    1.  DEFINITION OF REQUIREMENTS:
    
    Public Works and Government Services Canada on behalf of the Crown as a whole intends to solicit a bid and negotiate with CEB Inc. to renew the National Master Standing Offer for proprietary information technology research subscriptions, advice, analysis and applied research services related to their products on anas and when requested basis to Canadian government departments, corporations and agencies. 
    
    The call-up limitation is $100,000 including GST/HST as applicable. Requirements exceeding $100,000 will be sent to PWGSC for processing and approval. 
    
    Products and services offered will consist of proprietary online subscriptions for IT research and advisory services via the internet.  
    
    If other potential suppliers submit statements of capabilities during the fifteen calendar day posting period that meet the requirements set out in the ACAN, the government will proceed to a full tendering process on either the government's electronic tendering service or through traditional means, in order to issue the National Master Standing Offer.
    
    If no other supplier submits, on or before the closing date, a statement of capabilities meeting the requirements set out in the ACAN, a National Master Standing Offer will be issued to the pre-selected supplier.
    
    Suppliers who consider themselves fully qualified and available to meet the specified requirements may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
    
    
    2.  TRADE AGREEMENTS:
    
    This requirement is subject to limited tendering procedures in accordance with AIT, Article 506 12(a) exclusive rights; in accordance with WTO, Article XV.1(b), exclusive rights; in 
    accordance with CPFTA, Article 1409(1)(b)(ii), exclusive rights and excluded from NAFTA under classification D317, Automated News Services, Data Services, or Other Information Services and excluded from CCFTA under article O-07(a) publication, distribution, or sale of books, magazines, periodicals or newspapers in print or machine readable form.  This requirement is not subject to CLCA because no procurement is conducted in the area of land claims.
    
    
    3.  SOLE SOURCE JUSTIFICATION:
    
    The proposedContractor is the sole owner of the CEB proprietary retainer subscriptions for research and advisory services, structured CEB programs and additional services in support of these products and the only authorized agent to sell their subscription in Canada.

    4.  INTELLECTUAL PROPERTY
    
    There is no Intellectual Property. 
    
    
    5.  PROPOSED NATIONAL MASTER STANDING OFFER PERIOD:
    
    March 26, 2017 to March 31, 2020.

    An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award.  However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.
    
    Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
