    An ACAN is a public notice indicating to the supplier community
    that a department or agency intends to award a contract for
    goods, services or construction to a pre-identified supplier,
    thereby allowing other suppliers to signal their interest in
    bidding, by submitting a statement of capabilities. If no
    supplier submits a statement of capabilities that meets the
    requirements set out in the ACAN, on or before the closing date
    stated in the ACAN, the contracting officer may then proceed
    with the award.
    
    
    1.  Requirement
    
    It is the intent of Public Works & Government Services Canada
    (PWGSC), on behalf of Agriculture and Agri-Food Canada (AAFC),
    to negotiate on a sole source basis with Thermo Fisher
    Scientific Inc for the provision of the following:
    
    Support plan coverage, covering repairs, software upgrades and
    preventative maintenance, for a Linear Quadrupole Ion Trap Mass
    Spectrometer (LTQ11030).
    
    Deliverables
    
    The service contract shall provide the following:
    1.	Unlimited number of demand on-site service visits with a
    maximum 72h response, including 		labour and travel costs. Once
    completed to the satisfaction of the supervising scientists, a
    		document detailing the service call is signed by both parties.
    2.	Priority status for phoned-in technical support inquiries,
    response within 2h.
    3.	One annual scheduled preventative maintenance visit.  This is
    generally completed at the end of 		the contract, and once
    completed to the satisfaction of the supervising scientists, a
    document 		detailing the maintenance visit is signed by both
    parties.
    4.	Coverage extends to ThermoFisher-supplied computer hardware
    and software updates.
    5.	Factory-certified replacement parts are included.
    6.	Access to available on-line support resources.
    	
    
    Statement of Capabilities:
    
    Must provide written certification from the Original Equipment
    Manufacturer (Thermo Fisher Scientific) that they are authorized
    to;
    
    -	Perform repairs
    -	Provide parts
    -	Provide Service
    -	Provide Warranty
    -	Provide technical assistance 
    -	Provide telephone support
    
    2.  Trade Agreement
    
    This procurement is subject to the following trade agreement:
    North American Free Trade Agreement (NAFTA); 
    
    3. Government Contracts Regulations Exception
    
    Section 6 of the Government Contract Regulations applies as only
    one person or firm is capable of performing the contract.
    
    4. Exclusions and/or Limited Tendering Process
    
    Article 1016.2(b) of NAFTA is applicable as this requirement can
    be fulfilled by only one supplier.
    
    
    5. Period of the Proposed Contract 
    
    The period of the Contract is for one year from date of award
    (approximately 01 May 2012) with Canada retaining an irrevocable
    option to extend the Contract for an additional two (2)
    consecutive one (1) year periods.
    
    6.  Estimated Cost
    
    The estimated value of the Contract, including option years is
    $86,000.00CAD (including GST).

    Suppliers who consider themselves fully qualified and available

    person identified in this Notice on or before the closing date
    of this Notice. The statement of capabilities must clearly
    demonstrate how the supplier meets the advertised requirements.

    You are hereby notified that the government intends to negotiate
    with one firm only as identified above. Should you have any
    questions concerning this requirement, contact the contracting
    officer identified above.
    
    An Advance Contract Award Notice (ACAN) allows departments and
    agencies to post a notice, for no less than fifteen (15)
    calendar days, indicating to the supplier community that it
    intends to award a good, service or construction contract to a
    pre-identified contractor. If no other supplier submits, on or
    before the closing date, a Statement of Capabilities that meets
    the requirements set out in the ACAN, the contracting authority
    may then proceed with the award.  However, should a Statement of
    Capabilities be found to meet the requirements set out in the
    ACAN, then the contracting authority will proceed to a full
    tendering process.
    
    Suppliers who consider themselves fully qualified and available
    to provide the services/goods described herein, may submit a
    statement of capabilities in writing to the contact person
    identified in this Notice on or before the closing date of this
    Notice. The statement of capabilities must clearly demonstrate
    how the supplier meets the advertised requirements.
    
    The PWGSC file number, the contracting officer's name and the
    closing date of the ACAN must appear on the outside of the
    envelope in block letters or, in the case of a facsimile
    transmission, on the covering page.
    
    The Crown retains the right to negotiate with suppliers on any
    procurement.
    
    Documents may be submitted in either official language of Canada.
