1 of Part 4, Article 2 of the Request for Standing Offer EN578-112154/A. For point rated technical criteria for the Individual Training Standing Offer, see Attachment 2 of Part 4, Article 2 of the Request for Standing Offer EN578-112154/A. A zero rating will be assigned to rated evaluation criteria that have not been covered. BASIS OF SELECTION It will be recommended that no more than two (2) Standing Offers be awarded within the scope of this request, i.e. the Group Training Standing Offer and the Individual Training Standing Offer. 1 To be considered responsive, an offer must: a) comply with all the requirements of the Request for Standing Offers; b) meet all mandatory technical evaluation criteria; and c) obtain the required minimum of 36 points for the point rated technical criteria, which are subject to point rating. For an overview of the maximum number of points and the minimum number of points required, see Attachment 1 of Part 4, Article 2 for the Group Training Standing Offer, or see Attachment 2 of Part 4, Article 2 for the Individual Training Standing Offer of the Request for Standing Offer EN578-112154/A. 2 Offers not meeting a) or b) or c) above will be declared non-responsive. Neither the responsive offer that receives the highest number of points nor the one that proposed the lowest price will necessarily be accepted. 3 The evaluated price per point of a responsive offer will be determined by dividing the total evaluated price for the entire period of the Standing Offer including the periods of extension by the total rating obtained for all point rated technical criteria. 4 The responsive offer to the Group Training Standing Offer with the lowest evaluated price per point will be recommended for the issuance of the Group Training Standing Offer as described in Annex "A" Statement of Work of the Request for Standing Offer EN578-112154/A. In the event two or more responsive offers have the same lowest evaluated price per point, these offers will be ranked in ascending order of total evaluated price for the entire period of the Standing Offer including the periods of extension. The responsive offer with the lowest total evaluated price for the entire period of the Standing Offer including the periods of extension will be recommended for the issuance of a Standing Offer. 5 The responsive offer to the Individual Training Standing Offer with the lowest evaluated price per point will be recommended for the issuance of the Individual Training Standing Offer as described in Annex "A" Statement of Work of the Request for Standing Offer EN578-112154/A. In the event two or more responsive offers have the same lowest evaluated price per point, these offers will be ranked in ascending order of total evaluated price for the entire period of the Standing Offer including the periods of extension. The responsive offer with the lowest total evaluated price for the entire period of the Standing Offer including the periods of extension will be recommended for the issuance of a Standing Offer. 6 If the offer is submitted by a joint venture, the overall experience of the members of this joint venture will be considered in the evaluation of the Offeror's experience. 7 The Offeror must submit a complete and separate offer for each Standing Offer, i.e. for the Group Training Standing Offer and/or for the Individual Training Standing Offer in which it wishes to be evaluated. It may submit an offer for both standing offers. However, to allow for the awarding of the two (2) standing offers to two (2) distinct contractors, the Offeror recommended for issuance of the Group Training Standing Offer will be withdrawn from the evaluation process for the Individual Training Standing Offer. BASIS FOR CANADA'S OWNERSHIP OF INTELLECTUAL PROPERTY Canada has determined that any intellectual property rights arising from the performance of the Work under the resulting contract will belong to Canada, on the following grounds: where the material developed or produced consists of material subject to copyright, with the exception of computer software and all documentation pertaining to that software.
