Trade Agreement: NAFTA/AIT/Canada-Peru FTA/Canada-Colombia FTA Tendering Procedures: Attachment: None Non-Competitive Procurement Strategy: Exclusive Rights Comprehensive Land Claim Agreement: No Vendor Name and Address: Georgian College of Applied Arts & Technology Georgian College One Georgian Drive Barrie Ontario Canada L4M3X9 Nature of Requirements: RENTAL OF EDUCATION FACILITY The Department of National Defence, Canadian Forces Support Training Group (CFSTG) has a requirement for the rental of education cooking labs (kitchens) for 62 days from 25 June 2012 to 25 August 2012. The facility is required to conduct Cook Qualifications Level 3 Land Reserve Pilot Course, for 24 Canadian Forces Reservists (students). The facility requirements and services required are outlined below. Minimum Essential Requirements Any interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements: 1. Location: The facility must be located within 30 kilometers of CFB Borden, Borden, Ontario. 2. Provision of: a) Dedicated use of 2 cooking labs (kitchens) with individual workstations for 24 students from 1500 hours to 2400 hours Monday to Friday and half days on Saturday for a total of 49.5 days, including the use of small wares, exclusive use of 1 walk in refrigerator, 1 walk in freezer and a caged storage unit, and all gas, utilities, chemicals, cleaning supplies and personal protective equipment as required; b) A receiving area in close proximity to the cooking labs for delivery of DND provided rations from 0800 hours to 1600 hours; c) 3 classrooms ( 2 will be used for theory instruction, 12 students per classroom and 1 for office use for up to 11 instructors), as close to the cooking labs as possible, audio/video equipped with computer podium and power point; d) Access to Internet; e) Change rooms with showers and 30 lockers located as close to the cooking labs as possible; f) 4 parking spaces and passes if required; and g) Hot dinner buffet for 30 students/instructors 5 days per week at 1950 hours for a total of 45 days. Trade Agreements This procurement is subject to the Agreement on Internal Trade, and the North American Free Trade Agreement. Justification for the Pre-Identified Supplier Students and instructors will be quartered at CFB Borden, Borden, Ontario and will be transported on a daily basis to and from the educational facility. It is essential that the facility be located within 30 kilometers of the Base to keep transportation time and cost to a minimum. In addition, this is a pilot course requiring increased on-site administrative oversight which will be provided by instructional subject matter expertise resident at CFB Borden. The proposed contractor, Georgian College, Georgian Conference Services, Barrie, Ontario is the only source within 30 kilometers of CFB Borden that can provide the required facilities and services. Applicable Exceptions/Exclusions The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6 (d) - only one person is capable of performing the work" The following limited tendering reasons are invoked under the section of the trade agreements specified.: Agreement on Internal Trade - Article 506.12 (b) - "where there is an absence of competition for technical reasons and the goods or services can be supplied by a particular supplier and on alternative or substitute exists." North American Free Trade Agreement - Article 1016, 2 (b) -"where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists. Estimated Value The estimated value of the contract is $120,000.00 to $135,000.00 HSTI. Delivery Date: Above-mentioned You are hereby notified that the government intends to negotiate with one firm only as identified above. Should you have any questions concerning this requirement, contact the contracting officer identified above. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
