Trade Agreement: WTO-AGP/NAFTA/AIT/Canada-Peru FTA/Canada-Colombia FTA Tendering Procedures: Generally only one firm has been invited to bid Attachment: None Non-Competitive Procurement Strategy: Exclusive Rights Comprehensive Land Claim Agreement: No Vendor Name and Address: LBI, Incorporated 973 North Road Groton Connecticut United States 06340 Nature of Requirements: AXIB Arctic Weather Buoys Environment Canada, Meteorological Service of Canada, has a firm and optional requirements for the supply and delivery of Air Deployable AXIB Arctic Weather Buoys and Ship Deployable AXIB Arctic Weather Buoys. Firm Requirement: For the supply and delivery of five (5) Air Deployable AXIB Arctic Weather Buoys, to be delivered on or before 29 March 2013. Optional Requirements: Option to purchase additional quantities and/or goods during the period of contract from date of contract to 31 March 2016 as follows: - From date of contract to 31 March 2013 - up to qty. of 10 Air Deployable AXIB Arctic Weather Buoys; - From 1 April 2013 to 31 March 2014 - up to qty. of 10 Air Deployable AXIB Arctic Weather Buoys; and up to qty. of 10 Ship Deployed AXIB Arctic Weather Buoys; - From 1 April 2014 to 31 March 2015 - up to qty. of 10 Air Deployable AXIB Arctic Weather Buoys; and up to qty. of 10 Ship Deployed AXIB Arctic Weather Buoys; and - From 1 April 2015 to 31 March 2016 - up to qty. of 10 Air Deployable AXIB Arctic Weather Buoys; and up to qty. of 10 Ship Deployed AXIB Arctic Weather Buoys. This requirement is subject to WTO-AGP; NAFTA; Canada-Peru FTA, Canada-Colombia FTA, and AIT, and under these trade agreements, it is intended to carry out limited tendering process and direct this requirement to LBI, Incorporated, located in Groton, CT USA, the only manufacturer who currently manufactures AXIB Arctic Weather buoys (air and ship deployable). It is the only buoy on the market with the range of sensors integrated into the system that has the proven reliable performance in extremely harsh environment and can survive the Arctic freeze-thaw cycle while deployed on ice or in water. The unique design of the AXIB has a proven in-field operational lifetime of minimum of 18 months in the extreme Arctic environment, which is ideal for insitu marine monitoring, especially in growing areas of marginal first year ice, which have proven to be difficult to monitor using traditional ice buoy. As well, the Air Deployable AXIB Buoys have demonstrated successful deployment from C-130 aircraft in Arctic deployment. Therefore, based on the absence of competition for technical reasons and the goods can only be supplied by the proposed contractor as no alternative exists, it is intended to sole source to LBI, Incorporated. The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6 (d), only one person or firm is capable of performing the contract. The following limited tendering reasons are invoked under the section of the trade agreements specified: - WTO-AGP- Article XV, subsection 1 (b); - NAFTA - Article 1016, subsection 2(b); and - AIT - Article 506, subsection 12(b). The estimated value of the proposed contract, including optional requirement is $ 1,655,701.20 (GST/HST extra). Delivery Date: Above-mentioned You are hereby notified that the government intends to negotiate with one firm only as identified above. Should you have any questions concerning this requirement, contact the contracting officer identified above. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
