Purpose of an Advanced Contract Award Notice (ACAN) An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Definition of requirement The Department of Fisheries and Oceans (DFO) has a requirement for the supply of all labour, materials and engineering required to fabricate a 100ft wave tank. Existing wave tank is located at the Bedford Institute of Oceanography, Dartmouth, Nova Scotia. The new tank is to be installed at the Bedford Institute of Oceanography,Dartmouth, Nova Scotia. Also new wave tank drawing will be provided by the contractor. 3. Criteria for assessment of the Statement of Capabilities Any interested supplier must demonstrate by way of a statement of capabilities that its system meets the following requirements: The supplier must construct a carbon steel tank with dimension of 100ft long x 2ft wide x 6ft 7inches height. The steel should be 3/16 inch plates for the walls and floor. The ribbing to support the walls should be ¼ inch thick. The supplier should visit the site and inspect the existing tank to ensure they can duplicate the fabrication of it. Flow-through- The supplier will supply a tank that will contain a series of ½ inch threated coupling 6 inches apart running from the bottom to the top of the tank. These will be placed on both sides in the front of the tank at 9ft 10 inches from the inside front end. Also, at the back of the tank on both sides 8ft from the inside back end. Drainage system- The supplier will supply a tank with drain holes at the very far back and front of the tank. The drain holes will be designed to accommodate a 3 inch diameter drain pipe and they will be situated 6 inches from the end walls and on the center from the inside side walls. Stabilizing supports- The supplier will supply a tank that will have side stabilizing supports that will be bolted along the length of both sides of the tank. The supplier should inspect the site prior to mounting the stabilizing supports to ensure they line up with the concrete pad that will support the tank.. This will provide the necessary information to determine where the support arms should be situated. Exterior protection and site delivery- The supplier will supply a tank that will be sandblasted and painted. The paint will need to be a marine base to protect from salt water corrosion. Two coats of paint are required. Supplier will be required to make arrangements to deliver the new tank and have it placed on a concrete pad in a location requested by DFO. The supplier will be responsible to delivery the 100ft wave tank on or before March 28, 2013. Applicability of the trade agreements to the procurement This procurement is subject to the following trade agreements: Agreement on Internal Trade (AIT), North American Free Trade Agreement (NAFTA), Canada-Chile, Canada-Peru and Canada-Colombia trade agreements. 5. Set-aside under the Procurement Strategy for Aboriginal Business This requirement is not subject to a set-aside under the procurement strategy for Aboriginal Business. 6. Comprehensive Land Claims Agreement(s) Comprehensive Land Claim Agreements does not apply to this procurement. 7. Justification for the Pre-Identified Supplier Canadian Maritime Engineering is the designer, sole producer and owns the rights to the designs and construction drawings which is required to duplicate the 100 ft wave tank. 8. Government Contracts Regulations Exception(s) The following exception to the Government Contracts Regulations is invoked for this procurement under subsection: subsection 6(d) - "only one person is capable of performing the work"). 9. Exclusions and/or Limited Tendering Reasons The following exclusion and/or limited tendering reasons are invoked under the section of the trade agreements specified: Agreement on Internal Trade (AIT) - Article 506 paragraph 11 and 12. North American Free Trade Agreement (NAFTA) - Article 1016. 10. Ownership of Intellectual Property. Ownership of any Foreground Intellectual Property arising out of the proposed contract will vest in the Contractor. 11. The period of the proposed contract or the delivery date The system must be delivered on March 31, 2013. 12. A cost estimate of the proposed contract The estimated value of the contract, is $68,426.00 (GST/HST extra). 13. Suppliers' right to submit a statement of capabilities Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN, may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 15. The closing date for a submission of a statement of capabilities. The closing date and time for accepting statements of capabilities is February 19, 2013 at 2:00 p.m. EST. 16. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
