Advance Contract Award Notice (ACAN) An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Definition of Requirement Department of National Defence - Canadian Forces Base (CFB) Borden requires the supply and delivery of one (1) SPX Flow Lightnin Aerator Mixer Assembly Model 76Q25 (LAR-100) for Wastewater Treatment. The current Treatment Plant has 2 basins with aerator mixer assemblies; Aerator #2 assembly requires a replacement unit The unit must fully integrate with existing DND infrastructure at the Wastewater Plant. DND conducts wastewater treatment at CFB Borden under Environment Canada with discharged effluent meeting guidelines for a Class 1 fishery. The unit must perform equal to existing infrastructure as secondary clarification and settling treatment relies solely on the aerator mixer performance. Using this same instrument allows DND CFB-Borden to perform continued treatment processes without adverse effects to the receiving waters. 3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements) Any interested suppliers must demonstrate by way of a statement of capabilities that meets each of the following requirements under section 3.1. 3.1 Technical Specifications - Aerator Mixer Assembly The Aerator Mixer Assembly must have each of the following specifications: 1. Impeller Specifications 4.1 Mid(1), 71.0 inches A200 with 45 degree Tip Chord Angle 4.2 Keyed with plus 9.0/minus 9.0 adjustments 4.3 86 inches 4.4 Special Impeller 1 / Lower, 37 A201 up-pumping impeller, with stabilizer, 30 off-bottom. 4. Justification for the Pre-Identified Supplier The Lightnin Aerator Mixer Assembly Model 76Q25 (LAR-100) manufactured by SPX Flow, US LLC., is the only known instrument that meets all of the minimum essential requirements listed in Section 3 above. SPX Flow, US LLC, is the original equipment manufacturer (OEM) of the Aerator Mixer Assembly, and owner of all related Intellectual Property that can supply and deliver an instrument meeting all of the minimum essential requirements. The OEM does not authorize other value-added resellers or distributors for SPX Flow, US LLC, equipment, and therefore they are the only supplier for this equipment. As the sole supplier, SPX Flow, US LLC., at 135 Mt. Read Blvd, Rochester, New York 14611 United States, was selected as the Contractor of choice. The requested Lightnin Aerator Mixer Assembly Model 76Q25 (LAR-100) must be and is fully compatible with current structural setup and limitations where the aeration tank is to be installed. Environmental compliance issues will arise if aeration capabilities are not maintained and limited to the current structural setup. The mixer is the only unit that is compatible with the concrete structure currently in place, which also provides for full and proper access control. Proper coagulation and flocculation in the activated sludge process is achieved by design and hydraulics with the current mixer assembly and original concrete structure; this ensures optimum performance for environmental compliance. 6. Government Contracts Regulations Exception(s) The following exception(s) to the Government Contracts Regulations is (are) invoked for this procurement under subsection: 6(d) - "only one person is capable of performing the work"). 6.1 The Canadian Free Trade Agreement (CFTA) is applicable to this requirement. Limited Tendering is applicable under paragraph 1 through 3 of Article 513, specifically (b)(ii) where, the goods or services can be supplied by a particular supplier an no reasonable alternative or substitute goods or services exist for any of the following reasons (i, ii, iii, iv, v, vi). 6.2 Canadian Free Trade Agreement with Korea Article XIII, 1.b iii. due to an absence of competition for technical reasons. 7. Ownership of Intellectual Property: There are no IP considerations with this Procurement. Ownership of any Foreground Intellectual Property arising out of the proposed contract will vest in the Contractor. 8. Period of the proposed contract or delivery date: The immediate deliverable required must be supplied and delivered no later than August 30, 2021 with a preferred supply and delivery date of June 30, 2021. 9. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 11. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
