Advance Contract Award Notice (ACAN) An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Definition of the requirement The Department of National Defence has a requirement for the supply of one unit of a man portable, lightweight, deployable Mass Spectrometer (LTDMS), a warranty and support package, and operator training to the Canadian Armed Forces (CAF) Level Two Technical Exploitation Capability (L2EC). It is intended to utilize the equipment in applications where confirmatory or attributable chemical analysis cannot be accomplished using larger, bench mounted Gas Chromograph Mass Spectrometer (GCMS). 3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements) The following essential characteristics must be met: a. The Mass Spectrometer (MS) must be man- portable; b. The MS must be both accurate and precise. Accurate, in that the MS correctly identifies the substance being tested 90% of the time or better. Precise, in that the MS repeats or reproduces the same measurement consistently; c. The MS must permit use by a single trained operator; d. The MS must provide onboard identification of a range of chemicals with the ability to expand the library. The range of chemicals must include but are not limited to: triethylamine, triethylphosphate, triisopropyl phosphate, trimethyl phosphate, pinacolyl alcohol, dimethylmethylphosphonate, diethylethylphosphonate, acetone, black powder, camphor, 2,6-DNT, urea nitrate, 2-chloroethyl ethyl sulfide, acrolein, acrylonitrile, allyl alcohol, allyl amine, benzoyl chloride; e. The MS (including battery) must weigh less than 3.0 kg (6.5 lbs); f. The components required for the MS to perform its tasks must be contained in a single hand-held independent unit. g. The MS must function in various environmental conditions, including: • Conditions where humidity is not controlled; • Operation in temperatures that range from -46 degrees Celsius to +49 degrees Celsius; and • Exposure to wind, rain, ice, snow, sand or direct sunlight for extended periods of time. h. The MS must be easy to clean when contaminated due to chemical exposures. i. The system must have the following features, including but not limited to: • Detection and presumptive identification of threats in all three phases (gas, liquid/vapour or solid) under field conditions; • Detection and confirmatory identification when used with other test equipment of threats in all three phases under laboratory conditions; and • Remote monitoring of exploitation operations in non-traditional environments (e.g. sampling suspected chemical mixtures or Home Made Explosive precursors/samples where Command would benefit from real time observation), where the bench mounted GCMS equipment used by the L2EC would not be feasible for use; j. The MS must have a m/z (amu) range of 60 to 400 enabling a variety of chemical threats to be detected and identified to include Toxic Industrial Chemicals (TICs), Chemical Warfare Agents (CWAs) and explosives; k. The MS must have multiple modes of operation including but not limited to gas/vapour mode and solid/liquid mode for both bulk and trace quantities. • Trace is accepted as those samples which cannot be seen or smelled. • Bulk is scientifically accepted as samples which can be seen. l. The MS must work in a continuous gas/vapour mode providing real-time monitoring of airborne threats with a sample flow of no less than 1L/min; m. The MS must be operated with ruggedized physical buttons designed for operators in cumbersome protective gear that limits sight, tactile touch and grip. The user interface must be designed to simplify instrument operation. The buttons that operate the MS must be raised for ease of use for personnel wearing thick gloves but the on/off switch must be recessed to prevent the accidental turning off of the unit during an operation; and n. The MS must have a maximum response time between 30 and 60 seconds in continuous sampling mode. o. The MS must allow positive identification in the presence of target chemicals at parts per billion (ppb) levels. 4. Applicability of the trade agreement(s) to the procurement This procurement is subject to the following trade agreements: • Agreement on Internal Trade (AIT) • North American Free Trade Agreement (NAFTA) 5. Justification for the Pre-Identified Supplier The M908 Handheld Mass Spectrometer technology is the only solution to meet the DND's needs. Visiontech (2008) Limited is the sole and exclusive distributor authorized by 908 Devises Inc to sell and support the equipment in Canada. 6. Government Contracts Regulations Exception The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - only one person is capable of performing the work. 7. Exclusions and/or Limited Tendering Reasons The following exclusion(s) and/or limited tendering reasons are invoked under the: · Agreement on Internal Trade (AIT) - Article 506: 12. Where only one supplier is able to meet the requirements of a procurement, an entity may use procurement procedures that are different from those described in paragraphs 1 through 10 in the following circumstance: b) where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particular supplier and no alternative or substitute exists; · North American Free Trade Agreement (NAFTA) - Article1016: Limited Tendering Procedures: 2. An entity may use limited tendering procedures in the following circumstances and subject to the following conditions, as applicable: b) where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists 8. Ownership of Intellectual Property Ownership of any Foreground Intellectual Property arising out of the proposed contract will vest in the Contractor. 9. Period of the proposed contract or delivery date The equipment must be delivered on or before December 15, 2015. 10. Suppliers' right to submit a statement of capabilities Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 12. Closing date for a submission of a statement of capabilities The closing date and time for accepting statements of capabilities is on October 7, 2015 at 2:00p.m. EDT. 13. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
