Advance Contract Award Notice (ACAN) An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Definition of the requirement For the supply and delivery of (3) AA3 COLORIMETER for the department on Environment Canada, Burlington, Ontario. BACKGROUND Environment Canada (EC) currently have fourteen (14) AA3 colorimeter systems in the National Laboratory for Environmental Testing. Nine of these systems are located in the Burlington Laboratory at the Canada Centre for Inland Waters, Burlington, Ontario. Five of these systems are located in the Saskatoon Laboratory at the National Hydrology Research Centre, Saskatoon, SK. The new equipment must be compatible with the existing Software, AACE 6.0, on a Windows 7 OS, and with all high resolution colorimeters purchased prior to 2015. The modules of these instruments must be interchangeable with pre-existing instrumentation. EC currently have software and data management/import systems in place to process and import data into the National Laboratory Information Management System (NLIMS). The software must be compatible with the existing NLIMS. 3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements) Any interested supplier must demonstrate by way of a statement of capabilities that its equipment meets the following Specifications: SPECIFICATIONS: Each AA3 Colorimeter system must consists of 3 modules: 1) Auto sampler 2) Chemistry Module 3) High Resolution Digital Colorimeter The XYZ Sampler 3racks 270 sample cups: 0.5 mL or 2 mL, or 180 cups 4mL or 5 mL. Other racks are available for different sample tubes. User-defined special sample racks can be used. Separate rack for calibration and quality control standards. Sampler can access any cup at any time. This enables duplicate sampling and automatic repeats of off-scale or carryover-affected samples. Calibration and quality control standards can be taken from the same cup as often as required. Sample probes for all sample types, including acidic samples. The Sampler 6 Carousel 89 positions Sampler can access any cup at any time. This enables duplicate sampling and automatic repeats of off-scale or carryover-affected samples. Calibration and qualitycontrol standards can betaken from the same cup as often as required. Sample probes for all sample types, including acidic samples. The Chemistry Module Holds up to two analytical cartridges. Method documentation includes preparation for reagents and standards, performance data, reagent safety data, manifold description with part numbers, list of spares and consumables with part numbers. Hydraulic components are glass, chosen for its inert chemical properties. Mixing coils are mounted on thesurface of the method cartridge for easy operator verification of correct performance. Hydraulic component internal diameter is 2.0 mm to limit the risk of blockage from dirty samples. Heating bath has high accuracy proportional control and user-replaceable coil. Optional dialyzer is available to eliminate interference from coloured samples, such as wastewater, without filtration. Leak detector prevents damage to the analyzer in the event of spilt chemicals. Test Cartridge - The offered cartridges are multi-test and arecapable of running other EPA -approved chemistries sequentially. Method documentation is as supplied. High Resolution Dual Channel Colorimeter: Dual Beam detection system with same wavelength correction for high stability. Maximum-sensitivity 0.0000001-0.000001 Abs (wavelength dependant) enables ultra-low concentrations to be measured accurately and provides low detection limit. 8,000,000 digital resolution for wide analytical range. No de-bubbling necessary - software de-bubbling algorithm performed, hence reducing carryover. Baseline and sensitivity setting controlled automatically from PC. No user adjustment needed when new lamp or flow cell installed. 10mm, 30mm, 50mm or 500mm flow cells can be fitted according to method sensitivity requirements. Flow cell and transmission tubing are contained inside the photometer housing for optimum temperature equilibration and added protection of the flowcell and connections. Accessory kit with spare lamp, blank flow cell assembly, special tools. Extended wavelength range 350-900 nm for extended sensitivity at low- to mid- wavelengths. 4. Applicability of the trade agreement(s) to the procurement This procurement is subject to the following trade agreement(s): a. Agreement on Internal Trade (AIT) b. North American Free Trade Agreement (NAFTA) 5. Justifications for the Pre-Identified Supplier The supplier selected in advance and identified: Folio Instrument Inc. Is the only known supplier meeting all the specifications required insection 3, and is compatible with the existing systems in place. Folio Instrument Inc. is the Canadian distributor. They are the only distributor for Seal Analytical, the manufacturer of AA3 colorimeters. There are no other distributors of Seal Analytical Instruments in Canada. Seal Analytical Instruments is the only manufacturer of AA3 colorimeters compatible with the AA3 systems currently in place within ECCC. 6. Government Contracts Regulations Exception(s) The following exception(s) to theGovernment Contracts Regulations is (are) invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work"). 7. Exclusions and/or Limited Tendering Reasons The following exclusion(s) and/or limited tenderingreasons are invoked under the: Agreement on Internal Trade (AIT) Article 506: 12. Where only one supplier is able to meet the requirements of a procurement, an entity may use procurement procedures that are different from those described in paragraphs 1 through 10 in the following circumstance: b) Where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particular supplier and no alternative or substitute exists; North American Free Trade Agreement (NAFTA) Article1016: Limited Tendering Procedures: 2. An entity may use limited tendering procedures in the following circumstances and subject to the following conditions, as applicable: b) Where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only bya particular supplier and no reasonable alternative or substitute exists. 8. Delivery date The delivery of the AA3 must be delivered as soon as possible, but no later than 31 March 2017. 9. Cost estimate of the proposed contract The estimated value of the contract is CDN $71,000 HSTI. 11. Suppliers' right to submit a statement of capabilities Suppliers who consider themselves fully qualified and availableto provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilitiesmust clearly demonstrate how the supplier meets the advertised requirements. 12. Closing date for a submission of a statement of capabilities The closing date and time for accepting statements of capabilities is: December 16th, 2016 at 2:00 p.m. EST. 13. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
