ADVANCE CONTRACT AWARD NOTICE
- Advance Contract Award Notice (ACAN)
An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities.
If no other supplier submits, on or before the closing date, a statement of capabilities that meets the requirements set out in the ACAN, the competitive requirements of the government’s contracting policy have been met.
Following notification to suppliers not successful in demonstrating that their statement of capabilities meets the requirements set out in the ACAN, the contract may then be awarded using the Treasury Board electronic bidding authorities.
If other potential suppliers submit statements of capabilities during the fifteen calendar days posting period, and meet the requirements set out in the ACAN, the department or agency must proceed to a full tendering process on either the government’s electronic tendering service or through traditional means, in order to award the contract.
- Definition of Requirements
Transport Canada intends to award a contract to the Commercial Vehicle Safety Alliance (CVSA) to host and maintain the website that is home of the North American Fatigue Management Program (https://nafmp.org/) and to promote and increase the use of the program within the motor carrier industry.
The key requirements for this contract are: hosting and maintaining the interactive website of the NAFMP, entertaining user’s requests, addressing technical issues, providing comprehensive quarterly website usage data to the Steering Committee (SC), conducting widespread outreach activities to promote the use of the NAFMP to the enforcement community, motor carrier companies and their drivers, industry associations and government stakeholders, survey NAFMP users to assess their acceptance and preferences of the program, provide the SC with options for improvement and implement selected changes.
- Criteria for Assessment of the Statement of Capabilities
Transport Canada requires a contractor with the following qualifications and experience:
- Members include over 10,000 certified enforcement officials and more than 500 motor carrier companies and motor carrier industry associations;
- Has a mature and well-established method for providing outreach and education to the motor carrier industry, the enforcement community and government stakeholders. It offers online training courses through its learning management system platform. All these elements are crucial to the successful hosting of the NAFMP website and its promotion;
- Ability to promote and increase the usage of the NAFMP through its commercial vehicle enforcement activities and engagement with bus and truck industry stakeholders. These include magazines, workshops, meetings, webinars and events, the issuances of press releases to the trade press, participation by representatives on trucker radio channels on Sirius FM and at other media events, emails and newsletters sent to its tens of thousands of members, issuance of a brochure to be given by its member inspectors to commercial vehicle drivers during roadside driver and vehicle inspections, selecting the NAFMP as a focus area for the International Roadcheck and Operation Safe Driver, or the North American Inspectors Challenge, etc.

- Justification for Pre-Identified Supplier
The Department is publishing the Advance Notice of Contract Award Notice due to the absence of competition for technical reasons. The main reason being that the NAFMP is co-managed with the United States and that the United States have already executed a 5-year contract with CVSA in September 2021. Transport Canada nonetheless agrees with the United States that there are no other organizations, similar to CVSA, that could also be in a position to successfully carry out all the requirements for this contract.

The proposed contract period will be from March 10, 2022, to March 31, 2027.

The estimated maximum value of the proposed contract is $586,000.00 CAD including applicable taxes.

- Suppliers’ Right to Submit a Statement of Capabilities
Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a Statement of Capabilities in writing, preferably by e-mail, to the contact person identified in this Notice on or before the closing date and time of this Notice. The Statement of Capabilities must clearly demonstrate how the supplier meets the advertised requirements.
Responses received on or before the closing date will be considered solely for the purpose of deciding whether or not to conduct a competitive procurement. Information provided will be used by the Crown for technical evaluation purposes only and is not to be construed as a competitive solicitation. Your written response must provide sufficient evidence (e.g. specifications, technical data, drawings, or any other proof) that clearly demonstrates that your product or service is capable of fulfilling this requirement.
Suppliers that have submitted a response will be notified in writing of TC’s decision to continue with the non-competitive procurement or to compete for the requirement
