An Advanced Contract Award Notice (ACAN) is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Definition of requirement Simulation and validation activities will be performed in support of new Multi Role Boat systems that the Royal Canadian Navy is considering procuring. The simulation and validation activities shall be performed using the Ship Mechanical Systems Application Programmer Interface (SMS API) that was previously developed by Dynamic Systems Analysis Limited (DSA) for DRDC Atlantic. The Contractor shall integrate ShipMo3D hydrodynamic forces including interaction forces into the simulation. The Contractor shall perform simulations of existing and nominal new boats being launched from the HALIFAX class. The Contractor shall produce new complete user documentation of input files for the SMS API. This new input file documentation shall consolidate all existing input file documentation, including revisions that have been made to input file formats. The Contractor shall also perform validation simulations for comparison with sea trials that will be conducted with HMCS ATHABASKAN or other similar ship. 3. Criteria for assessment of the Statement of Capabilities Any interested supplier must demonstrate by way of a statement of capabilities that its services meets the the requirements that are detailed herein. 4. Justification for the Pre-Identified Supplier It is proposed that this contract be awarded to DSA. DSA is the only company that has detailed knowledge and experience of the SMS API, which will be the main software component of the proposed simulation. Furthermore, DSA has detailed knowledge and experience for application of the SMS API to simulate the launch and recovery of a small boat from a ship. The SMS API software is being used for this contract because it has been proven in previous simulation work and because the Government of Canada owns the software. 5. Government Contracts Regulations Exception(s) The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work". 6. Ownership of Intellectual Property This requirement has been reviewed in accordance with "Basis For DRDC Ownership of Intellectual Property Arising From DRDC Contracts" form and it has been determined that the Intellectual Property arising from this requirement should rest with the Crown. Canada intends to retain ownership of any Intellectual Property arising out of the proposed contract, under the following Exceptions: (6.4.2) the main purpose of the contract, or of the deliverables contracted for, is to augment an existing body of Canada's background information as a prerequisite to the transfer of the augmented background to the private sector, through licensing or assignment of ownership (not necessarily to the original contractor), for the purposes of commercial exploitation; (6.4.3) the main purpose of the contract, or of the deliverables contracted for, is to deliver a component or subsystem that will be incorporated into a complete system at a later date, as a prerequisite to the planned transfer of the complete system to the private sector, through licensing or assignment of ownership, for purposes of commercial exploitation; 7. The period of the proposed contract The proposed contract is from the date of contract award, to March 31, 2014 for Part 1 of the proposed requirement and part 2 to be completed by November 30, 2014. 8. A cost estimate of the proposed contract The estimated value of the contract is $30,000.00 (GST/HST extra) for fiscal year ending in March 31, 2014 and $40,000.00 (GST/HST extra) for part 2 (to be completed by November 30, 2014). 9. The closing date for a submission of a statement of capabilities The closing date and time for accepting statements of capabilities is February 6th, 2014 at 2:00 P.M. ADT. 12. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
