Advance Contract Award Notice (ACAN) An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Requirement Public Works and Government Services Canada (PWGSC) on behalf of its client, Environment Canada, intends to enter into a Contract with Isospark Canada Ltd. for the supply, delivery, installation, and training of the specified Isotopic Water Analyzer: LGR Isotopic Water Analyzer - Model IWA-35EP. The instrument will be used in combination with the existing equipment for the ongoing studies related to animal physiology in addition to routine water sampling. The specified water liquid/vapour isotope analyzer is for the stable isotopic analysis of both liquid water and water vapour. The device is for use in current support of animal physiology studies using breath water vapour and will also be used for routine liquid water sampling. As such, the identified flow rates and pump down between samples is critical. 3. Criteria for assessment of the Statement of Capabilities Suppliers who consider themselves fully qualified and available to provide the goods, services, or construction services described in this ACAN may submit a Statement of Capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. MANDATORY TECHNICAL SPECIFICATIONS Concentration Range Water Vapor: 1000 - 60000 ppm (non-condensing) Maximum Drift Water Vapor: (15-minute average at STP over 24 hrs) d18O: 0.2 per mild2H: 0.8 per mil H2O: 0.1% Precision (1s, 10 seconds/100 seconds) Water Vapor: d18O: 0.15 / 0.05 d2H: 0.5 / 0.2 [H2O]: 0.2% / 0.07% Liquid Water: 0.12 for 18O/16O 0.4 for D/H Data Storage Internal Hard Drive Must be compatible with EC custom-written peak integration software - necessary for live animal studies. Outputs Digital (RS232), Ethernet, USB Throughput Liquid Water over 800 injections/day (130 samples, >110 unknowns) 4. Applicability of the Trade Agreement(s) to the procurement This procurement is subject to the following trade agreement(s): Agreement on Internal Trade (AIT) World Trade Organization - Agreement on Government Procurement (WTO-AGP) North American Free Trade Agreement (NAFTA) 5. Justification for the Pre-Identified Supplier The extensive tests and studies by Environment Canada have been based on scientific software developed specifically for LGR instruments. The instrument works with the dedicated in-house software that allows interface with the existing instruments across the laboratories and works with the current LIMS data management. The software was written with the ability to integrate vapour peaks, essential for animal studies. The software takes into account the specific instrument settings that were measured in previous studies with the same test apparatus. Results will not be achievable or transferable with a different instrument due to software compatibility. In addition to the Mandatory Specifications listed herein, in liquid mode the analyzer requires an autosampler, of which Environment Canada already has for compatibility and continuity. In vapor mode a pump-down flow rate of 80 mls per minute, and/ or the equivalent throughput of liquid water samples of 800 per day is also necessary; of which the LGR instrument facilitates. Further to the above noted reasons, the LGR Isotopic Water Analyzer is the instrument meeting the Environment Canada specified requirement of rapid cavity evacuation and between-sample throughput necessary for the custom use in the animal research studies being conducted. 6. Government Contracts Regulations Exception(s) Government Contracts Regulations Exception(s) The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work". 7. Exclusions and/ or Limited Tendering Reasons The following exclusions and/or limited tendering reasons are invoked under the: Agreement on Internal Trade (AIT) - Articles 506.12 (a) and 506.12 (b) World Trade Organization - Agreement on Government Procurement (WTO-AGP) - Article XV.1 (b) North American Free Trade Agreement (NAFTA) - Article 1016.2 (b) 8. Deliverables LGR Isotopic Water Analyzer - Model IWA-35EP (Part No. 912-0026) Period of proposed contract delivery date: March 31, 2016. Estimated Value: $ 57,800.00 USD 9. Pre-identified Supplier: Isospark Canada Ltd. 2298 Chemin St. Francois Dorval, Quebec H9P 1K2 Delivery Date: Above-mentioned You are hereby notified that the government intends to negotiate with one firm only as identified above. Should you have any questions concerning this requirement, contact the contracting officer identified above. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
