ADVANCE CONTRACT AWARD NOTICE (ACAN) 1.1 An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting officer will proceed to a full tendering process. 1.2 Public Works and Government Services Canada, on behalf of its client, the Canada Border Services Agency (CBSA), intends to enter into a contract with Canquest Communications (Wireless) Inc. of Chatham Ontario for Access and Maintenance Services. 2. REQUIREMENT: 2.1 CBSA requires a Contractor to provide the Canada Border Service Agency (CBSA) with radio system access to the Canquest-owned MPT1327 radio system, as well as corrective maintenance, radio activation, deactivation, programming and relocation services for the CBSA's user kit in the Niagara Falls - Fort Erie area. 2.2 The Contractor must, upon award of contract, provide the services described, was well as provide the coverage to the locations listed in Appendix 2 to Annex A. 3. TRADE AGREEMENT APPLICABILITY: This requirement consists of telecommunication and transmission services (FSC D304A); therefore, this procurement is excluded from the application of the World Trade Organization - Agreement on Government Procurement (WTO-AGP), the North American Free Trade Agreement (NAFTA), the Canada-Chile Free Trade Agreement (CCFTA) and the Canada-Peru Free Trade Agreement (CPFTA). The Agreement on Internal Trade (AIT) is applicable. The Advanced Contract Award Notice (ACAN) will be posted on the Government Electronic Tendering Service (GETS). Since no services will be carried out in regions that are covered by the Comprehensive Land Claims Agreements (CLCAs), notification of the requirement will not be made to the claimant group(s). Aboriginal Set Aside is not applicable, as the client has determined that this project will not be part of the Set Aside program. 4. GOVERNMENT OF CANADA CONTRACT REGULATIONS (GCRs) Article 6, d) of the GCRs is being invoked as only one individual or firm is capable of providing the service of access and maintenance etc. on the contractor-owned network in the Niagara Falls-Fort Erie area. 5. OWNERSHIP OF INTELLECTUAL PROPERTY The ownership of intellectual property will rest with the Contractor. 6. TERM OF THE CONTACT: The Contract Period begins on the date of contract award and ends on 31 March 2017. 7. ESTIMATE COST OF THE PROPOSED CONTRACT: For the contract period, the estimated contract value shall be between $2,500,000.00 - $3,350,000.00 taxes included. 8. SUPPLIER'S RIGHT TO SUBMIT A STATEMENT OF CAPABILITIES: 9.1 Suppliers who consider themselves fully qualified and available to provide the services/goods described in this Notice, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. 9.2 The statement must demonstrate the supplier's ability to meet the terms of the contract by detailing the existing access infrastructure and maintenance service which would satisfy the requirement described in the Annex A -Statement of Work as well as the coverage described in Appendix 2 to Annex A. 9.3 The supplier must include the following information with its statement of capabilities: a) compatibility with existing MPT1327 portable and mobile radios; b) a detailed coverage map of each repeater tower site; c) system's capability to process alarm signals generated by portable radios; and d) demonstrate how the proposed system meets in-building coverage requirements. all of which must satisfy the requirements of the contract. 9.4 All statements of capabilities received by the time frame indicated in the ACAN will be reviewed by the contracting officer. 9.5 When a supplier's statement of capabilities provides sufficient information to indicate that it meets the requirements set out in the ACAN, the supplier is notified of the decision to compete the requirement before proceeding to a full bidding process. 10. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
