    PROJECT TITLE: Access to Information and Privacy Services
         
    BACKGROUND 
    
    PWGSC would like to establish a National Individual Standing Offer (NISO) for the provision of Access to Information and Privacy Services to satisfy the requirements of Identified Users on an "as and when requested" basis. It is anticipated to authorize multiple Standing Offers (SO).  
    
    CBSA ATIP requests include files varying in complexity from employee to invest
    
    igation files, to highly sensitive requests for corporate documents 
    such as briefing notes, audits and intelligence reports.  Requests may also include security certificate cases that have national security implications.  CBSA ATIP requests primarily deal with records relating to the administration and enforcement of the Customs Act and the Immigration and Refugee Protection Act.
    
    The Contractor must have experience in the processing of access to information and privacy requests within the federal government. The Contractor must have knowledge and experience with the Access to Information Act, the Privacy Act and associated Treasury Board Secretariat (TBS) policies, directives, and guidelines on Access to Information and Privacy. 
    
    OBJECTIVE
    
    The Canada Border Services Agency (CBSA), Access to Information and Privacy (ATIP) Division, requires the services of consultants with varying levels of expertise to augment its existing resources to assist with 
    
    
    
    the processing of access and privacy requests, as well as to develop 
    and deliver A TI and Privacy related training to departmental 
    personnel.
    
    The following two (2) work streams are proposed.
    
    Work Streams have been divided as follow, so that potential Offerors 
    can bid on the work stream or streams in which they are able to provide
    
    
    services and they can propose up to a maximum of three (3) resources 
    per category.  
    
    1. Senior ATIP Consultant
    2. Advanced ATIP Consultant
    
    PERIOD OF CONTRACT
    
    The proposed period of the SO will be for a four (4) year period commencing from dateofissuance of the SO with an irrevocable option to
    extend the period of the proposed SO by up to three (3) additional one 
    (1) year periods.
    
    SECURITY REQUIREMENT
    
    During the period of the SOs, it is proposed that Offerors offering servicesat federal institutions’ facilities (CBSA) must hold the security clearances listed below.
    
    For more information on personnel and organization security screening or
    
    
    
    
    security clauses, offerors should refer to the Industrial Security Program (ISP)of Public Works and Government Services Canada (http://ssi-iss.tpsgc-pwgsc.gc.ca/index-eng.html) website.  Questions about the security clearance process must be addressed to the CISD through the Web site.
     
    1.  The Contractor/Offeror must, at all times during the performance of the C
    
    ontract/Standing Offer, hold a valid Facility Security Clearance at the 
    
    level of SECRET, issued by the Canadian Industrial Security Directorate 
    
    
    
    (CISD), Public Works and Government Services Canada (PWGSC).
    
    2.  The Contractor/Offeror personnel requiring access to CLASSIFIED information, assets or sensitive work site(s) must EACH hold a valid personnel security screening at the level of SECRET, granted or a
    pproved by CISD/PWGSC.
    
    3.  The Contractor/Offeror MUST NOT remove any CLASSIFIED information from the identified work site(s), and the Contractor/Offeror must en
    sure that its personnel are made aware of and comply with this restriction. 
    
    4.  Subcontracts which contain security requirementsare NOT to be awarded without the prior written permission of CISD/PWGSC.
    
    5.  The Contractor/Offeror must comply with the provisions of the:
    
     (a)  Security Requirements Check List and security guide (if    
          applicable), attached at Annex D;
     (b) Industrial Security Manual (Latest Edition).
    
    All suppliers interested in submitting an offer are encouraged to initiate the security screening process by contacting the Contracting Authority and requesting sponsorship.
    
    CBSA Security Requirements
    
    CBSA SECURITY REQUIREMENT: The CBSA will conduct the Reliability Status 
    
    
    assessment on the proposed Contractor and its personnel on behalf of PWGSC as per the Treasury Board Secretariat of Canada’s (TBS) "Security an
    
    d Contracting Management Standard"and the Policy on Government 
    Security - Personnel Security Standard, irrespective of whether such assessment has already been conducted under any such policies. The Reliability Status assessment conducted by the CBSA will include a credit checkperformed by an authorized security official with the CBSA’s
    
     "Personnel Security Screening Section" (PSSS), which is independent of 
    
    the Public Works and Government Services Canada’s (PWGSC), "Canadian Industrial Security Directorate" (CISD) and the "International Industrial Security Directorate" (IISD). 
    
    For each proposed resource, the bidder must submit a completed signed original TBS 330-23 Form - Personnel Screening Consent and Auth
    orization 
    (http://www.tbs-sct.gc.ca/tbsf-fsct/330-23-eng.pdf) upon request of the 
    
    
    Contracting Authority prior to Contract Award.
    
    Until the credit check and all other security screening processes required by this Request for Proposal have been completed and the Contractor and its personnel is considered suitable by theCBSA, no contract will be awarded and the recommended Contractor / Offeror (specifically the Contractor / Offeror personnel) shall not be permitte
    d access to Protected / Classified information or assets, and further, shall not be permitted to enter sites where such information or assets are kept. 
    
    ** Contractor and its personnel can include in some instances 
    landlords, property management employees and principles of companies when the latter have access to the premises where the CBSA designated orclassified information\assets are kept.
    
    MANDATORY CRITERIA
    
    Contractor Resource Requirements:
    
    The following defines the minimum mandatory qualifications of each of the required resource categories.
    
    Resource Category
    
    Senior ATIP Consultant:
    
    1 The Offeror must demonstrate that the proposed resource has a minimum 
    
    
    of five years’ experience processing requests under the Access to Information Act and the Privacy Act within the last seven years.
    
    2 The Offerormust provide two Client Project references that demonstrate the proposed resource has worked on projects as a Senior ATIP consultant. These references must:
    
    i. Be from two different projects;
    
    ii. Have included the analysis, review and response preparation for sensitive requests and complaints under the Access to Information Act and the Privacy Act;
    
    iii. Have been completed within the last 5 years.
    
    3 The Offeror must demonstrate that the proposed resource has a minimum 
    
    
    of two (2) years’ experience delivering training related to the release 
    
    
    of records in response to requests under the Access to Information Act and the Privacy Act.
    
    Advanced ATIP Consultant:
    
    1 The Offeror must demonstrate that the proposed resource has a minimum 
    
    
    of 10 years’ experience processing requests under the Access to Information Act and the Privacy Act within the last 15 years;
    
    2 The Offeror must provide two Client Project references that demonstrate that the proposed resource has worked on projects as an Advanced ATIP consultant. These references must:
    
    i.   Be from two different projects;
    
    ii.  Have included performing analysis, review and response preparation 
    
    
    for complex and sensitive requests and complaints under the Access toInformation Act and the Privacy Act;
    
    iii.Have been completed within the last five years.
    
    3 The Offeror must demonstrate that the proposed resource has a minimum 
    
    
    of three (3) years of experience developing and delivering training related to the releaseof records in response torequests under the Ac
    cess to Information Act and the Privacy Act.
    
    BASIS OF SELECTION  
    
    PWGSC will issue multiple number of SOs to Offerors offering the best value for money.  Technical quality (Annex C) will be evaluated, in large part, on the basis of the experience of the resources proposed for 
    
    
    each work streams.  A combination of mandatory and rated criteria will be used.  PWGSC intends to use a selection method based on the "highest co
    
    mbined rating of technical merit and price" (60% Technical and 40% 
    Price) for requirements covered by SOs.
